RESOLUTION NO. 2002-026
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, DECLARING AS SURPLUS PROPERTY ONE (1) MODEL
YEAR 1997 FORD F350 TYPE 1 AMBULANCE; FINDING A PUBLIC NEED
AND NECESSITY IN TRANSFERRING SAID SURPLUS PROPERTY TO
THE LAMAR COUNTY CHAPrER OF THE AMERICAN RED CROSS;
ACCEPTING A DONATION FROM LAMAR COUNTY TO DEFRAY FIFTY
PERCENT (50%) OF THE TRADE-IN VALUE OF SAID AMBULANCE;
APPROVING DONATION OF SAID AMBULANCE TO THE RED CROSS;
AUTHORIZING PAYMENT BY THE CITY OF PARIS OF THE
REMAINING VALUE OF SAID AMBULANCE AS A TRADE-IN TOWARDS
THE PURCHASE OF A NEW AMBULANCE; REPEALING PRIOR
RESOLUTION NO. 2002-002; MAKING OTHER FINDINGS AND
PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN
EFFECTIVE DATE.
WHEREAS, the City EMS Ambulance Service has identified an existing model year 1997
Ford F350 Type 1 Ambulance, designated Medic 4 by the City Ambulance Service, as a vehicle
and piece of equipment, because of age, mileage, and use, no longer considered necessary for
ambulance purposes and thereby considered surplus equipment; and,
WHEREAS, the City Council of the City of Paris, Paris, Texas, desires to designate said
ambulance as surplus equipment; and,
WHEREAS, the practice of the City in the past has been to utilize such surplus ambulance
equipment for its trade-in value in acquiring new ambulance equipment; and,
WHEREAS, the Lamar County Chapter of the American Red Cross by and through its
Executive Director, Ms. Lisa McAllister, has petitioned the City Council of the City of Paris to
transfer said equipment to the American Red Cross for subsequent use as a disaster relief vehicle;
and,
WHEREAS, the Red Cross has indicated such a disaster vehicle would be used to treat
local victims of the city and the county in a disaster; would be used as a canteen to serve food,
provide blankets, and other basic necessities during a disaster; would be used in the city and the
county as a first aid station for a variety of community purposes; and would be used to replace an
existing disaster vehicle currently in a state of disrepair; and,
WHEREAS, the City Council finds and determines that the transfer of said surplus vehicle
to the Lamar County Chapter of the American Red Cross, and the purposes to which it would be
utilized as a disaster relief vehicle, constitute a public purpose and use to the betterment of the
public health, safety, and welfare of the citizens of the city of Paris; and,
WHEREAS, the aforesaid surplus vehicle has value to the City of Paris only as a trade-in
vehicle for purposes of acquiring a new ambulance, and the trade-in value of said vehicle has been
established as $15,503.00 based on prior Resolution No. 2001-184, adopted on November 12,
2001, and the City Council authorized the City Manager to utilize said surplus vehicle as a trade-in
to the Houston-Galveston Area Council of Governments at the value of $15,503.00; and,
WHEREAS, to the extent a portion of the value of said vehicle as a trade-in should be
reimbursed to the City, the Lamar County Chapter of the American Red Cross has previously
offered $5,000.00 to defray in part the value of the vehicle as a trade-in; and,
WHEREAS, the City Council has, by adoption of Resolution No. 2002-022 on January
14, 2002, authorized payment of the remaining value of the trade-in after the adjustment for the
$5,000.00 contributed by the Red Cross, or $10,503.00, to be paid pursuant to the County's
current contract with the City of Paris for ambulance service, whereby Lamar County pays forty
percent (40%) and the City of Paris pays sixty percent (60%) of the unreimbursed cost of the
expenses of said ambulance service; and,
WHEREAS, the Commissioners Court of Lamar County has further requested the City to
reconsider the donation of the ambulance to the Red Cross and is now willing to contribute an
amount equivalent to fifty percent (50%) of the trade-in value ofthe ambulance, that is, fifty percent
(50%) of$15,503.00, or $7,751.50, in part in lieu of the $5,000.00 offered by the Red Cross, and the
City Council desires to consider the offer by Lamar County and reconsider the terms for donation
to defray the cost ofthe trade-in value of said ambulance; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all
things approved.
Section 2. That a model year 1997 Ford F350 Type 1 Ambulance, Vehicle Identification
Number IFDKF3FOVEBI8087, currently designated by the City EMS Service as Medic 4,
because of its age, mileage, general condition, and extensive use, shall be and is hereby designated
as obsolescent and surplus property no longer appropriate for use as an ambulance by the City of
Paris EMS Ambulance Service.
Section 3. That the offer of a contribution by Lamar County in the amount of fifty percent
(50%) of the trade-in value of the Medic 4 ambulance, that is, fifty percent (50%) of$15,503.00,
or $7,751.50, to defray fifty percent (50%) of the value of the Medic 4 ambulance as a trade-in
towards the purchase of a new ambulance is hereby accepted.
Section 4. That the request for the City to transfer said ambulance to the Lamar County
Chapter of the American Red Cross is hereby approved, and the City Council hereby directs that
the remaining value of said ambulance as a trade-in, after contribution by Lamar County in the
amount of $7,751.50, shall be paid in a like amount of $7,751.50 by the City of Paris.
Section 5. That because of the overwhelming public purpose to be served as specified in
this resolution by using said surplus vehicle as a disaster relief vehicle, the aforesaid surplus
vehicle is hereby authorized for transfer to the Lamar County Chapter of the American Red Cross,
provided said vehicle shall hereafter be used as a disaster relief vehicle and not as an ambulance.
Provided further that, before said vehicle shall be used as a disaster relief vehicle, lettering,
markings, equipment, and other manifestations of the vehicle identifying it as an ambulance shall
be removed, and all lighting shall be converted to conform with appropriate State standards for
use as a disaster relief vehicle and not as an ambulance.
Section 6. That prior Resolution No. 2002-002 adopted on January 14, 2002, is hereby
in all things repealed.
Section 7. That this resolution shall be effective from and after its date of passage.
