2008-016-ORD-APPROVING AND ADOPTING REVISIONS TO FUTURE LAND USE PLAN MAP AND FUTURE LAND USE PLAN MAP LEGEND EXPLANATIONS2008-016 ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS APPROVING AND ADOPTING REVISIONS TO THE FUTURE LAND USE PLAN MAP AND THE FUTURE LAND USE PLAN MAP LEGEND EXPLANATIONS OF THE COMPREHENSIVE PLAN, MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A PENALTY CLAUSE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 211.004 of the Local Government Code requires that all zoning regulations must be adopted in accordance with a comprehensive plan and must be designated to lessen congestion in the streets; secure safety from fire, panic, and other dangers; promote health and the general welfare; provide adequate light and air; prevent the overcrowding of land, avoid undue concentration of population; or facilitate the adequate provision of transportation, water, sewers, schools, parks, and other public requirements; and, WHEREAS, on September 6, 2001, the City Council of the City of Paris enacted Ordinance No. 2001-054 which adopted a new Comprehensive Zoning and Land Use Plan for the City of Paris; and, WHEREAS, the Planning and Zoning Commission has undertaken a thorough review of the City's comprehensive Zoning and Land Use Plan in order to recommend revisions that would reflect actual land use changes in various areas over the past few years, and provide better guidance for future land use development that logically fits with those land use trends and has additionally developed more comprehensive definitions for the land uses themselves; and, WHEREAS, on April 7, 2008, the Planning and Zoning Commission reviewed and approved proposed changes to the Future Land Use Plan Map and Future Land Use Plan Map Legend Explanations and in accordance with Chapter 213 of the Local Government Code the Planning and Zoning Commission held a public hearing on May 5, 2008; and, WHEREAS, on May 12, 2008, the City Council of the City of Paris held a public hearing to receive input from the citizens of the City of Paris regarding the proposed amendments to the Future Land Use Plan Map and Future Land Use Plan Map Legend Explanations as contained in Exhibit A attached hereto; and, WHEREAS, the City Council desires to adopt the aforesaid amendments to the Future Land Use Plan Map and the Future Land Use Plan Map Legend Explanations of the Comprehensive Plan, and the same should be approved. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the proposed amendments to the Future Land Use Plan Map and the Future Land Use Plan Map Legend Explanations of the Comprehensive Plan, attached hereto as Exhibit A and made a part hereof, be and they are hereby approved and adopted. Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section S. That it is the intention of the City Council of the City of Paris that this ordinance, and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. That any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor, and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and each and every day's continuance of any violation of the above -enumerated sections shall constitute and be deemed a separate offense. Section 7. That this ordinance shall become effective immediately upon its passage. Kent Mc ar, City Attorney Comprehensive Plan, City of Paris, Texas Future Land Use LAND USE PLAN MAP. THE FUTURE LAND USE PLAN IS DEVELOPED BASED ON THE FOLLOWING LAND USE CLASSIFICATIONS. CITY OF PARIS FUTURE LAND USE PLAN MAP LEGEND EXPLANATIONS Low -Density Residential This use is representative of traditional, single-family detached dwelling units. Of the residential categories, it is recommended that low density residential continue to account for the largest percentage. The areas designated for low density residential land use are generally not adjacent to major thoroughfares or incompatible land uses, and are in proximity to existing single-family residential land use. Although all single family areas should be labeled "low density," the. City should allow and promote a range of lot sizes. Moderate Density Residential This use is representative of two-family attached dwelling units, such as duplex units and townhomes. Medium density land uses often provide areas for "empty nesters" who may not want the maintenance of a large -lot single-family home, and for young families who may find a townhome or duplex more affordable than a single-family home. The City should consider each proposed medium density development on its own merit but also generally on the following: • The patio homes or townhomes provide a buffer between single family land uses and higher intensity land uses such as multiple family or nonresidential. • The patio homes or townhomes provide a buffer between single family land uses and major thoroughfares or collectors. • The land proposed for development of patio homes or townhomes is located along an arterial or collector roadway. High Density Residential Traditional apartment -type units in attached living complexes characterize high density residential land use. There are currently several high density residential areas within Paris. It should also be noted that medium density uses should also be permitted in any area designated for high density use. In order to Revised April 14, 2008 45.1 EXHIBIT Comprehensive Plan, City of Paris, Texas Future Land Use ensure that multiple -family areas are designed to a high standard wherever they develop in the future, the City should consider incorporating the following guidelines into the Zoning Ordinance: • The proposed multi -family tract should be adjacent to an arterial roadway; • All structures within the multi -family development should be at least 90 percent masonry on exterior of the first story; • If the tract is adjacent to single-family residential dwellings, transition areas (greenspace, buffer areas, medium density development, etc.) should be incorporated into the project; • Based upon the density of the complex, an appropriate amount of usable open space should be required. Manufactured Housing This use consists of "HUD -code manufactured homes" as defined in Section 1201.003 of the Texas Occupations Code, as amended. Planned Development District This classification includes all uses and developments with design standards to assure transition to and protection of the adjacent properties, based upon site plan review approval. Office This use consists of commercial developments providing services for sale such as an accountant or a physician, or providing general office and administrative uses. Retail Retail land use areas are intended to provide for a variety of retail trade, personal, and business services and establishments, such as grocery store, drug store, restaurant, or department store. Retail establishments generally require greater visibility than do other types of nonresidential land use (e.g., office, commercial). As such, retail land uses have been designated in the higher traffic areas and at major intersections. However, retail uses do not have outside storage and sale of items, with the exception of occasional temporary displays of items not specifically prohibited by zoning regulations. Revised April 14, 2008 45.2 Comprehensive Plan, City of Paris, Texas Future Land Use Commercial Areas designated for commercial land use are intended for a variety of commercial uses and establishments with outside storage, display, and sales. Examples of such uses include automobile - related services, manufactured home sales, self - storage units, welding shops, and pawn shops. Commercial uses often locate along major thoroughfares not because they need the visibility, as retail uses generally do, but because they need the accessibility. The challenge lies in the fact that commercial uses generally have a greater need for outside storage areas, and these areas tend to lessen the visual quality of major thoroughfares. CentralArea This classification includes a mix of residential, retail, service, and business uses that provide for the daily convenience needs of on-site and nearby employees and residents. The purpose is to provide for pedestrian and transit -oriented high density employment and cultural uses together with limited complementary retail and higher density residential and other compatible uses that enhance the Central Area. Light Industrial This use includes light manufacturing processes which are contained within a building or which do not emit detectable dust, odor, smoke, gas, or fumes beyond the bounding property lines of the lot or tract upon which the use is located and which do not generate noise or vibration at the boundary of the District which is generally perceptible in frequency or pressure above the ambient level of noise in the adjacent areas. Heavy Industrial Public Lands and Institutions Parks and Recreation Revised April 14, 2008 This use includes intensive land uses including manufacturing, industrial servicing, or storage process not prohibited by law. Most uses in this District require a Specific Use Permit (SUP). This use includes primarily government, education, and health facilities. Open space amenities for both active and passive recreation. This category includes sport facilities, open space, playgrounds, recreation centers, and aquatic facilities. Revised April 14, 2008 45.4 Comprehensive Plan, City of Paris, Texas Future Land Use Agricultural This category includes uses devoted primarily to the tilling of soil, the raising of crops, horticulture, livestock, poultry, feed lots, and related commercial and industrial activities.
