1. The Board of Adjustment Board meeting was called to order by Chairman
Terry Christian at 12:00 p.m.
A. The following members were present:
Rodney Bass
Kyle Mc Carley
Howard Corriston (Arrived 12:05 p.m.)
Alternates: David Glass
Louis Yates
B. The following members were absent: None
C. Also present was Lisa Wright, Director of Community Development.
2. Approval of minutes from previous meetings. Motion to approve the minutes
of the March 21, 2006, meeting was made by David Glass, seconded by
Rodney Bass. Motion carried 5-0.
3. Motion was made to recuse Louis Yates by David Glass, seconded by Kyle
McCarley. Motion carried 4-0.
Howard Corriston arrived.
Public Hearing to consider the petition of Thou Chan to grant a variance of
Zoning Ordinance No. 1710, (1) Section 9-301, to modify the required lot depth
from 120' to 71~ which would be a 49' variance; (2) Section 9-701, to modify
the required rear setback from 10' to 6~ which would be a 4' variance; and (3)
Section 9-701, to modify the maximum rear yard building coverage from 50%
to 54.25%, which would be a 4.25% variance, on Lot 1, City Block 255-A, being
number 204 25th Street N.E. Louis Yates, the property owner's construction
contractor, stated that he can move the building line to 33' from 25th Street
N.E. to line up with the house on the north side.
4. Consideration of and action on the petition of Thou Chan to grant a variance
of Zoning Ordinance No. 1710, (1) Section 9-301, to modify the required lot
depth from 120' to 71~ which would be a 49' variance; (2) Section 9-701, to

modify the required rear setback from 10' to 6~ which would be a 4' variance;
and (3) Section 9-701, to modify the maximum rear yard building coverage
from 50% to 54.25%, which would be a 4.25% variance, on Lot 1, City Block
255-A, being number 204 25th Street N.E. Motion to grant the variance
conditioned upon the triplex being moved back to line up with the house to
the north was made by Kyle McCarley, seconded by David Glass. Motion
carried 5-0.
Motion was made for Louis Yates to return to the meeting by David Glass,
seconded by Kyle McCarley. Motion carried 5-0.
5. Public Hearing to consider the petition of Kenneth Scoff Baxley to grant a
variance of Zoning Ordinance No. 1710, Section 9-301, to modify the required
lot depth from 100' to 70~ which would be a 30' variance, on the proposed
replat of Lot 1, City Block 222, being number 198 20th Street N.E. Kenneth
Scott Baxley stated that at the time that he bought the property, he did not
realize that he could not sell it separately. He would like to be able to sell the
property separately, so he needs to plat it.
6. Consideration of and action on the petition of Kenneth Scoff Baxley to grant
a variance of Zoning Ordinance No. 1710, Section 9-301, to modify the
required lot depth from 100' to 70~ which would be a 30' variance, on the
proposed replat of Lot 1, City Block 222, being number 198 20th Street N.E.
Motion was made to approve the variance request by Rodney Bass, seconded
by Kyle McCarley. Motion carried 5-0.
7. Public Hearing to consider the petition of Chad Brown to grant a variance of
Zoning Ordinance No. 1710, Section 9-501, to modify the required front
setback from 25' to 247", which would be a 5" variance, on Lot 1, Block E, The
Hills Addition, being number 3525 Abby Lane. Chad Brown was available for
questions from the Commission.
8. Consideration of and action on the petition of Chad Brown to grant a variance
of Zoning Ordinance No. 1710, Section 9-501, to modify the required front
setback from 25' to 247", which would be a 5" variance, on Lot 1, Block E, The
Hills Addition, being number 3525 Abby Lane. Motion was made to approve
the request by Rodney Bass, seconded by David Glass. Motion carried 5-0.
9. The meeting adjourned at 12:25 p.m.
