Wright, Director of Community Development DESCRIPTION: Consideration of and action on a resolution authorizing the submission and acceptance (upon notice thereoD of a grant application to the Texas Historical Commission for a Certified Local Government Grant to fund the completion and publication of Design Standards for the Historic Districts of the City of Paris, and accepting the proposal of Main Street Architects for completion of said Design Standards and authorizing the execution of a professional services agreement. BACKGROUND INFORMATION: The City of Paris had previously hired a consultant to develop Design Guidelines for the Downtown Historic District; however, after adoption, those Guidelines were found to be extremely difficult to implement because they lacked specificity in several areas. Therefore, it applied for and received funding from both the Texas Historical Commission, Visionaries in Preservation Program, and the Martha, David, and Bagby Lennox Foundation to develop adequate Design Standards, with no matching funds being required by the City. The City originally contracted with Main Street Architects to develop Guidelines for the Commercial Historic District only; however, because the City would still have no guidelines for its residential districts, the Visionaries staff recommended that the grant be modified to expand the project to include guidelines for both districts up through a draft form. Main Street Architects has completed the draft Standards and has submitted a proposal in the amount of $8,000.00 to develop the Standards into final format. It is further estimated that the cost of publishing those Standards to both written format and to the City's website will be $7,000.00 or less. The proposed resolution would authorize the City to make application for a Certified Local Government Grant in the amount of $15,000.00, with $9,000.00 to be provided by grant and $6,000.00 to be provided by local cash match. If the City receives the requested funded, this will be the fourth consecutive year that the City has been awarded CLG funds for local historic preservation-related projects. In the three previous years, the funds have been devoted to updating the Historic Resource Survey. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION TO THE TEXAS HISTORICAL COMMISSION FORA CERTIFIED LOCAL GOVERNMENT GRANT TO FUND THE COMPLETION AND PUBLICATION OF DESIGN STANDARDS FOR THE HISTORIC DISTRICTS OF THE CITY OF PARIS; AUTHORIZING THE EXPENDITURE OF FUNDS; ACCEPTING SAID GRANT AWARD UPON NOTICE THEREOF; AUTHORIZING THE EXECUTION OF ANY AND ALL DOCUMENTS NECESSARY FOR ACCEPTANCE AND IMPLEMENTATION OF SAID GRANT UPON NOTICE THEREOF; ACCEPTING THE PROPOSAL OF MAIN STREET ARCHITECTS FOR COMPLETION OF SAID DESIGN STANDARDS AND AUTHORIZING THE EXECUTION OF A PROFESSIONAL SERVICES AGREEMENT; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of Paris had previously hired a consultant to develop Design Guidelines for the Downtown Historic District; however, after adoption, those Guidelines were found to be extremely difficult to implement because they lacked specificity in several areas; and, WHEREAS, because of the considerable importance comprehensive design standards play in helping both the Historic Preservation Commission and property owners undertaking preservation projects, the Texas Historical Commission, Visionaries in Preservation Program, previously awarded the City of Paris a Texas Preservation Trust Fund Grant in the amount of $7,300.00 to further develop the existing Guidelines, with the required cash match of $7,300.00 being provided by the Martha, David, and Bagby Lennox Foundation; and, WHEREAS, upon award of said Visionaries Grant to improve upon the Guidelines, the City originally contracted with Main Street Architects to develop Guidelines for the Commercial Historic District only; however, because the City would still have no guidelines for its residential districts, it requested and received a modification to the grant to expand the project to include guidelines for both districts up through a draft form; and, WHEREAS, Main Street Architects has completed the draft Standards and submitted the same to the Historic Preservation Commission on March 12,2007, thus completing the project funded under the Visionaries Grant; and, ~ -r WHEREAS, Main Street Architects has submitted a proposal to develop the Design Standards into a rmal version in the amount of $8,000.00, and it is estimated that the cost of publishing those Standards to both written format in an adequate number and to the City's website will be $7,000.00; and, WHEREAS, the Texas Historic Commission provides grant funding for Certified Local Government Grants, and the City Council of the City of Paris is desirous of submitting a grant application in the amount of$15,OOO.00 to fund the completion of the Design Standards for the Historic