RESOLUTION NO. 2006-157
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, APPROVING CHANGE ORDER NO. ONE & FINAL
TO CONTRACT FOR THE CONSTRUCTION OF THE
WASTEWATER SYSTEM IMPROVEMENTS FOR THE TEXAS
DEPARTMENT OF TRANSPORTATION PINE MILL ROAD AND
LOOP 286 NE GRADE SEPARATION PROJECT; MAKING OTHER
FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND
DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris did heretofore, on the 28th day of
August, 2006, in Resolution No. 2006-115, award the contract for "Wastewater System
Improvements for the TxDOT Pine Mill Road and Loop 286 NE Grade Separation Project,",
to B. Bray Construction of Paris, Texas; and,
WHEREAS, the City Engineer, Shawn Napier, acting as project engineer,
recommends the amendment of the contract for said project as the Contractor was able to lay
main without replacing curb and gutter, and providing for a net decrease of $10,521.11 in the
contract price, for a total contract price of$87,767.89; and,
WHEREAS, the form of Change Order No. One & Final, attached hereto as Exhibit
A, should, in all things, be approved, and the Mayor should be authorized to execute the same;
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble of this resolution are hereby in
all things approved.
Section 2. That the form of Change Order No. One & Final to the Contract for the
"Wastewater System Improvements for the TxDOT Pine Mill Road and Loop 286 NE Grade
Separation Project,", attached hereto as Exhibit A, as the Contractor was able to lay main
without replacing curb and gutter, and providing for a net decrease of$l 0,521.11 in the contract
price, for a total contract price of $87,767.89, be, and the same is hereby, approved.
Section 3. That the Mayor be, and he is hereby, authorized and directed to execute,
on behalf of the City of Paris, said Change Order No. One & Final, upon the terms and
conditions and in the form shown in Exhibit A, attached hereto.
Section 4. That this resolution shall be effective from and after the date of passage.
