AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING THE SITE PLAN FOR A PLANNED DEVELOPMENT DISTRICT- RETAIL SHOPPING CENTER (PD-a), PREVIOUSLY ESTABLISHED BY THE ENACTMENT OF ZONING ORDINANCE NO. 96-039, FOR LOT 4, BLOCK 8, SPRINGLAKE ADDITION; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on July 15, 1996 the City Council ofthe City of Paris, Texas, enacted Ordinance No. 96-039, establishing a Planned Development District- RETAIL SHOPPING CENTER (PD-a) on Lot 4 Block 8, Springlake Addition, City of Paris, Lamar County, Texas, as described in the aforesaid ordinance; and, WHEREAS, the City Council desires to approve the site plan for said Planned Development District as shown on Exhibit A, attached hereto; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the site plan, including the drainage plan, for Lot 4, Block 8, Springlake Addition, City of Paris, Lamar County, Texas, also known as 230 N. Collegiate Drive, attached hereto as Exhibit A, be and the same is hereby, approved. Section 3. All provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. The repeal of any ordinance or part of ordinances affected by the enactment ofthis ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 5. It is the intention of the City Council of the City of Paris that this ordinance, and every provision hereof, shall be considered severable, and the invalidity T" "" '... or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. Any person violating any ofthe provisions ofthis ordinance shall be guilty of a Misdemeanor and, upon conviction, shall be fined in any sum not to exceed $2000.00, and each and every day's continuance of any violation ofthe above- enumerated sections shall constitute and be deemed a separate offense. Wright, Director of Community Development Shawn Napier, City Engineer / Director of Public Works SUBJECT: Site Plan for Lot 4, Block 8, Spring Lake Addition (230 N. Collegiate Drive) DATE: November 6,2007 The above-subject site plan was approved by the Planning & Zoning Commission on October 1, 2007, and submitted to the City Council for its consideration on October 8, 2007. After a public hearing at which opposition was present, the City Council tabled this item and sent it back to the Planning & Zoning Commission for further review. The main concern of both the adjacent property owners and the City Council was the potential negative impact the increased traffic flow onto 28th Street N.E. would have on the residents living along that street; therefore, the City Council asked the Commission to take a more in depth look at this issue. On October 22, 2007, we met with the attorney for the Chans and recommended (1) that the building be moved farther back on the lot to provide for more parking in the front, thus eliminating the three rear parking spaces along 28th Street and the parallel parking spaces along the south side of the lot, and (2) that 28th Street access to the lot be removed entirely. These two items result in what appears to be the sticking point for both the adjacent property owners and the City Council, that being access to 28th Street from the parking lot. On October 23, we received the attached letter from Mrs. Chan requesting that the site plan be approved in the form submitted at the October 1 Planning & Zoning Commission meeting and the October 8 City Council meeting. No changes have been made with regard to rear parking, parallel parking, or access to 28th Street. On November 5, 2007, the Planning and Zoning Commission heard this matter and approved the site plan by a vote of four to three. Be advised that there are currently no paved parking lots or driveways to other commercial properties along this section ofN. Collegiate Drive; however, two unpaved areas do exist behind Screen Graphics and Texoma Sleep Diagnostics Clinic, using what appears to be the driveway aprons ofthe residences that were once located on the rear of the lots (the Community Development Department will be issuing citations to both property owners for violation of the dust-free parking ordinance). However, only the rear parking lot for the Texoma Sleep Diagnostics Clinic was approved on the original site plan. They will be required to pave it if they choose to continue with its use. The rear parking at Screen Graphics was not included on their site plan; therefore, if they wish to continue the use of this small rear lot, they will be required to seek a site plan amendment prior to paving the lot. If neither lot is paved, then neither can be used for a driveway or for parking. We have again reviewed the current site plan of the above-subject property and have found that it contains all of the minimum required elements to satisfy the City of Paris site plan requirements; however, the City Council may place additional requirements on the property as it deems necessary. cc: Kevin Carruth, City Manager T..T... The building will consist of 1683 sq. ft. without a donut shop. We met with the City Staff that recommend in detail what was needed on this site plan for your approval. This information was passed on to Chaney Engineering for the completion of site plan. The site plan meets all City of Paris codes and requirements as specified by the City of Paris. This area is zone Plan Development, and we have done everything we can to make this project work for our business and comply with the requirement of the City of Paris. This has . cost us a substantial amount money and time with the changes. Our final decision is to make this an Art and Custom Frame Shop only. The (9) nine parking spaces that are required for . this 1683 sq. building are based on information that we receive from the City of Paris staff. The driveway indicated on the site plan is needed to allow adequate parking for the Art and Custom Frame Shop per City of Paris requirements. Your approval of this site plan will be greatly appreciated.