Districts of the City of Paris, publication of the Standards in written format, and publication of the Standards to the City's website, with $9,000.00 to be provided by grant and $6,000.00 to be provided by local cash match; and, WHEREAS, the City Council desires to authorize the Mayor, City Manager, and appropriate City staff to accept and implement said grant (if same is received) without further action of City Council; and, WHEREAS, it is further deemed appropriate that the Mayor be authorized to execute the professional services agreement with Main Street Architects for completion of the Design Standards, upon award of the grant (if same is received), under the terms and conditions and in the form shown in Exhibit A, attached hereto; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That an application be made to the Texas Historical Commission for a Certified Local Government Grant in the amount of$15,OOO.00 to fund the completion of the Design Standards for the Historic Districts of the City of Paris, publication of the Standards in written format, and publication of the Standards to the City's web site, with $9,000.00 to be provided by grant and $6,000.00 to be provided by cash match. Section 3. That the City Manager be, and he is hereby, appointed as the Authorized Official of said project and is authorized and directed to execute, on behalf of the City of Paris, the application for grant under the terms and conditions and in the form approved by the City Attorney. Section 4. That the Director of Community Development, be, and she is hereby, appointed as Project Director and is hereby authorized to execute and deliver, on behalf of the City of Paris, all reports, communications, assurances, and documents necessary for the completion of said project. That the Director of Finance be. and he is hereby. authorized and directed to serve as the Financial Officer for said project and to receive and distribute funds. both grant funds and funds from local resources, for purposes of completing the Design Standards for the Historic Districts of the City of Paris. Section 6. That the Mayor, City Manager, Director of Community Development, and the Finance Director be authorized and directed to execute, on behalf of the City of Paris, any and all documents necessary for acceptance and implementation of said grant upon notice of award thereof by the Texas Historical Commission, Certified Local Government Division, under the terms and conditions and in the form approved by the City Attorney, and to proceed with use of said funds upon receipt thereof for the purposes stated herein and in accordance with the grant conditions. Section 7. That the Mayor be. and he is hereby, authorized and directed to execute, on behalf of the City of Paris. a professional services agreement with Main Street Architects for completion of the Design Standards, upon award of the grant (if same is received). under the terms and conditions and in the form shown in Exhibit A, attached hereto. City Attorney --.-. --'"T""'" ......- MAINSTREET ARCHITECTS INC. 3 May 2007 Lisa Wright Director of Community Development City of Paris 150 Southeast First Street Paris, Texas 75460 RE: Completion of Design Standards City of Paris, Texas Dear Ms Wright: As per Agreement dated 5 April 2006, Mainstreet Architects has completed and delivered the Final Draft of the Design Standards for the City of Paris, Texas, for your review and comment. The Standards consist of research, photography and documentation specifically for the Commercial and Residential Historic Districts in the City of Paris. This phase was conducted through funding available through the City and a grant from The Texas Historic Commission. Phasing in this manner offered the opportunity to look at the Historic Districts in a broad sense without segregating the research that would prove disjointed with regard to the Historic Districts. It has been our understanding that the document would be completed and delivered, as the remaining funds were available. We understand that the City and Review Commission have had an opportunity to review the Draft document and have comments and recommendations to be considered for incorporation and revision to the final document. We look forward to reviewing those comments and recommendations. Mainstreet Architects is ready to complete the Final Phase and Production of this document. As per our original proposal, the fee for the entire process and document was to be $23,000.00. Phasing was implemented to accommodate a grant opportunity through The Texas Historical Commission providing joint funding in the amount of $15,000.00. Mainstreet Architects agrees to complete the project for the balance remaining on the original proposal, $8,000.00. We request two payments, $4,000.00 on execution of this agreement and $4,000.00 on acceptance of the final document. EXHIBIT A- 133 W.
