1. The regular meeting of the Planning and Zoning Commission on Monday,
December 3,2007, was called to order at 5:30 p.m. by Richard Hunt, Acting
Chairman.
A. The following members were present:

B. The following members were absent:
Reeves Hayter, Chairman
Curtis Fendley, Vice-Chairman
Brad Archer
Darin Manning
C. Lisa Wright, Community Development Director, was also present.
2. Approval of minutes from previous meetings. Motion to approve the minutes
of the November 5,2007, meeting was made by Benny Plata, seconded by
Bobby Myers. Motion carried 5-0.
3. Public Hearing to consider the petition of Peoples Bank for a change in zoning
from a One-Family Dwelling District No.2 (SF-2) to a General Retail District
(GR) on Lot 5A, City Block 286, being number 2870 E. Price Street.
The public hearing was declared open.
A. The fOllowing individuals spoke in favor of the petition.
Terry Christian, 2750 Willow Bend, spoke in favor of the petition.
Peoples Bank owns the lot between it and Liberty Bank to the back of
the Slaton property. The Bank will raze the apartments, extend the
drive-thru facility, and put an entrance on E. Price to reduce the
congestion at Collegiate and Lamar. They may do something with the
Slaton property in the future, but they have no plans at this point.
B. There was no opposition present.
C. The public hearing was declared closed.
4. Consideration of and action on the petition of Peoples Bank for a change in
zoning from a One-Family Dwelling District (SF-2) to a General Retail District
(GR) on Lot SA, City Block 286, being number 2870 E. Price. Motion was made
by Bobby Myers, seconded by Benny Plata, to approve the request. Motion
carried 5-0.
5. Public hearing to consider the petition of Peoples Bank for a change in zoning
from a Planned Development District-Retail Shopping Center (PD-a) to a
General Retail District (GR) on Lot 6, City Block 286, being number 2915
Lamar A venue.
The public hearing was declared open.
A. The following individuals spoke in favor of the petition.
Terry Christian, 2750 Willow Bend, spoke in favor of the petition and
stated that the facts are the same as the previous item.
B. There was no oPposition present.
C. The public hearing was declared closed.
6. Consideration of and action on the petition of Peoples Bank for a change in
zoning from a Planned Development District-Retail Shopping Center (PD-a) to
a General Retail District (GR) on Lot 6, City Block 286, being number 2915
Lamar A venue. Motion was made by Fran Neeley, seconded by Barbara
Forrest, to approve the request. Motion carried 5-0.
7. Public hearing to consider the petition of AI Green for a change in zoning from
a Neighborhood Service District (NS) to a General Retail District (GR) on Lot
12, Block C, East Park Addition, being number 951 E. Hickory Street.
The public hearing was declared open.
A. The following individuals spoke in favor of the petition.
AI Green, 1605 17th Street N.E., spoke in favor of the petition. Mr.
Green stated he wants to lease the property out to someone who wants
to put a private club in the bUilding.
Clarene Montgomery, Seattle Washington, stated she Owns the property
at 1500 Fitzhugh. She stated that she is in favor of the zoning change,
and so is her sister, who owns property in the area, and her mother,
who also owns property in the area.
Barbara Forrest asked Ms. Montgomery if she was Mr. Green's sister.
She stated she was. She asked her if the family owned several pieces
of property in the area, and she stated they did.
B. There was no OPposition present.
C. The public hearing was declared closed.
8. Consideration of and action on the petition of AI Green for a change in zoning
from a Neighborhood Service District (NS) to a General Retail District (GR) on
Lot 12, Block C, East Park Addition, being number 951 E. Hickory Street. Lisa
Wright advised the Commission that the Comprehensive Plan recommends
that the zoning be residential in this area; therefore, the Comprehensive Plan
would need to be amended ifthe Commission wished to approve this request.
Benny Plata stated that he has a problem with putting a club in a residential
area because clubs bring trouble and police. Fran Neeley asked how close
this was to T.G. Givens, and Richard Hunt stated it is two to three blocks.
Fran Neeley stated that the Commission has been hesitant to allow mobile
homes in the city, and this is a bigger step than that. She said we have been
trying to stick to the Comprehensive Plan.
Motion was made by Barbara Forrest, seconded by Benny Plata, to deny the
petition. Motion carried 5-0.
9. Consideration of and action on the Preliminary Plat of Lot 1, Block A, Peoples
Bank 286 Addition, being number 2805 Lamar A venue. Motion was made by
Fran Neeley, seconded by Bobby Myers, to approve the plat subject to the
City Engineer's recommendation. Motion carried 5-0.
10. Consideration of and action on the Final Plat of Lot 1, Block A, Peoples Bank
286 Addition, being number 2805 Lamar A venue. Motion was made by
Richard Hunt, seconded by Benny Plata, to approve the plat subject to the City
Engineer's recommendation. Motion carried 5-0.
11. Consideration of and action on the Preliminary Plat of Lot 1, Block A, Omega
306 Addition, being number 2885 Stillhouse Road. Motion was made by
Barbara Forrest, seconded by Bobby Myers, to approve the plat subject to the
City Engineer's recommendation. Motion carried 5-0.
12. Consideration of and action on the Preliminary Plat of Lots 1, 2, 3, and 4,
Block G, and Lots 5, 6, 7, and 8, Block K, The Hills Phase \I. Motion was made
by Fran Neeley, seconded by Bobby Myers, to approve the plat subject to the
City Engineer's recommendation. Motion carried 5-0.
13. Consideration of and action on the Master Plat of Lots 1, 2, 3, and 4, Block G,
and Lots 5, 6, 7, and 8, Block K, The Hills Phase \I. Motion was made by
Benny Plata, seconded by Barbara Forrest, to approve the plat subject to the
City Engineer's recommendation. Motion carried 5-0.
14. Discussion of and possible action on proposed revisions to the
Comprehensive Land Use Map.
Lisa Wright presented a map to the Commission. She stated that they has
trouble printing large copies, so she would try to get something printed to
mail to them for review prior to the next meeting. She recommended that the
Commission make additional amendments to the definitions of Low-Density,
Moderate-Density, and High-Density Residential. She stated that zoning
should be progressive to provide adequate buffers, such as zoning
residential, then office next to it, then retail, then commercial, then industrial.
The current Map has retail and commercial lumped together, but they are two
distinctly different classifications because so much more can go into
Commercial zoning. She recommended that they be separated and that a
buffer be added.
Benny Plata stated that he was not happy with the locations of the
Manufactured Housing districts. Lisa Wright stated that this map is the first
time the Commission has seen all changes fully incorporated onto one map,
so the Commission can make any additional changes to the map before it is
finally acted upon. She reminded the Commission that a subcommittee has
previously reviewed manufactured housing ordinances and made
recommendations for a new ordinance. Mr. Plata asked what the definition of
a mobile home was, and Ms. Wright stated that it all came down to a
construction date, but she did not know the entire definition off-hand.
Fran Neeley stated that she wants a list of definitions before she adopts the
final map. She requested that the City Attorney be at the next meeting to help
the Commission make sure it adopts good definitions. Richard Hunt stated
that the definitions should be kept simple. Lisa Wright stated that the
Commission was nearing a point where the City Attorney would need to be
very involved because the process of amending the plan is very technical.
