the privilege to create the Northeast Texas Regional Mobility Authority (NETMOB). In

TO THE TEXAS TRANSPORTATION COMMISSION:
Pursuant to provisions of Chapter 370 of the Texas Transportation Code and 43 Tex. Admin.
Code 26.01 et.seq. Delta, Hopkins, Hunt and Lamar Counties (the "Petitioners") tender their
"Petition and request for Authorization to Form the NETMOB Regional Mobility Authority"
(NETMOB). As required by 43 Tex. Admin. Code 26.11, Petitioners submit the following in
support of their petition:
1. Commissioners Court Resolutions
On December 11,2006, the Commissioners Court of Delta County adopted a resolution
approving the creation of NET MOB.
On December 27,2006, the Commissioners Court of Hopkins County adopted a resolution
approving the creation of NETMOB.
On December 11, 2006, the Commissioners Court of Hunt County adopted a resolution
approving the creation of NETMOB.
On November 27,2006, the Commissioners Court of Lamar County adopted a resolution
approving the creation of NET MOB.
Copies of these resolutions are included herein as Attachment 1.

2. Description of Improvements to Regional Mobility
The northeast Texas region that comprises Delta, Hopkins, Hunt and Lamar Counties is
situated in an extremely strategic area of the state. IH 30 travels from Dallas to the east
through two of these counties; SH 24 travels northeast from IH 30, to Oklahoma and the
Indian Nation Turnpike, through three of these counties; and SH 19 travels due north from
IH 30, to Oklahoma and the Indian Nation Turnpike, through three of these counties.
Located just to the east of the congested Dallas-Ft Worth region, the resulting IH 30 - SH
24 - SH 19 traffic triangle connects major hubs throughout the NETMOB region.
NETMOB, working co-operatively with the Texas Department of Transportation
(TxDOT), will assist in the development, planning, designing and financing of critical
transportation projects that will serve the region's unique travel demands. These are
projects that will introduce new travel modes, enhance safety, decrease travel time, and
improve the quality ofHfe for citizens of this region, and for the state.
3. Initial RMA Proiect
The initial project that will be pursued by NETMOB is the completion of the widening of
SH 24, from a two-lane to a four-lane divided facility. SH 24 is a Texas Trunk System
route that connects two National Highway System routes. At it southernmost terminus, SH
24 intersects IH 30, approximately 9 miles south of the City of Commerce (which is the
home of Texas A&M University - Commerce). At its northernmost terminus, SH 24
intersects US 271, in the City of Paris. Further to the north, in the State of Oklahoma, US
271 intersects the Indian Nation Turnpike, and eventually IH 40. IH 30 is an east-west
facility, and US 271 / Indian Nation Turnpike is a north-south facility. Therefore, SH 24,

which runs predominately southwest to northeast, is a connector route which provides a-
suitable bypass of the metroplex for NAFT A and other through traffic.
This facility (which was originally constructed in 1924) has been converted from a rural 2-
lane facility, to a 4-lane divided facility, as is shown:

SH 24 is a section of a relief route for traffic moving from one side of the metrop1ex to the
other, without going through it. Once completely 4-laned, it will become the primary
north-south bypass for the already congested IH 35 and US 75 corridors through the
Dallas-Ft Worth region. Closing this gap will REDUCE CONGESTION and IMPROVE
AIR QUALITY in the metroplex.
SH 24 was selected as a part of the Texas Trunk System by the Texas Transportation
Commission in 1997. Closing this gap at approximately the middle of this route will
EXPAND ECONOMIC OPPORTUNITY through the NETMOB region and
INCREASE THE VALUE OF TRANSPORT A TION ASSETS.

