BACKGROUND:
Mr. Nash lives at 645 Johnson Woods Drive in the Merry-Glenn Subdivision being Block B,
Lots 3 & 4. His property has a pool with a deck that has been undermined during some of
the recent heavy rainfalls. He is in the process of having his deck stabilized at his own
expense. The City has a 25-foot municipal drainage easement running along the east side
(rear) portion of his residential lots.
During the last two large rains we have had this year, at least eight houses in the City
suffered some degree of flood damage inside the structure. We are evaluating each one of
these situations individually to determine if there is anything the City needs to do to improve
drainage flow within the City's drainage easements or rights-of way. We will prepare a
summary of the eight situations and present this report to Council before the meeting.
The City of Paris is responsible for maintaining a functioning municipal drainage easement,
which includes periodic inspections and removal of any large objects that may be impeding
water flow in the drainage easement.
As the fee simple owner of the land (the City holds only a drainage easement across the land)
the property owner is responsible for maintaining the property such as mowing and general
upkeep. The property owner is also prohibited from placing any obstructions in the City
drainage easement, such as fencing, storage sheds, trees, shrubs, etc.

Drive and SE 31st. Serious erosion is accuring in a stretch of
waterway caused primarily by a paved water collection drainage:
ditch that collects all runoff water from east side of Crockett
Middle School and dumps into the unpaved drainage easement

Engineering staff has seen and photographed problem.
