07-E Authorize City Mgr to cast vote-TML Benefits Pool DRAFT RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AUTHORIZING THE CITY MANAGER TO CAST THE VOTE FOR THE CITY OF PARIS FOR THE TML INTERGOVERNMENTAL EMPLOYEE BENEFITS POOL BOARD OF TRUSTEES - TML REGION 15 BALLOT FOR JAMES J. STOKES; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of Paris is a member of the TML Intergovernmental Employee Benefits Pool through which it provides health benefits coverage to the City's officers and employees and to their dependents; WHEREAS, the City desires to cast a vote in the 2006 election for regional representation on the Board of Trustees of the TML Intergovernmental Employee Benefits Pool; and WHEREAS, the City Council of the City of Paris has been informed by the Texas Municipal League Intergovernmental Employee Benefits Pool that nominees for an election of a member of the Board of Trustees of the Employee Benefits Pool for a term of office from October 1, 2006 through September 30, 2009 are to be mailed to the Board Secretary no later than 5:00 p.m. (CST) on September 26,2006, and WHEREAS, the City of Paris believes that James 1. Stokes is the nominee most qualified to serve as regional representative on the Board of Trustees of the TML Intergovernmental Employee Benefits Pool; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the City of Paris hereby decides to vote for James 1. Stokes as its regional representative on the Board of Trustees of the TML Intergovernmental Employee Benefits Pool. Section 3. That the City Council of the City of Paris, hereby authorizes Tony Williams, City Manager, to cast its vote for the TML Intergovernmental Employee Benefits Pool Board of Trustees - TML Region 15. Section 4. That the City Clerk, be, and she is hereby, directed to timely deliver a copy of this Resolution to the Board Secretary of the Texas Municipal League Intergovernmental Employee Benefits Pool Board of Trustees. Section 5. It is hereby officially found and determined that the meeting at which this Resolution was considered was open to the public as required and that public notice of the time, place, and purpose of said meeting was given as required r" by the Open Meetings Act, Chapter 551 of the Texas Government Code. All qualified nominees appear on the ballot. Please see that this ballot is placed on the agenda for the next meeting of your governing body. To be counted, ballots must certify that the vote was taken at an official meeting of the governing body. Facsimile ballots will not be accepted. Enclosed is a pre-addressed envelope to return your ballot. The Board Secretary must receive ballots by 5:00 p.m. (CST) on September 26,2006 at Bickerstaff, Heath, Pollan & Caroom, L.L.P., 816 Congress Ave., Suite 1700, Austin, Texas 78701-2443. The term of office will be from October 1, 2006 through September 30, 2009 for the individual elected. The Tmst Agreement provides that "if more than two (2) candidates are running, the person receiving the largest number of votes shall be elected." Further, the Tmst Agreement provides "write-in candidates otherwise duly qualified shall be eligible for election." To be duly qualified the individual must be either an employee or elected official of an incorporated city within the state of Texas, which is a Member of the Pool at the time of their election. A municipal "employee" is a person who holds a position of Department Head or higher; works at least 20 hours per week for an incorporated city; is paid by the incorporated city with incorporated city funds; and may be hired and fired only by another incorporated city official or by the incorporated city's governing body. He has a Bachelor of Arts, Political Science from Abilene Christian College and a Master of Public Policy and Administration from Baylor University. Mr. Stokes is the current 3rd Vice President of the Gladewater Lions Club, 2/)(1 Vice President of the Gladewater Chamber of Commerce.
