2002-029-ORD AMENDING ZONING ORDINANCE NO 1710 AND CHANGING BOUNDARES ESTABLISHED BY ZONING MAP OF SAID CITY ON LOT 11 BLOCK 1 WARREN ADD'N ON PROPERTY BELONGING TO GARY NASH ORDINANCE NO. 2002-029 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY THE ZONING MAP OF SAID CITY; ESTABLISHING A COMMERCIAL DISTRICT (C) ON LOT 11, BLOCK 1, WARREN ADDITION, ON PROPERTY BELONGING TO GARY NASH, SO AS TO INCLUDE THEREIN TERRITORY FORMERLY DESIGNATED AS A TWO- FAMILY DWELLING DISTRICT (2F); DESIGNATING THE BOUNDARIES OF THE COMMERCIAL DISTRICT (C) SO ESTABLISHED; PROVIDING FOR A PENAL TY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council ofthe City of Paris, Paris, Texas, has previously received a request for an amendment to the zoning ordinance of the City of Paris; and, WHEREAS, the City Council has subsequently referred said request for amendment to the Planning and Zoning Commission for its review and recommendation in accordance with the City zoning ordinance and State law; and, WHEREAS, the Planning and Zoning Commission did conduct a public hearing on said proposed amendment to the City zoning ordinance and, following said hearing, made formal recommendation to the City Council regarding said proposed change; and, WHEREAS, the City Council of the City of Paris did subsequently conduct a public hearing on the aforesaid proposed amendment to the City zoning ordinance, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing, found and determined that approving the aforesaid zoning change would be consistent with the comprehensive plan ofthe City of Paris, consistent with the City zoning ordinance, and in the best interests tlnd to the benefit of the public health, safety, and welfare of the citizens of the City of Paris; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the boundaries heretofore established by the Zoning Map and Ordinance No. 1710 of the City of Paris, Paris, Texas, be, and the same are hereby, changed, and that a COMMERCIAL DISTRICT (C) be, and the same is hereby, established on LOT 11. BLOCK I, WARREN ADDITION, on property belonging to GARY NASH, so as to include in such COMMERCIAL DISTRICT (C) the hereinafter described property, which was formerly and is presently designated as a TWO-FAMILY DWELLING DISTRICT (2F), and that the boundaries of said COMMERCIAL DISTRICT (C) be, and the same are hereby, established as follows: SITUATED within the corporate limits ofthe City of Paris, County of Lamar, and State of Texas, being a part ofthe Asa Jarman Survey Abstract #473, being a part of the Warren Addition by Plat recorded in Volume 70, Page 367 of the Lamar County Deed Records, and being Lot 13, Block I ofthe Warren Addition as shown by Plat in Envelope 351- B of the Lamar County Plat Records; said lot being the tract of land conveyed to Gary Nash by deed recorded in Volume 624, Page 316 of the Lamar County Real Property Records, Lots 11 and 12 as conveyed to James Wright and wife, Lynn Wright, by deed recorded in Volume 711, Page 80 of the Lamar County Deed Records, Lot 25 as conveyed to Leroy Ricks by deed recorded in Volume 893, Page 257 ofthe Lamar County Real Property Records, and Lot 26 as conveyed to Kathy Bea McDonald by deed recorded in Volume 1156, Page 324 of the Lamar County Deed Records; also being a part of an abandoned alley as conveyed to Gary Nash by deed recorded in Volume 113 5, Page 281 of the Lamar County Real Property Records, James and Lynn Wright as recorded in Volume 1135, Page 283 of the Lamar County Real Property Records, Leroy Ricks as recorded in Volume 1182, Page 321 of the Lamar County Real Property Records, and Kathleen Draper as recorded in Volume 1182, Page 323 ofthe Lamar County Real Property Records; and being more particularly described as follows: BEGINNING at a 1/2 inch iron pin found for corner at the intersection of the south line of Maple Avenue with the east line of 19th Street N.W., said pin being the northwest corner of the said Nash tract and being the northwest corner of the original City Block 200; THENCE North 88038'35" East along said Maple Avenue a distance of85.01 feet to the 3/8 inch iron pin found for corner in a fence on the south side of a metal fence corner post, said pin