2001-022-ORD PROVIDING EXTENSION OF CERTAIN BOUNDARY LIMITS OF COP AND ANNEXATION OF 48.42 ACRES ORDINANCE NO. 2001-022 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 48.42 ACRES, MORE OR LESS, AS REQUESTED BY PETITION OF THE OWNERS THEREOF; GRANTING TO SAID TERRITORY AND TO ALL FUTURE INHABITANTS OF SAID PROPERTY ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID FUTURE INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF THE CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a petition of annexation has been duly signed and acknowledged by each and every person or corporation having an interest in the following described territory, to-wit: Being all that certain tract ofland located 4.5 miles 480 East of the City of Paris, Lamar County, Texas; being a part ofa 128.76 acre tract; being a part of the Wesley Askins Survey, Abstract No.7; being a part ofa called 138.5 acre tract of land conveyed to C. L. Darnell by deed dated February 5, 1984, and recorded in Volume 667, Page 682 ofthe Deed Records of Lamar County, Texas; and being more particularly described as follows: BEGINNING at a point in the existing city limit line of the city of Paris as described in Tract 5 of Ordinance No. 97-059, passed and adopted by the City Council of the City of Paris on December 15, 1997, said point being a distance of500 feet from the centerline ofF.M. Highway 195 and being located in an existing fence line found in the west line of the said 128.76 acre tract ofland and the east line ofa 3 acre tract ofland conveyed to John L. Simmons and wife, Brenda C. Simmons, on May 10, 1993, and recorded in Volume 359, Page 10 of the Lamar County Real Property Records, and the east line of a 1.52 acre tract of land conveyed to John L. Simmons and wife, Brenda C. Simmons, on May 10, 1993, and recorded in Volume 359, Page 10 of the Lamar County Real Property Records; THENCE North 30 32' 48" West with said existing fence line and the east line of said 3 acre tract ofland and the east line of said 1. 52 acre tract ofland a distance of 128.70 feet, more or less, to a found iron rod; THENCE North 880 59' 35" West with the South line of said 128.76 acre tract ofland and the north line of the said 1.52 acre tract ofland a distance of553.34 feet to a found iron rod at the northwest corner of the said 1.52 acre tract ofland; THENCE North 10 10' 07" West with a fence a distance of 96.46 feet to a found iron rod; THENCE South 89015' 49" West with a fence a distance of633.26 feet to a found iron rod at the southwest comer of the said 128.76 acre tract ofland; THENCE North 60 40' 54" West with a fence a distance of 2.50 feet to a found iron rod; THENCE North 00 45' 03" West with a fence a distance of 1194.33 feet to a set iron rod; THENCE North 880 57' 03" East with a fence a distance of83.63 feet to a found iron rod; THENCE North 00 35' 52" West a distance of 141.12 feet to a point for comer; THENCE East a distance of385.5 feet to a point for corner; THENCE North 00 35' West a distance of 140.0 feet to a point for comer; THENCE East a distance of 1050,0 feet to a point for comer; THENCE South 460 14' East a distance of207.88 feet to an iron pin found for corner; THENCE South a distance of 876.40 feet to an iron pin found for comer; THENCE South 60 00' 57" West to a point in the existing Paris city limit line as described in Tract 5 of said Ordinance No. 97-059, said point being a distance of 500 feet from the centerline ofF. M. 195; THENCE southwesterly along the existing city limit line, being at all times a distance of 500 feet from the centerline ofF. M. 195, to the point of beginning, and containing 48.42 acres, more or less; and, WHEREAS, said tract ofland is contiguous and adjacent to the current city limits ofthe city of Paris, Texas, and is not more than one-half (1/2) mile in width; and, WHEREAS, said petition fully conformed with the requirements of Section 6 of the Charter of the City of Paris and Section 43.028 of the Local Government Code; and, WHEREAS, said petition was presented to the City Council on the 12th day of March, 2001; and, WHEREAS, after hearing such petition and the arguments for and against the same, the City Council adopted Resolution No. 2001-021 granting such petition to annex said territory into the city of Paris, Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. M. 195; THENCE southwesterly along the existing city limit line, being at all times a distance of500 feet from the centerline ofF M. 195, to the point of beginning, and containing 48.42 acres, more or less, be, and the same is hereby, annexed to the city of Paris, Texas, and that boundary limits ofthe city of Paris, Texas, be, and the same are hereby, extended to include the above-described territory, and the same shall hereafter be included within the territorial limits of the city of Paris, and that said land and the inhabitants thereof shall hereafter be entitled to all ofthe rights and privileges and subject to all of the obligations and responsibilities of other citizens of the city of Paris, Texas, and shall be bound by the acts and ordinances of the City of Paris. Section 3. That the City Clerk be, and she is hereby, directed to file with the County Clerk of Lamar County, Texas, a certified copy ofthis Ordinance accompanied by a copy of the Petition for Annexation. Section 4. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 5. That this ordinance shall become effective on April 9, 2001.
