Notice is hereby given that the City Council of the City of Paris shall meet in regular session
on Monday, October 13, 2008 at 5:00 p.m. The meeting will be held at the City Council
Chamber, 107 E. Kaufinan Street, in Paris, Texas. The matters to be discussed and acted
upon are as follows:
Work Session 5:00 p.m.
The Council will conduct a work session to discuss items on the Regular
Agenda. No action will be taken during the work session.
Regular Meeting 6:00 p.m.
Opening Agenda
1. Call meeting to order.
2. Invocation.
3. Pledge of Allegiance.
4. Citizens' forum.
(Persons desiring to address the Council must limit their presentation to no more than two
minutes. The Texas Open Meetings Act prohibits the Council from responding to any
comments other than to refer the matter to a future agenda, to an existing policy, or to a staff
person with specific factual information. Claims against the City, Council Members, or
employees, as well as individual personnel appeals are not appropriate for citizens' forum.)
Consent Agenda
Items on the Consent Agenda are approved by a single action of the Council, with such approval applicable
to all items appearing on the Consent Agenda. A Council Member may request any item to be removed
from the Consent Agenda and considered as a separate item.
5. Deliberate and act on the approval of minutes from the meetings
on September 10, 2008; September 15, 2008; September 19, 2008
September 22, 2008, and September 29, 2008.
6. Receive and deliberate on reports and/or minutes from the
following boards, commissions, and committees:
a. Lake Pat Mayse Water Study Committee (July 10, 2008; July
24, 2008; and August 7, 2008)
7. Deliberate and act on a resolution approving a professional
services agreement with American Red Cross; and authorizing the
City Manager to negotiate and execute all necessary documents.
8. Deliberate and act on a resolution approving a professional
services agreement with East Texas Council on Alcohol and Drug
Abuse (ETCADA); and authorizing the City Manager to negotiate
and execute all necessary documents.
9. Deliberate and act on a resolution approving a professional
services agreement with Models of the Maker; and authorizing the
City Manager to negotiate and execute all necessary documents.
lO.Deliberate and act on a resolution approving a professional
services agreement with CASA; and authorizing the City Manager
to negotiate and execute all necessary documents.
11.Deliberate and act on a resolution approving a professional
services agreement with Children's Advocacy Center; and
authorizing the City Manager to negotiate and execute all
necessary documents.
12.13eliberate and act on a resolution approving a professional
services agreement with Lamar County Human Resources Council;
and authorizing the City Manager to negotiate and execute all
necessary documents.
13.Deliberate and act on a resolution approving a professional
services agreement with the Lamar County Historical Museum;
and authorizing the City Manager to negotiate and execute all
necessary documents.
14.Deliberate and act on a resolution finding that Oncor Electric
Company's requested increases to its electric transmission and
distribution rates and charges within the City should be denied and
finding that the City's reasonable rate case expenses shall be
reimbursed by the Company.
15.Deliberate and act on a resolution authorizing the execution of an
Agreement for Arbitrage Rebate Compliance Services with First
Southwest Asset Management, Inc.; and authorizing the City
Manager to negotiate and execute all necessary documents.
16.Deliberate and act on a resolution approving the application for the
2009-2010 Texas Community Development Block Grant to fund
the replacement of sewer infrastructure in the central portion of the
City of Paris; and authorizing the City Manager to negotiate and
execute all necessary documents.
17.Deliberate and act on a resolution accepting the donation of a
pedestrian bridge to be placed at US 271 and Loop 286 from the
Greater Paris Development Foundation, Inc., and approving and
authorizing the execution of a Lease Agreement between the City
of Paris and the Greater Paris Development Foundation, Inc. for
the property known as the 0.8 mile East Extension of Trail de
Paris; and authorizing the City Manager to negotiate and execute
all necessary documents.
18.Deliberate on drainage ditch maintenance report.
19.Deliberate on Casa Bonita demolition project.
20.Report on demolition of dilapidated houses.
21.Report on goals and objectives.
Regular Agenda
22.Public hearing, deliberate and possibly act on first reading of an
Ordinance approving a request for zoning change from One-
Family Dwelling District No. 3(SF-3) to One-Family Dwelling
District No. 3(SF-3) with a specific use for permit for day care on
Lot 2A, City Block 279, being 1462 15th Street N.E.
23.Deliberate on recording of all council meetings.
24.Deliberate on cell phone usage in school zones.
25.Deliberate on cost of living payments.
26.Deliberate and act on a resolution approving an application for a
Texas Department of Transportation Capital Improvement
Program Grant for various projects at Cox Field; and authorizing
the City Manager to negotiate and execute all necessary
documents.
27.Public hearing, deliberate and possibly act on first reading of an
Ordinance amending the budget for the fiscal period beginning
October 1, 2008 and ending September 30, 2009, as amended in
accordance with the Charter of the City of Paris and appropriating
the various amounts.
28.Convene into Executive Session pursuant to Section 551.071 of the
Texas Government Code, consultation with attorney to receive
legal advice about pending or contemplated litigation and/or on
matter in which the duty of an attorney to his client under the
Texas Disciplinary Rules of Professional Conduct of the State Bar
of Texas, clearly conflict with this chapter as follows:
a. To receive legal advice on proposed electrical supply agreement
through CAPP Cities.
29.Reconvene in Open Session to deliberate and possibly take action
regarding those matters discussed in Executive Session.
30.Consider and approve future events for City Council and/or City
Staff pursuant to Resolution No. 2004-081.
31.Deliberate on possible future agenda items.
