2001-026-1-ORD AMENDING ZONING ORDINANCE NO 1710 AND CHANGING BOUNDARIES ESTABLISHED BY ZONING MAP OF SAID CITY ON LOT 2 CITY BLOCK 342 ON PROPERTY BELONGING TO KENNETH SCOTT BAXLEY ORDINANCE NO. 2001-026 -1 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY THE ZONING MAP OF SAID CITY; ESTABLISHING A COMMERCIAL DISTRICT (C) ON LOT 2, CITY BLOCK 342, ON PROPERTY BELONGING TO KENNETH SCOTT BAXLEY, OWNER, SO AS TO INCLUDE THEREIN TERRITORY FORMERLY DESIGNATED AS AN AGRICULTURAL DISTRICT (A); DESIGNATING THE BOUNDARIES OF THE COMMERCIAL DISTRICT (C) SO ESTABLISHED; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES ORP ARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE OF JUNE 1,2001. WHEREAS, the City Council of the City of Paris, Paris, Texas, has previously received a request for an amendment to the zoning ordinance of the City of Paris; and, WHEREAS, the City Council has subsequently referred said request for amendment to the Planning and Zoning Commission for its review and recommendation in accordance with the City zoning ordinance and State law; and, WHEREAS, the Planning and Zoning Commission did conduct a public hearing on said proposed amendment to the City zoning ordinance and, following said hearing, made formal recommendation to the City Council regarding said proposed change; and, WHEREAS, the City Council of the City of Paris did subsequently conduct a public hearing on the aforesaid proposed amendment to the City zoning ordinance, and having considered the recommendations ofthe Planning and Zoning Commission and the testimony and evidence introduced at said public hearing, found and determined that approving the aforesaid zoning change would be consistent with the comprehensive plan of the City of Paris, consistent with the City zoning ordinance, and in the best interests and to the benefit of the public health, safety, and welfare of the citizens of the City of Paris; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble of this ordinance are hereby in all things approved, Section 2. That the boundaries heretofore established by the Zoning Map and Ordinance No. 1710 of the City of Paris, Paris, Texas, be, and the same are hereby, changed, and that a COMMERCIAL DISTRICT (C) be, and the same is hereby, established on LOT 2, CITY BLOCK 342, on property belonging to KENNETH SCOTT BAXLEY, so as to include in such COMMERCIAL DISTRICT (C) the hereinafter described property, which was formerly and is presently designated as an AGRICULTURAL DISTRICT (A), and that the boundaries of said COMMERCIAL DISTRICT (C), be, and the same are hereby, established as follows: All those certain tracts or parcels ofland in Lamar County, Texas, described in deed as Tracts One and Two from Freeman Roxie Safford to Kenneth Scott Baxley, recorded in Volume 1004, Page 200, Real Property Records of Lamar County, Texas, being number 2800 3rd Street S.E., and being more particularly described as follows: Tract One: SITUATED within the corporate limits of the City of Paris, County of Lamar, and State of Texas, being a part of the James King Survey, Abstract No. 511, and being a part ofa 50 acre tract ofland described in deed recorded in Volume 286, Page 107, Lamar County Deed Records, being part of Lot 2, City Block 342, and being more particularly described as follows: BEGINNING at an iron pipe in the east boundary line ofFM Highway No. 1497, this point being 40 feet east of the west boundary line of the King Survey, and 184 feet north and 40 feet east of the southwest comer of the above-mentioned 50 acre tract ofland; THENCE East a distance of 313 feet to an iron pipe; THENCE North a distance of288 feet to an iron pipe in the south boundary line of Loop 286; THENCE with the south boundary line of Loop 286 as follows: South 81 Deg. 55 Min. West a distance of229 feet to a concrete monument; South 40 Deg. 30 Min. West a distance of 122.5 feet to a concrete monument; THENCE South with the east boundary line ofFM Highway No. 1497 a distance of 182 feet to the place of beginning, containing 1. 848 acres ofland, and being the same property described in deed to Francis R. Safford and wife, Freeman R Safford, dated November 19, 1973, of record in Volume 553, Page 798, Lamar County Deed Records; reference being made to all the above-mentioned instruments and records for all necessary purposes. Tract Two: SITUATED within the corporate limits of the City of Paris, County of Lamar, and State of Texas, being a part of the James King Survey, and being a part ofa 76.8 acre tract ofland described in deed from Nellie Brooks Bradley et al to W. Claude Walker on February 21, 1947, recorded in Volume 290, Page 565, Lamar County Deed Records, being part of Lot 2, City Block 342, and being more particularly described as follows: BEGINNING at a stake in the east boundary line ofF. M. Highway No, 1497 at a point 182 feet south of the south boundary line of Loop 286, said point being also 422 feet south and 40 feet east from the northwest comer of said Bradley et ai-Walker 76.8 acre tract ofland; THENCE East a distance of 313 feet to a stake; THENCE South a distance of209 feet to a stake; THENCE West a distance 0013 feet to a stake; THENCE North with the east boundary line ofF. M. Highway No. 1497 a distance of209 feet to the place of beginning, containing 1.5 acre ofland, reference being made to the above-mentioned instruments and records for all necessary purposes; said tracts described herein being number 2800 3rd Street S.E. Section 3. That the Chief Building Official of the City of Paris be, and he is hereby, directed to change the Zoning Map of the City of Paris in accordance with the provisions of Ordinance No. 1710 and the land use map accompanying the same, and in accordance with the provisions of this ordinance, Section 4. That any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor, and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and each and every day's continuance of any violation of the above-enumerated sections shall constitute and be deemed a separate offense. Section 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 6. That this ordinance shall become effective June 1, 2001.
