1998-066-RES WHEREAS, CITY COUNCIL DID HERETOFORE ON THE 9TH DAY OF APRIL RESOLUTION NO. 98-066 WHEREAS, the City Council of the City of Paris did heretofore, on the 9th day of April, 1984, did receive the plans for the Flow Equalization Basin Site Development Project and authorize the City Attorney to procure property for the same; and, WHEREAS, in conjunction with said Project, it is deemed appropriate that Jim N. Thompson and wife, Elizabeth Holden Thompson, be granted a thirty (30) foot ingress and egress easement along the north boundary line of the Flow Equalization Basin property; and, WHEREAS, the form of the Ingress and Egress Easement, attached hereto as Exhibit A, should, in all things, be approved, and the Mayor, Charles H. Neeley, should be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the form the Ingress and Egress Easement which grants a thirty (30) foot access easement along the north boundary line of the Flow Equalization Basin property to Jim H. Thompson and wife, Elizabeth Holden Thompson, attached hereto as Exhibit A, be, and the same is hereby, approved; and, BE IT FURTHER RESOLVED, that the Mayor, Charles H. Neeley, be, and he is hereby, authorized and directed to execute, on behalf of the City of Paris, said Ingress and Egress Easement, under the terms and conditions and in the form shown in Exhibit A, attached hereto. Foster, City Attorney INGRESS AND EGRESS EASEMENT STATE OF TEXAS } KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LAMAR } That the City of Paris, Paris, Texas, a municipal corporation of Lamar County, Texas, for and in consideration of the sum of ONE DOLLAR ($1.00) cash, and other good and valuable consideration, to it in hand paid by Jim N. Thompson and wife, Elizabeth Holden Thompson, the receipt and sufficiency of which is hereby acknowledged, does hereby sell, give and grant unto the said Jim N. Thompson and wife, Elizabeth Holden Thompson, of Lamar County, Texas, a thirty (30) foot ingress and egress easement described as follows: SITVA TED about 4 1/2 miles North of the City of Paris within the corporate limits of the City of Paris, County of Lamar, and State of Texas, a part of the John Wilson Survey, Abstract No. 981, being a part of a 100.975 acre tract described in a Deed from G. C. Darnell and wife, Lela May Darnell, to the Veterans' Land Board of Texas, dated May 27, 1959, recorded in Volume 2360, Page 457, Lamar County Deed Records, being a part of a 9.0 acre tract described as Fourth Tract in an Affidavit of Rosie Randall, dated February 15, 1952, recorded in Volume 328, Page 9, Lamar County Deed Records, and being more particularly described as follows: BEGINNING at a point in the Southwest corner of City of Paris Flow Equalization Basin property being in the East Boundary Line of Stillhouse Road; THENCE North 89040' 00" East a distance of 424.250 feet a point; THENCE North 88038' 00" East a distance of 654.140 feet to a point for corner; THENCE South a distance of 30.009 feet to a point for corner; THENCE South 880 38' 00" West a distance of 653.424 feet to a point; THENCE South 89040'00" West a distance of 423.447 feet to a point for corner; THENCE North 1052' 00" West a distance of 30.011 feet to the place of beginning, containing 0.742 acres, more or less. TO HAVE AND TO HOLD the above property unto Jim N. Thompson and wife, Elizabeth Holden Thompson, for the purposes aforesaid, with the right and privilege of ingress ... EXHIBIT A and egress on and across said land. The right of ingress and egress herein granted across the easement premises shall be exercised and used in such a manner as not to cause any damage or destruction of any nature whatsoever to or interruption of the use of the adjoining lands owner. Grantor does hereby bind itself, its successors and assigns, to warrant and forever defend, all and singular, said premises unto Jim N. Thompson and wife, Elizabeth Holden Thompson, against every person whomsoever lawfully claiming or to claim the same or any part thereof. WITNESS its hand this 8th day of June, 1998.
