The regular meeting of the Planning and Zoning Commission on Monday, May 5, 2007, was called to order at 5:30 p.m. by Chairman Reeves Hayter. A. The following members were present: Reeves Hayter, Chairman Barbara Forrest Richard Hunt Fran Neeley Darin Manning Benny Plata B. The following members were absent: Marshall Kent, Vice-Chairman Bobby Myers Brad Archer C. Also present were Lisa Wright, Community Development Director, Shawn Napier, City Engineer, and Kent Mcllyar, City Attorney. 2. Approval of minutes from previous meetings. Motion to approve the minutes ofthe March 5, 2007,meeting was made by Reeves Hayter, seconded by Benny Plata. Motion carried 6-0. 3. Public Hearing to consider the petition of Jane Williams for a change in zoning from a Light Industrial District (L1) to a Heavy Industrial District (HI) with a Specific Use Permit (41) Wrecking or Salvage Yard on Lots 23 and 24, Block 251, being numbers 2211 and 2255 N. Main Street. The public hearing was declared open. The following individuals spoke in favor of the petition. Wayne Brown, 3055 33rd Street N.E., spoke in favor of the petition. Mr. Brown stated, since 1953, Williams operated the salvage yard on this property. Ms. Williams turned off utilities back last year and to their surprise, the classification changed. The Williams have a buyer who wants to operate r - -. salvage yard. Julio Natahl, 8040 Middle Hill, Frisco, stated he has been in salvage for 17 years in Dallas, and he wants to purchase a salvage yard in Paris. They clean cars so they're not environmental hazards before they go out to the yard. John Larkin, Larkin Environmental, presented paperwork showing that the wrecking yard's TCEQ permit is still active. He is requesting that this be permitted to reopen. Jace Horton, 5151 Loraine Drive, Frisco, is the grandson of Jane Williams. He stated that the business has been in the family for over fifty years and they employed several people. If they cannot sell it as a wrecking yard, it will be a detriment to N. Main Street. There was no opposition present, and the public hearing was declared closed. 4. Consideration of and action on the petition of Jane Williams for a change in zoning from a Light Industrial District (L1) to a Heavy Industrial District (HI) with a Specific Use Permit (41) on Lots 23 and 24, Block 251, being numbers 2211 and 2255 N. Main Street. Fran Neeley stated that this wrecking yard has been there since she can remember, and she would hate to see it go since it's a fixture to Paris. Motion was made by Fran Neeley, seconded by Benny Plata, to approve the request. Motion carried 6-0. 5. Consideration of and action on the Preliminary Plat of Lot 1 Block A, Jordan Addition (City Block 091), being located in the 500-600 block of N. Main Street. Motion was made by Benny Plata, seconded by Reeves Hayter, to approve the plat subject to the City Engineer's recommendation. Motion carried 6-0. 6. Consideration of and action on the Preliminary Plat of Lot 1 Block A, Main St. 250 Addition (City Block 250), being number 2240 N. Main Street. Shawn Napier, City Engineer, stated the back 2/3 of the lot is zoned SF-2, but they don't currently have plans to build in that area. Motion was made by Benny Plata, seconded by Darin Manning, to approve the plat subject to the City Engineer's recommendation. Motion carried 6-0. 7. Consideration of and action on the Preliminary Plat of Lot 2, Block A, Lamar Plaza (City Block 102), being located in the 1400 block of Lamar Avenue. Commissioners expressed concern about drainage and lack of access to back lot. Motion was made by Reeves Hayter, seconded by Barbara Forrest, to approve the plat subject to the City Engineer's recommendation. Motion carried 6-0. ,.. .. 8. Consideration of and action on the Preliminary Plat of Lot 1, Block A, Longhorn Addition (City Block 307), being located in the 3600 block of Loop 286 N. ~ Lisa Wright pointed out to the Commission that the hundred block listed on the agenda was incorrect, however, the legal description is correct. Motion was made by Benny Plata, seconded by Darin Manning, to approve the plat subject to the City Engineer's recommendation. Motion carried 6-0. 9. Consideration of and action on the Preliminary Plat of Lots 1 and 2, Block A, Powell Plantation (City Block 330), being located in the 3800-3900 block of Old Tiger Town Road. Motion was made by Reeves Hayter, seconded by Barbara Forrest, to approve the plat subject to the City Engineer's recommendation. Motion carried 6-0. 10. Consideration of and action on the Final Plat of Lots 1 and 2, Block A, Powell Plantation (City Block 330), being located in the 3800-3900 block of Old Tiger Town Road. Motion was made by Benny Plata, seconded by Reeves Hayter, to approve the plat subject to the correction of a typographical error in the "Acceptance" section. Motion carried 6-0. 11. Consideration of and action on recommending to the City Council an ordinance amending Zoning Ordinance No. 1710 by revising Section 21-100, providing that zoning change requests may go directly to the Planning and Zoning Commission without the necessity of a referral from the City Council. Motion was made by Fran Neeley, seconded by Benny Plata, to accept the amendment. Motion carried 6-0. 