2007-008-RES-approving the appointment of Kent McIlyar for the position of City Attorney of Kent McIlyarRESOLUTION NO. 2007 -008 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING THE APPOINTMENT OF KENT McILYAR FOR THE POSITION OF CITY ATTORNEY OF THE CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, former City Attorney of the City of Paris, Larry Schenk did heretofore tender his resignation effective November 16, 2005; and, WHEREAS, the City Council of the City of Paris did on November 20, 2006 interview for the position of City Attorney of the City of Paris; and, WHEREAS, it is deemed in the best interest of the citizens of the City of Paris to appoint Kent McIlyar as City Attorney of the City of Paris, under the terms described in Exhibit A attached hereto, and the same should be approved; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the City Council of the City of Paris does hereby approve the appointment of Kent McIlyar as City Attorney for the City of Paris under the terms described in Exhibit A attached hereto. Section 3. That this resolution shall be effective from and after its date of passage. PASSED AND APPROVED this 16th day of January, 2007. Kent McIlyar 4661 Livingston Avenue Dallas, Tx 75209 Dear Mr. McIlyar: As we discussed on the telephone on 1/3/07, the City Attorney position with the City of Paris, Texas, is hereby offered to you in accordance with the following terms, subject to final approval by the Paris, City Council: • Salary in accordance with the City of Paris Pay Plan, Grade Z63, step 4, salary of $90,029 per year. • The City will pay for actual moving expenses with a maximum expense of $8,500. • Full employee benefits as outlined in the City Personnel Policy Book. • The City will provide up to 3 days of administrative leave (paid leave) for you to handle business related to relocation to Paris. • In the event that the City Council terminates your employment as City Attorney for any reason, other than as a result of a conviction for a misdemeanor involving moral turpitude or personal gain, or any felony; the City shall pay to you a lump sum cash payment equal to three (3) months full salary and benefits, plus the cash value of all accrued vacation leave and up to 20 days of sick leave.
