2003-036-ORD AMENDING ZONING ORDINANCE NO 1710 AND CHANGING BOUNDARIES ESTABLISHED BY ZONING MAP OF SAID CITY LOTS 1B AND 1C CITY BLOCK 315 AS REQUESTED BY RONALD KYLE ORDINANCE NO. 2003-036 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY THE ZONING MAP OF SAID CITY; ESTABLISHING A GENERAL RETAIL DISTRICT (GR) WITH SPECIFIC USE PERMIT (52) SIGNS AND BILLBOARDS ON LOTS IB AND IC, CITY BLOCK 315, AS REQUESTED BY RONALD KYLE, AGENT TO LEASE FROM D. WAYNE BROWN, OWNER, SO AS TO INCLUDE THEREIN TERRITORY FORMERLY DESIGNATED AS A GENERAL RETAIL DISTRICT (GR); DESIGNATING THE BOUNDARIES OF THE GENERAL RETAIL DISTRICT (GR) WITH SPECIFIC USE PERMIT (52) SIGNS AND BILLBOARDS SO ESTABLISHED; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris, Paris, Texas, has previously received a request for an amendment to the zoning ordinance of the City of Paris; and, WHEREAS, the City Council has subsequently referred said request for amendment to the Plalming and Zoning Commission for its review and recommendation in accordance with the City zoning ordinance and State law; and, WHEREAS, the Planning and Zoning Commission did conduct a public hearing on said proposed amendment to the City zoning ordinance and, following said hearing, made formal recommendation to the City Council regarding said proposed change; and, WHEREAS, the City Council of the City of Paris did subsequently conduct a public hearing on the aforesaid proposed amendment to the City zoning ordinance, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing, found and determined that approving the aforesaid zoning change would be consistent with the comprehensive plan of the City of Paris, consistent with the City zoning ordinance, and in the best interests and to the benefit of the public health, safety, and welfare of the citizens of the City of Paris; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the boundaries heretofore established by the Zoning Map and Ordinance No. 1710 of the City of Paris, Paris, Texas, be, and the same are hereby, changed, and that a GENERAL RETAIL DISTRICT (GR) WITH SPECIFIC USE PERMIT (52) SIGNS AND BILLBOARDS be, and the same is hereby, established on LOTS 1B AND lC, CITY BLOCK 315, as requested by RONALD KYLE, AGENT TO LEASE FROM D. WAYNE BROWN, OWNER, so as to include in such GENERAL RETAIL DISTRICT (C) WITH SPECIFIC USE PERMIT (52) SIGNS AND BILLBOARDS the hereinafter described property, which was formerly and is presently designated as a GENERAL RETAIL DISTRICT (C) , and that the boundaries of said GENERAL RETAIL DISTRICT (C) WITH SPECIFIC USE PERMIT (52) SIGNS AND BILLBOARDS be, and the same are hereby, established as follows: SITUA TED within the corporate limits of the City of Paris, County of Lamar, and State of Texas, being Lots IB and lC, City Block 315, and being number 3755 Loop 286 N.E. Lot 1-B Situated within the Corporate Limits of the City of Paris, County of Lamar, and State of Texas, a part of the Joseph Leach Survey #524, and being a part of a 7.539 acre tract of land conveyed Kay Brown et al by deed recorded in Volume 592, Page 328, ofthe Deed Records of said Lamar County, Texas, and being more particularly described as follows: Beginning at an iron pin (s) for corner in the East Boundary Line of Loop Hwy. 286 at the Southwest corner of a 1.687 acre tract of land conveyed out of said 7.539 acre tract, said point being South 11 Deg. 53 Min. East a distance of 170.4 ft. from the Northwest corner of said 7.539 acre tract; THENCE North 87 Deg. 04 Min. East a distance of 445.2 ft. to an iron pin (f) for corner at the Southeast corner of said 1.687 acre tract, said point being the Northwest corner of an 8.199 acre tract of land conveyed D. Wayne Brown et al by deed recorded in Volume 635, Page 897, of said Deed Records; THENCE along the East Boundary Line of said 7.539 acre tract and the West Boundary Line of said 8. 199 acre tract as follows: South 0 Deg. 16 Min. West a distance of 438.1 ft to an iron pin (s); South 0 Deg. 30 Min. West a distance of 35 ft. to an iron pin (s) for corner; THENCE South 83 Deg. 13 Min. West a distance of273.6 ft. to an iron pin (s) for corner; THENCE along the East Boundary Line of said Loop Hwy. 286 as follows: North 20 Deg. 37 Min. West a distance of 444.6 ft. to a concrete marker (f); North 11 Deg. 53 Min. West a distance of68.1 ft to the place of beginning and containing 4.035 acres of land. Lot l-C Situated about 2 miles East of the Court House, Paris, County of Lamar, and State of Texas, a part of the Joseph Leach Survey and a part of the Enoch Crown Survey and also being a part of the same land described in deed from J. K. Guest, Jr. to Chisum Square Partnership, recorded in Volume 1052, Page 84 of the Real Property Records of Lamar County, Texas, and being more particularly described as follows: Beginning at the Northwest corner of Lot 1 City Block 315; THENCE East a distance of 273.5 feet to the Northeast corner of said lot; THENCE South a distance of 130.8 feet to the Southeast corner of said lot; THEN CE West a distance of 230.1 feet to the Southwest corner of said lot; THENCE North a distance of 140.7 feet to the place of beginning. Section 3. That the Chief Building Official of the City of Paris be, and he is hereby, directed to change the Zoning Map of the City of Paris in accordance with the provisions of Ordinance No. 1710 and the land use map accompanying the same, and in accordance with the provisions of this ordinance. Section 4. That any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor, and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and each and every day I s continuance of any violation of the above-enumerated sections shall constitute and be deemed a separate offense. Section 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 6. That this ordinance shall become effective October 1, 2003.
