AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AMENDING THE CITY OF PARIS CODE OF ORDINANCES BY REVISING SECTION 26-1 OF SAID CODE TO AUTHORIZE THE STAFFING LEVELS OF THE POLICE DEPARTMENT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the employment of police officers in the City of Paris is governed by Chapter 143 of the Local Government Code, dealing with Civil Service employment; and, WHEREAS, Section 143.021 of said Chapter 143 of the Local Government Code provides for a municipality's governing body to establish the classifications of police officers by ordinance; WHEREAS, due to the loss of the Violence Against Women Act Grant through the Office of the Governor, Criminal Justice Division, through the Ark- Tex Council of Governments, it is necessary for the City to eliminate one police private position in the Paris Police Department; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That Section 26-1 of the Code of Ordinances of the City of Paris, Paris, Texas, be, and the same is hereby, amended so that such shall read as follows: "Sec. 26-1. Composition of department. The police department of the City shall be composed of the chief of police and sixty- two (62) members classified as follows: (1 ) One (1) assistant chief. (2) Three (3) police lieutenants. (3) Twelve (12) police sergeants. (4) Four (4) police corporals. (5) Forty-two (42) police privates." Section 3. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 4. That this ordinance shall become effective on October 1,2007. In accordance with V.T.C.A., Local Government Code, chapter 143, section 143.014, the chief of police of the city shall, in accordance with the aforesaid civil service law, appoint the individual within the police department to serve as assistant chief of police. (Ord. No. 2004-046, ~ 2, 9-13-04) Sec. 26-3. Policemen to furnish transporta- tion to and from work; excep- tions. Each member of the police department shall furnish his own transportation to and from work, except those policemen who are furnished with a city car that they keep overnight, and except that, Supp. No. 58 POLICE ~ 26-4 when any member of the police department is called out on an emergency, the regular patrol cars may transport him to and from his home. (Code 1970, ~ 25-3) Sec. 26-4. Arrests without warrant. (a) Any police officer of the City may arrest an offender, without a warrant, for any offense com- mitted in his presence or within his view. Such officer may also arrest, without warrant, when a felony or breach of the peace has been committed in the presence or within the view of a magistrate, and such magistrate verbally orders the arrest of the offender. (b) In addition to the provisions of paragraph (a) ofthis section any police officer ofthe City may arrest without warrant: (1) Persons found in suspicious places and under circumstances which reasonably show that such persons have been guilty of some felony or breach of peace, or threaten or are about to commit some offense against the laws; (2) Persons who the officer has probable cause to believe have committed an assault re- sulting in bodily injury to another person and the officer has probable cause to be- lieve that there is danger of further bodily injury to that person; or (3) Persons who the officer has probable cause to believe have committed the offense defined by V.T.C.A., Penal Code Section 25.08 (violation of court order), whether of not the offense is committed in the pres- ence of the officer. (c) If necessary to verify an allegation of a violation of a protective order, an officer shall follow the procedures established under V.T.C.A., Family Code Section 71.18, without leaving the scene of the investigation if there is a possibility of the further commission of family violence.
