04 City Council Mtg Min 4-23-07 REGULAR MEETING OF THE CITY COUNCIL, CITY OF PARIS April 23, 2007 The City Council of the City of Paris met for a regular session at 6:00 P. M. Monday, April 23,2007, at the City Council Chamber, 107 E. Kaufman, Paris, Texas. Present: Mayor: Richard Manning Council Members: Curtis Fendley; Mary Ann Fisher, Mayor Pro Tern; Kevin Gray; Jesse James Freelen; and Don Wilson City Staff: Ernie Clark, Interim City Manager; Kent McIlyar, City Attorney; and Janice Ellis, City Clerk Absent: Council Member: Tim Ray 1. Mayor Manning called the meeting to order. Ernie Clark gave the invocation. 2. Pledge of Allegiance. Curtis Fendley led the pledge. 3. Approval of minutes from previous City Council meetings. (4/12/07) Council Member Freelen made a Motion to approve the minutes and Council Member Fisher seconded the Motion. Motion carried, 6 ayes - 0 nays. 4. Consideration of and action on the following ordinances: A. ORDINANCE NO. 2007-007: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING ARTICLE III CURFEW REGULATIONS FOR CHILDREN OF CHAPTER 21 OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS, REVISING CERTAIN LAW ENFORCEMENT PROCEDURES APPLICABLE TO THE CURFEW ORDINANCE AND MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, SEVERABILITY CLAUSE, AND SA VINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Council Member Wilson inquired if anyone had spoken with the home school representative to determine if the association was agreeable with this change. Mayor Manning said he had not. . r' ". Regular City Council Meeting April 23, 2007 Page 2 Based on a previous conversation with the local home school representative, Kent McIlyar reported this change was agreeable with the association. A Motion to approve this item was made by Council Member Freelen and seconded by Council Member Fendley. Motion carried, 6 ayes - 0 nays. B. ORDINANCE NO. 2007-008: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS, BE AMENDED BY REVISING SECTION 6-24(a) OF SAID CODE; PROVIDING FOR A 7.55 INCREASE IN T-HANGAR RENTAL FEES; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. A Motion to approve this item was made by Council Member Freelen and seconded by Council Member Wilson. Motion carried, 6 ayes - 0 nays. 5. Consideration of and action on the following resolutions: A. RESOLUTION NO. 2007-046: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING CHANGE OF COUNCIL MEETING DATE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. A Motion to approve this item was made by Council Member Wilson and seconded by Council Member Fisher. Motion carried, 6 ayes - 0 nays. B. RESOLUTION NO. 2007-047: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING AN APPLICATION FOR A RECREATIONAL TRAILS GRANT THROUGH THE TEXAS PARKS & WILDLIFE DEPARTMENT RECREATION GRANTS BRANCH TO EXTEND THE TRAIL DE PARIS EAST A DISTANCE OF APPROXIMATELY 0.8 MILES; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. A Motion to approve this item was made by Council Member Fendley and seconded by Council Member Wilson. Motion carried, 6 ayes - 0 nays. C. RESOLUTION NO. 2007-048: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING AND AUTHORIZING THE EXECUTION OF A JOINT ELECTION AGREEMENT BETWEEN THE PARIS INDEPENDENT SCHOOL DISTRICT AND THE CITY OF PARIS TO SHARE COMMON POLLING PLACES FOR THE May 12,2007 ELECTION; MAKING ,... .. Regular City Council Meeting April 23, 2007 Page 3 OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. A Motion to approve this item was made by Council Member Fisher and seconded by Council Member Fendley. Motion carried, 6 ayes - 0 nays. D. RESOLUTION NO. 2007-049: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING AND AUTHORIZING THE EXECUTION OF A GRANT APPLICATION TO THE OFFICE OF THE GOVERNOR, CRIMINAL JUSTICE DIVISION, THROUGH THE ARK- TEX COUNCIL OF GOVERNMENTS, FOR A VIOLENCE AGAINST WOMEN ACT GRANT IN THE AMOUNT OF $95,749.00, WITH THE CITY OF PARIS PROVIDING $79,585.00 IN THE FORM OF IN-KIND SERVICES; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. Council Member Freelen inquired ifthe total amount was for Lamar County. Chief Louis told the Council that the Police Department worked jointly with Family Haven and the majority of the cases were within the city. Kent McIlyar apprised Council the amount of in-kind services had changed from $79,040.00 to $79,585.00. A Motion to approve this item was made by Council Member Wilson and seconded by Council Member Freelen. Motion carried, 6 ayes - 0 nays. E. RESOLUTION NO. 2007-050: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING AND AUTHORIZING THE EXECUTION OF AN EXECUTIVE SEARCH AGREEMENT WITH THE PACE GROUP TO CONDUCT A SEARCH FOR A NEW CITY MANAGER; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. A Motion to approve this item was made by Council Member Gray and seconded by Council Member Fisher. Council Member Fendley favored putting a cap on the fee charged by the Pace Group. Mayor Manning said he did not think they needed a cap, because the Council would have the final decision as to how much to pay the new city manager. Council Member Wilson said he had concern about the administrative fees Pace charged in the amount of $500.00 per month for postage, telephone and administrative fees. Ernie Clark expressed concern about delay of the process. Council Member Fendley made a Motion approve the contract subject to an amendment capping the city's fee at one-third ofthe salary currently budgeted for city manager and Council Regular City Council Meeting April 23, 2007 Page 4 Member Wilson seconded the Motion. Motion carried, 4 ayes - 2 nays, with Mayor Manning and Council Member Gray casting the dissenting votes. 6. Citizens Forum. Reverend Rondie Williams, Wayside Church of God in Christ, 2910 Bonham Street - he told the Council there had been an ongoing outcry for years to tear down the Casa Bonita Apartments. Don Taylor, 515 Bunker - he told Council they should be more concerned about the millions of dollars loaned by PEDC rather than the additional $15,000.00 spent on a consultant to hire a city manager. Billy Bell, 2054 Cleveland - he asked Council to consider hiring people and renting a machine to replace deteriorating water and sewer lines. He further expressed concern about officers working with Family Haven, because Family Haven had lost grant money. 7. Possible future agenda items. Don Wilson asked for an item regarding what type of action the City could legally take to tear down the Casa Bonita Apartments. Mayor Manning asked for a study regarding replacement of old water lines. 8. Referrals. Jane Williams - Williams Auto Salvage, 2211 and 2255 North Main, Lots 23-24, Block 251 - request for zoning change from light industrial to heavy industrial. 9. Information items: A. TML Insurance Pool- City has received a total of$181, 131.00 in equity returns since fiscal year 2003-04. B. Receipt and acceptance of Monthly Financial Report. Council Member Wilson expressed appreciation to Ernie Clark and Gene Anderson for the new financial reporting form. C. City investments quarterly report. D. City of Paris Boards and Commissions - Schedule of Meetings: · Paris Library Advisory Board Meeting scheduled Wednesday, April 25, 4:00 r' . Regular City Council Meeting April 23, 2007 Page 5 p.m. in the Library Gallery. · Planning & Zoning Commission Meeting scheduled May 7,2007,5:30 p.m. in the Council Chambers. Mayor Manning read a letter from the Sheriff of Red River County commending Chief Louis, Bob Hundley and the Paris Police Department in their assistance of apprehending a suspect. 10. Adjournment. There being no further business, Council Member Freelen made a Motion to adjourn and Council Member Wilson seconded the Motion.
