2007-144-RES-Authorizing the execution of a 20 foot water line easement and a 50 foot temporary construction easement to Lamar County Water SupplyRESOLUTION N0. 2007-144 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AUTHORIZING THE EXECUTION OF A 20 FOOT WATER LINE EASEMENT AND A 50 FOOT TEMPORARY CONSTRUCTION EASEMENT TO LAMAR COUNTY WATER SUPPLY DISTRICT WHICH CROSSES UNDER PART OF LAKE CROOK PROPERTY FORA 16 FOOT WATER MAIN; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, on December 10, 2007, a public hearing was held to receive input from citizens regarding a request from Lamar County Water Supply District fora 20 foot water line easement and a 50 foot temporary construction easement to install a 16" water line under a part of Lake Crook property as more particularly described in Exhibits A and B a,nd depicted in Exhibit C attached hereto (the "Project"); and, WHEREAS, Lake Crook is a designated park and/or recreation area owned by the City of Paris; and, WHEREAS, according to testimony from representatives of Lamar County Water Supply District and the City Engineer, there is no feasible or prudent alternative available for locating the proposed 16" water line than under a portion of Lake Crook as more particularly described in Exhibits A & B and depicted in Exhibit C attached hereto; and, WHEREAS, the Project has been designed so as to minimize any harm to Lake Crook and has been reviewed and accepted by the City Engineer. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the City Council of the City of Paris hereby finds and determines, based upon the testimony and information provided by Lamar County Water Supply District, City staff and citizens speaking at the public hearing that there is no reasonable or prudent alternative for locating the proposed 16"water line other than under a portion of Lake Crook as further described in Exhibits A and B and depicted in Exhibit C attached hereto and that the Project has been planned and designed so as to minimize any harm to this portion of Lake Crook. Section 3. That the request from Lamar County Water Supply District fora 20 foot utility easement and a 50 foot temporary construction easement crossing under a part of Lake Crook property as described in Exhibits A, B and C attached hereto, be and is hereby approved. Section 4. That the Mayor of the City of Paris be, and he is hereby authorized and directed to execute the 20 foot water line easement and the 50 foot temporary construction easement from the City of Paris to Lamar County Water Supply District, substantially according to the documents attached hereto as Exhibits A, B and C. Section 5. That this resolution shall be effective from and after the date of passage. Chismn Survey A-175, the centerline of said easement being described as follows: Beginning at a point in the West boundary line of a called 210.536 acre tract of land conveyed as the sixth tract in a deed from Campbell Soup Company to Campbell Soup Supply Company L.L.C. on July 29, 1999 and recorded in volume 898, page l 82 of the Real Property Records of Lamar County Texas, said point being located N 00°45'00" E a distance of 261.24 feet from a concrete monument found at the Southwest corner of the aforementioned called 210.536 acre tract, said point also being located 60 feet at aright angle from the centerline of an existing 100-foot wide Oncor electric transmission line easement. Thence N 88°27'46" W parallel to the aforementioned 100-foot wide Oncor easement a distance of 1282.57 feet to a point; Thence S 47°44'28" W parallel to the aforementioned 100-foot wide Oncor easement a distance of 6531.78 feet to a point in the East right-of--way line of F.M. 79, said point being located 60.feet at a right angle from the centerline of the aforementioned 100 foot wide Oncor electric transmission line easement, said point also being located S 32°40'43" W a distance of 189.36 feet from a 2 inch pipe found at the Southeast corner of a called 1.6 acre tract as conveyed from Gerald L Hanks and wife Mary J. Hanks to Richard M. Amis on October 13, 1982 and recorded in volume 649, page 853 of the deed records of said county. EXHIBIT .g GENERAL DESCRIPTION 50' Temporary Construction Easement Lamar County, Texas November 2007 Being a 50' wide temporary construction easement on and across land owned by the City of Paris in the John Watson Survey A-1023 and in the Thomas G. Chisum Survey A-175, the centerline of said easement being described as follows: Beginning at a point in the West boundary line of a called 210.536 acre tract of land conveyed as the sixth tract in a deed from Campbell Soup Company to Campbell Soup Supply Company L.L.C. on July 29, 1999 and recorded in volume 898, page 182 of the Real Property Records of Lamar County Texas, said point being located N 00°45'00" E a distance of 276.24 feet from a concrete monument found at the Southwest corner of the aforementioned called 210.536 acre tract, said point also being located 75 feet at aright angle from the centerline of an existing 100-foot wide Oncor electric transmission line easement. Thence N 88°27'46" W parallel to the aforementioned 100-foot wide Oncor easement a distance of 1288.39 feet to a point; Thence S 47°44'28" W parallel to the aforementioned 100-foot wide Oncor easement a distance of 6531.4] feet to a point in the East right-of--way line of F.M. 79, said point being located 75 feet at a right angle from the centerline of the aforementioned 100 foot wide Oncor electric transmission line easement, said point also being located S 36°46'10" W a distance of 179.74 feet from a 2 inch pipe found at the Southeast corner of a called 1.6 acre tract as conveyed from Gerald L Hanks and wife Mary J.