12. Consideration of and action on recommending to the City Council an ordinance adopting a new Section 5-600 to Zoning Ordinance No. 1710 to regulate outside storage in all zoning classifications. Lisa Wright explained to the Commission that this ordinance has been in the works for some time. She stated that outdoor storage was a problem around town and that Code Enforcement received complaints about this on a regular basis. As current ordinances are written, they do little to provide any guidance as to what can and what cannot be stored in the front yard. She stated that the purpose of the ordinance was not to disallow outdoor storage where the zoning ordinance already allows it or to begin allowing where the zoning ordinance currently does not. The goal is to simply help clean up the appearance of neighborhoods. She stated that the ordinance was lengthy, so she recommended that the Commission take some time to review it. Benny Plata stated that he was in favor and against at the same time, because some people are too poor to be able to do this. Ms. Wright explained that Code Enforcement will always work with people through the City's bulk sanitation services to help them clean up their properties. If they have so much junk that it takes a while to finally get it all picked up through the City, r .. since citizens can only put out so much at a time, they will give that extra time needed as long as they were making progress. She stated that it's when they aren't trying to clean up that we have a problem. Reeves Hayter stated he doesn't want to prohibit outdoor sales, and Ms. Wright said they would make an amendment to reflect that, because that is not one of the things that the ordinance is seeking to regulate in areas where those sales are permitted under the zoning ordinance. Darin Manning stated lawn equipment could be an issue, and Ms. Wright said they could put an exception in for a reasonable amount of equipment if the Commission recommended it. She said there are some homes around town where Code Enforcement has seen dozens of lawn mowers in the front yard. Fran Neeley also expressed a concern about not allowing indoor furniture on the front porch, because many people like to sit on them. Billy Bell, 2054 Cleveland Street, stated that the City has more problems than a couch on the front porch to deal with. He said to enforce what's on the books. Motion was made by Benny Plata, seconded by Fran Neeley, to table the item to allow time for a more thorough review. Motion carried 6-0. 13. Consideration of and action on recommending to the City Council a 180 day moratorium on zoning for and placement of billboards within the city limits pending adoption of a new ordinance regulating such structures. Lisa Wright explained this was moratorium was actually requested by a billboard company that has several signs in town. He had advised her that sign companies have been moving into small cities that don't have good regulations and loading them up with billboards. All this ordinance would do is put a moratorium on issuing further permits for billboards until an ordinance was adopted. Ms. Wright stated that billboards, electric signs, and other off-premise signs have come a long way, and the current sign ordinance does little to provide guidance to the staff on how to properly handle them. In fact, right now, we have no ordinance to govern electronic signs and scrolling signs, and those could cause driver distraction on roadways. Reeves Hayter recommended 90 days instead of 180 days, and Ms. Wright said she thought that was adequate. Motion was made by Fran Neeley, seconded by Reeves Hayter to approve a 90 day moratorium. Motion carried 6-0. 14. Consideration of and action on recommending to the City Council an ordinance amending Zoning Ordinance No. 1710 by revising Section 10, providing for standards for parking in the city of Paris. Lisa Wright stated that the City Council wants the ordinance with regard to dust-free parking changed. She stated that the entire ordinance is out of date, so there has not been a lot of guidance regarding parking requirements. She stated that this ordinance was very lengthy and recommended that the Commission take more time to review it. Motion made by Richard Hunt, seconded by Reeves r - .. Hayter, to table this item to allow time for a more thorough review. Motion carried 6-0. 15. Consideration of and possible action on providing directions to the City Attorney with regard to the development of a new Manufactured Housing Ordinance. Lisa Wright stated that he purpose of this item was to allow the Commission to give the City Attorney some direction on where the City wants to go with regard to regulation of mobile and manufactured homes. Reeves Hayter said he wanted to know if we can or should continue to allow specific use permits or confine them to specific areas. What kind of improvements can we require with manufactured housing? Mr. Hayter went on to state we need to know how far we can go. Kent Mcllyar, City Attorney, stated it can be tricky with these kinds of homes, and it would require a lot of input from the building official. This can get really technical, and it would be smart to look at what other cities are doing. Benny Plata asked if the City can allow double wide with shingled roofs that looks like a house. Richard Hunt stated they should be anchored, but there are some really nice ones out there. Fran Neeley stated that she wants it to look like a home. 16.
