1998-090-RES WHEREAS, COP DID HERETOFORE ON THE 26TH DAY OF AUGUST 1991 RESOLUTION NO. 98-090 WHEREAS, the City of Paris did heretofore, on the 26th day of August, 1991, receive a Special Warranty Deed from Roy L. Smith for his interest in and to Lot 12, City Block 297, being number 2310 19th Street N.W.; and, WHEREAS, the City Council of the City of Paris is in receipt of a request from Olma Smith Leinart, the other heir to said property, to convey to her the City of Paris's interest in and to the same in order to keep the property in her family; and, WHEREAS, Ms. Leinart did heretofore, on the 7th day of July, 1998, sign a Contract of Sale and Purchase whereby she agrees to pay to all taxing entities the full amount of all taxes that would have been payable on the property for the years 1991 through 1997 and to pay all of the 1998 taxes when due; and, WHEREAS, it is deemed to be in the best interests of the citizens of Paris that the City of Paris convey its interest in and to said property to Ms. Leinart in order that the same can be placed back on the tax rolls; and, WHEREAS, the form of the Quitclaim Deed, attached hereto as Exhibit A, should, in all things, be approved, and the Mayor, Charles H. Neeley, should be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the conveyance by the City of Paris of its interest in and to Lot 12, City Block 297, to 01ma Smith Leinart, be, and the same is hereby, approved; and, BE IT FURTHER RESOLVED, that the form of the Quitclaim Deed, attached hereto as Exhibit A, be, and the same is hereby, approved; and, BE IT FURTHER RESOLVED, that the Mayor, Charles H. Neeley, be, and he is hereby, authorized and directed to execute, on behalf of the City of Paris, the Quitclaim Deed, under the terms and conditions and in the form shown in Exhibit A, attached hereto. Neeley, duly authorized, for and in consideration of the sum of Eight Hundred Forty-Five and 97/1 00 Dollars ($845.97), in hand paid by the Grantee herein named, the receipt of which is hereby acknowledged, have QUITCLAIMED, and by these presents do QUITCLAIM, unto Olma Smith Leinart, Grantee, of the County of Lamar, State of Texas, all of its interest in and to the following described real property situated in Lamar County, Texas, to-wit: SlTUA TED within the corporate limits of the City of Paris, County of Lamar and State of Texas, a part of the Reddin Russell Survey, being a part of a 30 acre tract described in a receivers deed from Hutchison Rediever to A. Smith and wife, Carrie Smith, dated March 29, 1946, recorded in Volume 277, Page 475, Deed Records, Lamar County, Texas, also being the same property described in special warranty deed from Roy L. Smith to the City of Paris, recorded in Volume 237, Page 135, Real Property Records, Lamar County, Texas, and being more particularly described as follows: BEGINNING at a stake in the W cst Boundary Line of the above-mentioned Stephens tract at a point located 35 yards South of the Southwest Corner of a tract described in deed from A. E. Stephens and wife, Nora Stephens, to Arthur C. Maroney, dated December 13, 1945, and recorded in Volume 277, Page 335, Deed Records, Lamar County, Texas; THENCE South with the West Boundary Line of the Stephens tract a distance of 3 5 yards to a stake; THENCE East a distance of 138.3 yards to a stake; THENCE North a distance of35 yards to a stake; THENCE West parallel with the South Boundary Line of the Maroney Tract a distance of 138.3 yards to the place of beginning, containing 1 acre ofland, more or less.
