2007-055 RES-Canvassing the returns from the May 12, 2007 city wide special election on the proposed amendments to the charter of the City of ParisRESOLUTION N0. 2007-055 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, CANVASSING THE RETURNS FROM THE MAY 12, 2007 CITY- WIDE SPECIAL ELECTION ON THE PROPOSED AMENDMENTS TO THE CHARTER OF THE CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on the 25th day of January, 2007, the City Council of the City of Paris passed Resolution No. 2007-015, ordering a special city-wide municipal election for the City of Paris to be held on May 12, 2007, for all qualified voters of the City of Paris, for the purpose of voting on proposed amendments to the Charter of the City of Paris; and, WHEREAS, on May 12, 2007, pursuant to prior Resolution No. 2007-015, a special city-wide election was held in the City of Paris, Texas at which qualified voters were given the opportunity to vote for or against seventy (70) proposed amendments to the Charter of the City of Paris; and, WHEREAS, in accordance with the March 15, 1976 Order issued by the United States District Court for the Eastern District of Texas, in Civil Action No. P-75-3-CA, and as provided by the Paris City Charter and the laws of the State of Texas, such election was conducted and held at the specified and designated polling places for all seven (7) Voting Districts in the City of Paris and early voting was conducted at the City Annex, 150 1st Street N.E., from April 30 through May 8, 2007; and, WHEREAS, sealed returns of said election for all seven (7) Districts, made by the duly appointed and designated election officials of and for the respective voting districts, having been made to the Mayor and City Council of the City of Paris, as required bylaw, which returns after due and deliberate review and canvass thereof, show the results as summarized herein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That on May 12, 2007 a special election was held in all seven (7) Voting Districts of the City of Paris, Texas, with early voting conducted from April 30, 2007 through May 8, 2007, for the purpose of submitting to the qualified voters of the City of Paris proposed amendments to the Charter of the City of Paris; the form of the propositions and a tabulation of the votes cast are as follows: -1- 1. Proposition 7: Amend Section 9, "Eminent Domain," to clarify the meaning by deleting antiquated or unnecessary language, particularly regarding procedures applicable to railroad corporations, so that the entirety of the section following the first sentence shall read: In all cases where the city seeks to exercise the power of eminent domain, it may be controlled by the laws authorized or permitted by the constitution and laws of this state, or in any manner and form that may be provided by ordinance of the governing body of the city. The power of eminent domain hereby conferred shall include the right of the city to take the fee in the lands so condemned and such power and authority shall include the right to condemn public property. Street and public property improvements. The City of Paris shall have exclusive dominion, control, and jurisdiction in, upon, and over and under the public streets, avenues, alleys, highways, and other public property of the city, and may provide for the improvement thereof by paving, repaving, raising, draining, constructing public improvements, or otherwise. The city's authority over such public property shall include all authority granted by the Legislature and Constitution of the state and all control not expressly prohibited by the Legislature or the Constitution. Such exclusive dominion, control and jurisdiction in, upon, over and under the public streets, avenues, alleys, highways, and other public property of the city shall also include, but not be limited to, the right to -10- regulate, locate, relocate, remove, require the removal or relocation at the sole cost of the owner, or prohibit the location of all utility pipes, lines, wires, poles, conduits, appurtenances, supporting facilities, or other property. Proposition 19: Amend Section 22, "Appointment and removal of city manager," to change the procedure whereby the council may remove the city manager by first suspending him by resolution, then holding a hearing at which the city manager and the public may address the council, after which the council shall adopt a resolution either reinstating or removing the city manager, so that the second paragraph shall read: The salary of the city manager shall be fixed by the city cou ncil and he shall hold office at its will. The city council may suspend the city manager if the manager declines to resign at the request of the council, that request being expressed in a -19- resolution approved by a majority vote of the total membership of the council. Such resolution shall set forth the reasons for suspension and proposed removal. A copy of such resolution shall be served immediately upon the city manager, who shall have 15 days in which to reply thereto in writing, and upon request, shall be afforded