AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS, APPROVING A SITE PLAN, AS AMENDED, FOR LOT 4,
BLOCK 8, SPRINGLAKE ADDITION, CITY OF PARIS, LAMAR COUNTY,
TEXAS, LOCATED IN A PLANNED DEVELOPMENT DISTRICT - RETAIL
SHOPPING CENTER (PD-a), PREVIOUSLY ESTABLISHED BY ZONING
ORDINANCE N0. 96-039; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, on July 15,1996 the City Council of the City of Paris, Texas,
enacted Ordinance No. 96-039, establishing a Planned Development District-
RETAIL SHOPPING CENTER (PD-a) on Lot 4 Block 8, Springlake Addition, City
of Paris, Lamar County, Texas, as more particularly described in the aforesaid
ordinance (the "Property"); and,
WHEREAS, the owner of the Property has submitted a site plan which was
reviewed by City Staff and approved by the Planning and Zoning Commission at
their public meeting on November 5, 2007; and
WHEREAS, the site plan was brought before the City Council of the City of
Paris, Texas on November 12, 2007 for review and consideration; and,
WHEREAS, following review and discussion of the site plan by City
Council, City Staff, and the Property Owner, the City Council approved the site plan
subject to the Property Owner's agreement to increase the side yard set back along
the north side of Lot 3, Block 8, Springlake Addition from one foot (1') to a
minimum of five feet (5'); and elimination of the proposed driveway and exit to NE
28`" Street; and,
WHEREAS, no building permit will be issued for the Property until a revised
site plan, which includes the changes approved by City Council on November 12,
2007, is filed with the City Community Development Department, reviewed and
approved by the City Engineer and Director of Community Development.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are
hereby in all things approved.
Section 2. That the site plan, as amended above, including the drainage plan,
for Lot 4, Block 8, Springlake Addition, City of Paris, Lamar County, Texas, also
known as 230 N. Collegiate Drive, be, and the same is hereby, approved subject to
the Property Owner submitting a revised site plan reflecting an increase in the side
yard from one foot (1') to a minimum of five feet (5') along the north side of Lot 3,
Block 8, Springlake Addition and elimination of the proposed driveway and exit to
NE 28' Street, said plan which must be reviewed and approved by the City Engineer
and Community Development Director for compliance with this ordinance.
Section 3. All provisions ofthe ordinances ofthe City ofParis, Texas in conflict
with the provisions of this ordinance are hereby repealed, and all other provisions of the
ordinances of the City of Paris not in conflict with the provisions of this ordinance shall
remain in full force and effect.
Section 4. The repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering
any penalty accruing or to accrue, or as affecting any rights of the municipality under any
section or provisions of any ordinance at the time of passage of this ordinance.
Section 5. It is the intention of the City Council of the City of Paris that this
ordinance, and every provision hereof, shall be considered severable, and the invalidity
or partial invalidity of any section, clause, or provisions of this ordinance shall not affect
the validity of any other portion of this ordinance.
Section 6. Any person violating any of the provisions of this ordinance shall
be guilty of a Misdemeanor and, upon conviction, shall be fined in any sum not to
exceed $2000.00, and each and every day's continuance of any violation of the above-
enumerated sections shall constitute and be deemed a separate offense.
Section 7. That this ordinance shall become effective from and after its
passage and publication as required by law.
