05-B Board of Adjustment Min 1-3-06 MINUTES SPECIAL MEETING CITY OF PARIS BOARD OF ADJUSTMENT CITY HALL WEST ANNEX CONFERENCE ROOM 150 1 ST STREET S.E. PARIS. TEXAS WEDNESDAY. JANUARY 3. 2007 12:00 O'CLOCK NOON 1. The Board of Adjustment meeting was called to order by Chairman Terry Christian at 12:00 p.m. A. The following members were present: Rodney Bass Kyle Mc Carley Howard Corriston Chester Martindale B. The following members were absent: Alternates: Louis Yates David Glass C. Also present was Lisa A. Wright, Community Development Director. 2. Approval of minutes from previous meetings. Motion to approve the minutes of the August 29,2006, meeting was made by Kyle Mc Carley, seconded by Chester Martindale. Motion carried 5-0. 3. Public Hearing to consider the petition of Ruth Ann Alsobrook to grant a variance of Zoning Ordinance No. 1710, Section 9-602(5), to modify the required side yard setback from 25' to 14~ which would bean 11'variance, on Lot 6, City Block 119-A, being number 208 SO' Street S.~ Ms. Alsobrook stated she owns the property at 208 5th S.W. She brought photos and architectural drawings showing the carport will be compatible with the house. Ms. Alsobrook stated she has to park in front on the street and does not feel safe. She would like to park in the backyard and stated there is an existing carport there but it is in very bad condition and is too far in the back of the backyard. Chester Martindale stated he visited the house and there is no place to park. January 3, 2007 Page 2 Mr. Richard Hunt, 405 W. Kaufman, expressed concern that once you start a variance process and deal with building codes and setbacks, you have created a precedent. He asked ifthere was another position where she could put this behind the house and keep off street. Ms. Alsobrook stated that there's not room behind house because of the gas meter and an old well. The driveway off Kaufman would cut the yard into two pieces. The old well is a few feet directly behind the back door, approximately 10 steps out. Kyle Mc Carley stated that he has found that being flexible in older areas has been a good thing for the community in places where people are trying to revitalize the area. 4. Consideration of and action on petition of Ruth Ann Alsobrook to grant a variance of Zoning Ordinance No. 1710, Sections 9-501 and 9-206(5), to modify the required side yard setback from 25' to 14~ which would be an 11' variance, on Lot 6, City Block 119-A, being the number 208 SU' Street s.w: Motion by Chester Martindale, seconded by Howard Corriston, to approve the variance request. Motion carried by a vote of 5 ayes and 0 nays. 5. Public Hearing to consider the petition of Jim Coplin to grant a variance of Zoning Ordinance No. 1710, Section 9-301, to modify the required lot depth from 120' to 79~ which would be a 41'variance, on Lot4, City Block 259, being number 2565 E. Cherry Street. No one was present to speak in favor of or in opposition to the petition. 6. Consideration of and action on the petition of Jim Coplin to grant a variance of Zoning Ordinance No. 1710, Section 9-301, to modify the required lot depth from 120' to 79~ which would be a 41' variance, on Lot 4, City Block 259, being number 2565 E. Cherry Street. Motion by Chester Martindale, seconded by Rodney Bass, to approve the variance request. Motion carried by a vote of 5 ayes and 0 nays. 7. Consideration of and possible action on establishing a day of the month on which variance requests will be heard by the Board. Motion was made by Kyle Mc Carley, seconded by Rodney Bass, to establish the second Tuesday at 12:00 p.m. as a regular meeting atwhich variance requests will be heard by the Board. Motion carried by a vote of 5 ayes and 0 nays.