While almost two-thirds of this route has already been 4-laned, reliance on traditional
financing for the remaining segment will delay corridor completion such that the initial
investment cannot yield its maximum benefit to the region' and the State. NETMOB will
join TxDOT in financing this project by supplementing and leveraging traditional funding
sources with local funds) as required by TxDOT. However) it is understood that neither the
Petitioners (counties) nor the cities located within the boundaries of the counties are
financially liable to NETMOB unless specific agreements are entered into obligating such
parties, Section 370.303. Transportation Code. A general description of the location ofSH
24 is shown in Attachment 2.
A. Consistency with Texas Transportation Plan and MFO Plan
The SH 24 widening project is included in the Statewide Transportation Improvement
Program (STIP) and the Unified Transp~rtation Program (UTP). None ofSH 24 is
within a Metropolitan Planning Organization (MPO).
B. Description of Known Environmental. Social. Economic or Cultural Resources Issues
The Paris District of TxDOT has conducted preliminary environmental investigations
along SH 24, within the cited limits. Potential impacts to vegetation, wetlands,
endangered species, air, water, and noise quality, hazardous materials and waste,
archaeological sites) historical structures, and economic and social conditions were
evaluated for both of these locations. They have reported to us that, at this stage of
development, they believe that potential environmental concerns will be manageable
within the scope of traditional highway projects.

C. Known Opposition and/or Controversies Regarding Proiect
There are no known (to NETMOB or the Paris District of TxDOT) opponents
to this requested project.
D. Preliminary Financing Plan
The construction cost of this project is $32 million. NETMOB will pursue a pass-
thru financing agreement with TxDOT to fund the construction and the construction
engineering costs of the project. TxDOT will provide and/or enact the environmental
document through FONSI (Finding of No Significant Impact); any required
environmental mitigation; all right-of-way mapping and acquisition documents; all
required right-of-way; and all required utility adjustments.
4. Commitment to Secure Route Studies, Environmental Approvals, Row. and Construction
Plans
NETl\10B, to the extent not otherwise undertaken by TxDOT, will be fully responsible for
identifying and securing all federal and state permits, commitments, and approvals
necessary for the development of RMA projects. NETl\10B will support and assist the
Paris District in preparing all pending route location studies, environmental impact
analysis, public meetings, roadway schematics, right-of-way maps, and plans,
specifications & estimates.
5. Board Composition
The initial board of directors for NETMOB will consist of nine (9) members serving
staggered two (2) year terms as required by statute. Board members are restricted to
serving a maximum of three consecutive terms; however, reappointment will be permitted
with a break in service. All members of the NETMOB board must reside within a

NETMOB county throughout their entire membership on the board, or they will be
removed from the board. To assure adequate representation from throughout Delta,
Hopkins, Hunt and Lamar counties, these members will be appointed as follows:
A. One (I) Presiding Officer appointed by the Governor of Texas. This person shall
reside within the RMA boundary. For each renewal term, the new Presiding Officer
appointee shall be selected from an RMA county other than the county of the
previous three appointees.
B. Two (2) Members appointed by the Delta County Commissioners Court, one
specifically representing the City of Cooper's interests.
C. Two (2) Members appointed by the Hopkins County Commissioners Court, one
specifically representing the City of Sulphur Springs' interests.
D. Two (2) Members appointed by the Hunt County Commissioners Court, one member
specifically representing the City of Commerce's interests.
E. Two (2) Members appointed by the Lamar County Commissioners Court, one
member specifically representing the City of Paris' interests.

