AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ESTABLISHING A MAXIMUM, REASONABLE RATE OF SPEED ON CERTAIN PORTIONS OF CERTAIN STREETS AND HIGHWAYS AND PUBLIC PLACES IN THE CITY OF PARIS; PROVIDING FOR A FINE NOT TO EXCEED $200.00; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Paris Traffic Commission is charged with the responsibility to study and evaluate reasonable rates of speed on City streets and roadways; and, WHEREAS, the Traffic Commission, at its regular meeting of July 10, 2007, considered and evaluated various suggestions and requests for the adjustment of maximum permissible speeds at various locations throughout the city, and having done so found and determined that the adjustment of maximum permissible speeds at certain locations and on certain streets and roadways in the city is necessary to protect the health and safety and is in the best interests of the citizens of the city of Paris, and have so recommended speed adjustments to the City Council of the City of Paris; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the following maximum, rates of speed are hereby determined and declared to be reasonable and safe for motor vehicles traveling upon the names streets or portions thereof as identified below: From the north curb line ofthe intersection ofW. Campbell Street and 7th Street NW to the south curb line of the intersection of West Henderson Street and 7th Street NW, a speed limit of thirty (30) miles per hour at all times. Section 3. The City Engineer is hereby authorized to cause to be erected appropriate signs indicating the maximum speed limit for this roadway. Section 4. All provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions ofthis ordinance shall remain in full force and effect. Section 5. The repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 6. It is the intention ofthe City Council ofthe City of Paris that this ordinance, and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 7. Any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor and, upon conviction, shall be fined in any sum not to exceed $200.00- Traffic, and each and every day's continuance of any violation of the above-enumerated section( s) shall constitute and be deemed a separate offense. Section 8. That this ordinance shall become effective from and after its passage and publication as required by law. PASSED AND ADOPTED this 23rd day of July, 2007.