a public hearing, which shall occur not earlier than 10 days nor later than 15 days after such hearing is requested. At such public hearing, if one is requested, the city manager will be allowed up to 30 minutes to respond to his proposed termination. Members of the public will be allowed to speak in support of or in opposition to termination, and may address any aspect of the city manager's performance. After the conclusion of the public hearing, if one is requested, or after 15 days if the manager has not responded to the request to resign, and after full consideration, the city council by a majority vote of its total membership shall adopt a final resolution of removal or reinstatement. The city manager shall continue to receive full salary until the effective date of a final resolution of removal. The action of the council in suspending or removing the city manager shall be final, it being the intention of this charter to vest all authority and fix all responsibility for such suspension or removal in the city council. During an absence or disability of the city manager, except as provided in Section 41, the council may designate a properly qualified person to perform the duties of the office. Proposition 20: Amend Section 23, "Council not to interfere in appointments or removals," to provide that a council member who violates the section by interfering in appointments or removals of any employee by the city manager, or by not dealing through the city manager and giving orders to subordinates of the city manager may, after multiple, willful violations and a hearing, be removed from office, so that the section shall read: Neither the council nor any of its members shall direct the city manager or any of his subordinates in the appointment or removal of any city employee; provided, however, that the appointment of department heads shall be subject to the approval of the council. Except for the purpose of inquiry, the council and its members shall deal with city employees solely through the city manager, and neither the council nor any member thereof shall give orders to any subordinates of the city manager, either publicly or privately. It shall be grounds for removal from office if, following investigation by and a hearing before the council, a council member is found guilty of multiple, willful violations of this section. A. A total of 1,289 For votes were cast in ;favor of the aforesaid Proposition No. 65, and a total of 78 Against votes were cast in opposition to the aforesaid proposition, and it is further declared and determined that the aforesaid amendment to the Charter of the City of Paris, DID pass. 66. A total of 1,298 For votes were cast in favor of the aforesaid Proposition No. 66, and a total of 61 Against votes were cast in opposition to the aforesaid proposition, and it is further declared and determined that the aforesaid amendment to the Charter of the City of Paris, DID pass. 67. A total of 1,293 For votes were cast in favor of the aforesaid Proposition No. 67, and a total of 94 Against votes were cast in opposition to the aforesaid proposition, and it is further declared and determined that the aforesaid amendment to the Charter of the City of Paris, DID pass. -80- 68. A total of 1,307 For votes were cast in favor of the aforesaid Proposition No. 68, and a total of 73 Against votes were cast in opposition to the aforesaid proposition, and it is further declared and determined that the aforesaid amendment to the Charter of the City of Paris, DID pass. 69. A total of 1,297 For votes were cast in favor of the aforesaid Proposition No. 69, and a total of 83 Against votes were cast in opposition to the aforesaid proposition, and it is further declared and determined that the aforesaid amendment to the Charter of the City of Paris, DID pass. 70. A total of 1,274 For votes were cast in favor of the aforesaid Proposition No. 70, and a total of 92 Against votes were cast in opposition to the aforesaid proposition, and it is further declared and determined that the aforesaid amendment to the Charter of the City of Paris, DID pass. Section 4. That it is hereby ORDERED and DECLARED that the City Charter of the City of Paris be, and hereby is amended to conform to said propositions and the same are hereby declared to be adopted. Section 5. It is further ORDERED that the Mayor is hereby authorized and directed to certify to the Secretary of State an authenticated copy of these amendments to the City Charter under City Seal and the City Clerk shall record said amendments in the official records of the City of Paris. Upon the recording of this resolution declaring the Charter amendments to be adopted, such amendments shall be considered a public act and all courts shall take judicial notice of the same and no further proof shall be required of such amendments in any court. Section 6. That it is the intention of the City Council of the City of Paris that this resolution and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provision of this resolution shall not affect the validity of any other portion of this resolution.