transportation improvement projects; and,
WHEREAS, Texas voters approved Proposition ]5 in November 2001, allowing the creation of
Regional Mobility Authorities (RMA's). In June 2002, the Texas Department of Transportation
(TxDOT) adopted 43 Tex. Admin. Code, 2~.01, a set of rules for the creation and operation of
an RMA, which now have been codified by the Legislature as Chapter 370 of the Transportation
Code; and,
WHEREAS, RMA's have the ability to undertake many types of transportation improvement
projects, including: turnpikes, passenger and freight rail, pedestrian and bicycle facilities,
Intermodal hubs, and border inspection stations; and,
WHEREAS, the 4-laning of SH 24 is only partially complete, despite the assistance of TxDOT
and the Texas Transportation Commission, and,
WHEREAS, a project now requires regional support and assistance to continue its development;
and,
WHEREAS, the TxDOT plan for solving mobility problems and for the faster completion of
transportation projects focused on 5 goals: reduce congestion, enhance safety, expand economic
opportunity, improve air quality, and increase the value of transportation assets, and
WHEREAS, the counties of Delta, Hopkins, Hunt and Lamar have embraced these five TxDOT
goals as common goals for transportation improvement projects including SH 24.
NOW THEREFORE, BE IT RESOLVED THAT DELTA COUNTY COMMISSIONERS
COURT:
1. Supports the formation of the NETMOB Regional Mobility Authority (NETMOB).
2. Authorizes the Delta County Judge to execute a petition to the Texas Transportation
Commission to form NETMOB, and that the Petition will contain all the elements
required by law, including:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, DECLARING SUPPORT FOR THE ESTABLISHMENT OF
THE NORTHEAST TEXAS REGIONAL MOBILITY AUTHORITY;
DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION
WAS PASSED COMPLIED WITH THE TEXAS OPEN MEETINGS ACT;
MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE
SUBJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Paris recognizes the importance of regional partnerships to meet
common transportation goals; and,
WHEREAS, the State of Texas has established that Regional Mobility Authorities will be
important to the future development of new transportation corridors; and,
WHEREAS, the State of Texas has established new Regional Mobility Authority (RMA)
powers through the passage ofHB 3588; and,
WHEREAS, the City of Paris supports the creation of a NETMOB Regional Mobility
Authority in Northeast Texas covering Lamar, Delta, Hopkins, and Hunt Counties; and,
WHEREAS, said authority would be charged with the planning, financing, constructing,
maintaining and operating of the "Four-Laning of State Highway 19/24" highway corridor joining
communities and other major transportation corridors; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all things
approved.
Section 2. That the City of Paris supports the creation of the NETMOB Regional Mobility
Authority (RMA) to encompass Lamar, Delta, Hopkins, and Hunt Counties.
Section 3. That the City of Paris wishes to also collaborate with the Counties of Lamar,
Delta, Hopkins, and Hunt in the formation ofthe NETMOB RMA to meet common transportation
goals.
Section 4. That the City of Paris supports a Northeast Texas delegation to request the
authorization from the Texas Transportation Commission to create NETMOB RMA.
Section 5. That the meeting at which this resolution was approved was conducted in strict
compliance with the Texas Open Meetings Act. Texas Government Code Chapter 551

creation and operation of an RMA, which now have been codified by the Legislature as
Chapter 370 of the Transportation Code; and,
WHEREAS, RMA's have the ability to undertake many types of transportation
improvement projects, including: turnpikes, passenger and freight rail, pedestrian and
bicycle facilities, Intennodal hubs, and border inspection stations; and,
WHEREAS, the 4-laning of SH 24 is only partially complete, despite the assistance of
TxDOT and the Texas Transportation Commission; and,
WHEREAS, a project now requires regional support and assistance to continue its
development; and,
WHEREAS, the TxDOT plan to solve mobility problems and for the faster completion
of transportation projects with additional money to get the job done right is focused on 5
goals: reduce congestion, enhance safety, expand economic opportunity, improve air
quality, and increase the value of transportation assets, and
WHEREAS, the counties of Delta, Hopkins, Hunt and Lamar have embraced these five
TxDOT goals as common goals for transportation improvement projects consisting of SH
24.
NOW THEREFORE, BE IT RESOLVED THAT CITY OF SULPHUR SPRINGS,
TEXAS, CITY COUNCIL:
1. Supports the formation of the NETMOB Regional Mobility Authority
(NETMOB).

2. Supports the execution of a petition by the Hopkins County Judge to the Texas
Transportation Commission to form NETMOB, with the understanding that the
Petition will contain all the elements required by law, including:
· Hopkins County Commissioners Court Resolution
· Description of Proposed Priority RMA Projects
· Statement that these Proposed RMA Projects are consistent with the
approved plan of the Delta, Hopkins, Hunt and Lamar County
Transportation Plans.
· Statement of known environmental, social, economic, or cultural resource
Issues.
· Statement of known opposition andlor controversies regarding proposed
projects.
· Statement of preliminary financing plan for the initial project, SH 24.
However, it is understood that neither the County nor the Cities located
within the boundaries of the County are financially liable to the
NETMOB unless specific agreements are entered into obligating such
parties, Section 370.303. Transportation Code.
· RMA Board Structure.
