BACKGROUND:
On October 28, 2008, a jury trial was conducted in the Municipal Court for cases filed against Chad and
Debra Brown, owners of the One Oak Apartments, for failure to comply with a demolition order issued
by the Buildings and Standards Commission. Myself, Robert Talley, and Chad C. Brown (not the
defendant) and Mary Crumpler, members of the BSC at the time the property was considered, testified
in the case. After hearing the facts, the jury found both defendants guilty and fined each of them
$2,000.00, which is the maximum fine.
It is unlikely that Chad and Debra Brown have the resources to demolish the complex. In mid-October,
Community Development solicited Brady Environmental to perform an asbestos survey on the building.
On November 18, 2008, the City received the final inspection report indicating that asbestos is present in
floor tile and mastic, sheetrock, tape, bedding, joint compounds, and spray-on ceiling textures. This
building is structurally intact for the most part, however, the materials must be removed prior to
demolition. The City is seeking estimates (not formal bids) so that the City Council will have an idea
what this project may cost so it can determine if it wishes to proceed with formal solicitation of bids for
the demolition of this complex.
Research indicates that there is no mortgage lien holder on this property.