being the northwest corner of a tract of land conveyed to Sandi Shonebarger by deed recorded in Volume 362, Page 87 of the Lamar County Deed Records, said pin also being the northwest corner of said lot 28; THENCE South 0033'35" East along a metal fence a distance of80.83 feet to a metal fence corner post found for corner; THENCE South 89043'14" East a distance of65.83 feet to a metal rod found for corner in a fence; THENCE South 0021'17" West a distance of 9.95 feet to a 3/8 inch iron pin found for corner; THENCE South 89047'55" East a distance of54.22 feet to a 1/2 inch iron pin found for corner at a fence corner, said pin also being in the east line of Lot 27 and the west line of Lot 26 as conveyed to said Kathy Bea McDonald; THENCE North 0022'50" West a distance of94.72 feet to a 1/2 inch iron pin set for corner in the south line of said Maple Avenue, said pin being the northwest corner of said Lot 26; THENCE North 89054'23" East, passing a 1/2 inch iron pin set at 64.82 feet, continuing in all a distance of 119.82 feet to a 1/2 inch iron pin set for corner, being the northeast corner of said Lot 25 and the northwest corner of Lot 24 as conveyed to John David Lofton by deed recorded in Volume 890, Page 132 of the Lamar County Real Property Records; THENCE South 0036'11" East, passing a 1/2 inch iron pin set at 100.00 feet, continuing in all a distance of 155. 11 feet to a wood fence corner post found for corner, being the southeast corner of said Lot 25 and being in the north line and the northeast corner of the portion of an alley (not opened) as conveyed to said Leroy Ricks; THENCE South 0029'32" East, passing a wood fence corner post at 8.93 feet, said post being the northeast corner of said alley as conveyed to James and Lynn Wright, continuing in all a distance of 15.00 feet to a 1/2 inch iron pin set for corner in the northeast corner of said Lot 11; THENCE South 0002'16" West a distance of 154.89 feet to a 1/2 inch iron pin set for corner in the north R.O.W. of Bonham Street, also being the southwest corner of Lot 10 as conveyed to the Immanuel Baptist Church by deed recorded in Volume 75, Page 216 of the Lamar County Real Property Records; THENCE South 89054'23' West along said street a distance of 119.33 feet to an iron pin found for corner in a concrete headwall, said pin being the southwest corner of said Lot 12 and being the southeast corner of said Lot 13 as shown in said Replat; THENCE North 89054'15" West continuing along said street a distance of 53.08 feet to an "x" set in the concrete parking, said "x" being the southerly southwest corner of said Nash tract and the southeast corner of a tract of land conveyed to F.F.P. Properties, L.P. by deed recorded in Volume 857, Page 107 of the Lamar County Real Property Records; THENCE North 8059'56" West, passing the east line of said lot 14 at 61.07 feet, continuing in all a distance of 81. 19 feet to an iron pin found for corner; THENCE North 0005'50" East, passing the south line of said alley at 69.52 feet, continuing in all a distance of 81. 14 feet to a 1/2 inch iron pin found for corner; THENCE North 89051 '22" West, passing the east line of said Block 200 at 54.96 feet, continuing in all a distance of 141.38 feet to a 1/2 inch iron pin found for corner in the east line of said 19th Street N.W.; THENCE North 0006' West along said street a distance of 157.78 feet to the point of beginning, containing 1.643 acres of land, and being located in the 1800 Block of Bonham Street. Section 3. That the Chief Building Official of the City of Paris be, and he is hereby, directed to change the Zoning Map of the City of Paris in accordance with the provisions of Ordinance No. 1710 and the land use map accompanying the same, and in accordance with the provisions of this ordinance. Section 4. That any person violating any of the provisions of this ordinance shall be guilty ofaMisdemeanor, and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and each and every day's continuance of any violation of the above-enumerated sections shall constitute and be deemed a separate offense. Section 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 6. That this ordinance shall become effective July I, 2002.
