10-B2 Board of Adjustment Min MINUTES REGULAR MEETING CITY OF PARIS BOARD OF ADJUSTMENT CITY OF PARIS - CITY HALL COUNCIL CHAMBERS 107 E. KAUFMAN STREET PARIS. TEXAS THURSDAY. AUGUST 23. 2007 12:00 O'CLOCK P.M. 1. The Board of Adjustment meeting was called to order by Chairman Terry Christian at 12:00 p.m. A. The following members were present: Terry Christian Kyle McCarley Rodney Bass Chester Martindale Howard Corriston Louis Yates B. The following members were absent: Alternates: David Glass C. Also present was Lisa A. Wright, Community Development Director. 2. Approval of minutes from previous meetings. Motion to approve the minutes ofthe July 16, 2007, meeting was made by Rodney Bass, seconded by Chester Martindale. Motion carried 6-0. 3. Public hearing to consider the petition of Thou Chan to grant a variance of Zoning Ordinance No. 1710, as follows: (1) Section 10-102(1), reducing the required number of off-street parking spaces and (3) on-street parking spaces; and (2) Section 10-104(a), removing the requirementfor loading zone, on Lot 4, Block 8, Springlake Addition, being number 230 N. Collegiate Drive. Motion was made to recuse Louis Yates by Louis Yates, seconded by Kyle McCarley. Motion carried 5-0. Sybil Colson - 819 Lamar Avenue - Owns property at 28th Street and Price. She objects to variance because there will be no parking on lot and will put all traffic and parking on 28th street. Ms. Colson went on to state they are putting to much on to little of a lot. Three off street parking spaces will tie up street. Edith Dunne - 257 28th Street N.E. - Ms. Dunne stated she was not aware that 28th street is commercial. She said there is one driveway for each lot out there and when she has company they park on the street. Ms. Dunne further stated she is against parking on the street for commercial use because there is not enough room for people who live there. - T Yvonne Bowers - 228 28th Street N.E. - Ms. Bowers stated she agrees with the statements that have been made by Ms. Dunne and Ms. Colson. Parking will be in their front yard. She further request a privacy fence around property so they will have privacy. Virginia Hampton - 238 28th Street N.E. - Ms. Hampton stated she lives across from property. She also said when her son gets a truck they will have no where to park and someone will have to give. Louis Yates, Jr. - Contractor - Regarding privacy fence there are three businesses on 28th street without privacy fence. Have reduced the building to 1300 square feet heated and air conditioned with 940 square feet of warehouse and 120 square feet of porch area. He stated Shawn Napier said parking space for every 200 square foot of parking. Kyle McCarley asked what is space used for? Louis Yates said it will be art studio, not a donut shop anymore. Chester Martindale asked why that large a storage area? Terry Christian said she buys framing equipment and they build them in the warehouse. Louis Yates stated she has machinery she will put in warehouse. Terry Christian asked on revised site plan has drive thru been removed? Chester Martindale also asked why drive thru? Louis Yates stated drive thru still there although donut shop not going in. He said Screen Graphics has three parking spaces and Collegiate street is on- street parking. Rodney Bass stated anyon-street parking on Collegiate is hazardous. Three on-street on 28th and three off-street on Collegiate. Kyle McCarley stated three rear parking spaces will be employees mainly. Louis Yates said the only employees are her and her husband. Howard Corriston stated drive thru traffic could cause congestion on 28th street for residents. Chester Martindale asked if no donut shop then why the drive thru? Louis Yates said he didn't know. The dumpster will be a small one located at the rear of the property. Ms. Hampton stated this will effect her drastically, because she is right behind it. Terry Christian stated he will abstain from the vote. "r Public hearing declared closed. 4. Consideration of and action on the petition of Thou Chan to grant a variance of Zoning Ordinance No. 1710, as follows: (1) Section 10-102(1), reducing the required number of off-street parking spaces from twelve (12) to three (3) off- street parking spaces and (3) on-street parking spaces; and (2) section 10- 104(a), removing the requirement for loading zone, on Lot 4, Block 8, Springlake Addition, being number 230 N. Collegiate Drive. Motion was made to deny parking variance by Rodney Bass, seconded by Chester Martindale. Motion carried 4-0. Motion was made to eliminate loading zone by Kyle McCarley, motion failed for the lack of a second. Rodney Bass stated the entire request should be addressed. Motion was made to deny all of the variance requests by Rodney Bass, seconded by Chester Martindale. Motion carried 4-0. 5. Meeting adjourned at 12:30 p.m. APPROVED THIS DAY OF ,2007.
