ORDINANCE NO. 2001-035
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, AMENDING ARTICLE III TO CHAPTER 23, SECTION 23-
77 OF THE CODE OF ORDINANCES OF THE CITY OF PARIS TO REVISE
THE RATES FOR DAILY PASSES, DAILY PASS GROUP RATES, AND
DAY CARE RATES FOR THE USE OF THE CITY OF PARIS AQUATIC
FACILITY; ADOPTING A NEW ARTICLE IV TO CHAPTER 23 OF THE
CODE OF ORDINANCES ENTITLED REGULATIONS AND FEES FOR IN-
PARK PROGRAMS; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, Article III to Chapter 23 of the Code of Ordinances of the City of Paris, at
Section 23- 77, establishes fees for daily passes, daily pass group rates, and day care group rates for
use of the City of Paris aquatic facilities; and,
WHEREAS, the Director of the Parks and Recreation Department has identified the need
to increase said rate to enable the City to recover its cost in operating the aquatic facilities; and,
WHEREAS, the City likewise conducts various other programs in its various parks other
than the aquatic facilities; and,
WHEREAS, the City Council desires to authorize the Director of Parks and Recreation to
promulgate rules and regulations for the conduct of such programs in the City's parks and to assess
appropriate fees in a manner similar to those rules and regulations authorized for the use of the City's
aquatic facility and the adopted fees similar to those fees authorized for use of the City's aquatic
facility; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby in all things
approved.
Section 2. That Sections 23-77(a) (1),(2), and (6) of Article III, Chapter 23 of the Code of
ordinances of the City of Paris, Paris, Texas, are hereby in all things amended to increase the rates
for daily passes, daily pass group rates, and day care group rates at the City of Paris aquatic facility,
such revised rate schedules and amended provisions of Section 23-77 to read as follows:
"Sec. 23-77. Fees and requirements for rental.
"(a) The department of parks and recreation shall charge the following fees to the
public under the following requirements for the use of the City of Paris aquatic
facility:
"(1) Daily pass $2.00 per person;
"(2) Daily pass group rate (20 or more people) $1.00 per person;
"
"(6) Day care group rate (20 or more people) $1.00 per child. Arrangements
must be made for day care by contacting the department of parks and
recreation. "
Section 3. That all other terms and provisions of Section 23-77 of the Code of Ordinances
not amended by the terms and provisions of this ordinance shall remain in full force and effect.
Section 4. That there is hereby adopted to Chapter 23, Parks and Recreation, of the Code
of Ordinances of the City of Paris, Texas, a new Article N, to be entitled "Regulations and Fees for
In-Park Programs", said new Article N to read as follows:
"ARTICLE IV. REGULATIONS AND FEES FOR IN-PARK PROGRAMS
"Sec. 23-90. Rules and regulations for in-park programs.
"All recreational or other programs conducted in the city's parks must be authorized
by the city's director of parks and recreation. The director of parks and recreation
shall promulgate and enforce any and all rules and regulations necessary to the
conduct of such programs in the city's parks, including, but not limited to, soft ball
programs, golf camps, other similar camps, park pals, diamond skills, NYSCA
coaching clinics, other similar clinics, hunter safety, start smart, and any and all other
programs authorized by the director of parks and recreation.
"Sec. 23-91. Fees.
"(a) Where the city council has not established by ordinance specific fees for various
park-related programs, the director of parks and recreation shall be and is hereby
authorized to impose such fees as shall be necessary to recover the city's expenses
incident to such programs.
"(b) The director of the department of parks and recreation may establish a
scholarship program to assist economically disadvantaged families and individuals
in improving their quality oflife through the recreational programs offered by the city
in its parks. Such scholarships will be available for all programs and amenities in the
city's parks as the director of parks and recreation shall determine.
"Sec. 23-92. Violations; penalty.
"Any person violating any of the provisions of this article shall be guilty of a
misdemeanor, and upon conviction shall be fined in any sum not to exceed two
thousand dollars ($2,000.00), and each and every day's continuance of any violation
of this article shall constitute and be deemed a separate offense."
Section 5. That all ordinances or portions of ordinances in direct conflict with the terms and
provisions of this ordinance shall be and are hereby repealed to the extent of such conflict only.
Section 6. That the terms and provisions of this ordinance are severable, and upon a finding
by any court of appropriate jurisdiction that any provision of this ordinance in unlawful, it is the
stated intention of the City Council of the City of Paris, Texas, that such finding of unlawfulness
shall not in any way affect the other terms and provisions of this ordinance, and such other terms and
provisions of this ordinance shall remain in full force and effect.
Section 7. That this ordinance shall be effective June 1,2001.
