2004-042-ORD PROVIDING EXTENSION OF CERTAIN BOUNDARY LIMITS OF COP ORDINANCE NO. 2004-042 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 13.635 ACRES, MORE OR LESS, AS REQUESTED BY PETITION OF THE OWNERS THEREOF; GRANTING TO SAID TERRITORY AND TO ALL FUTURE INHABITANTS OF SAID PROPERTY ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID FUTURE INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF THE CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a petition of annexation has been duly signed and acknowledged by each and every person or corporation having an interest in the following described territory, to-wit: Being all that certain tract of land situated in Lamar County, Texas, a part of the Wesley Askins Survey, Abstract No. 7, a part of the 100.00 acre tract of land conveyed to D. Wayne Brown, et al., by deed recorded in Volume 939, Page 31 of the Lamar County Real Property Records, and a part of the 121.76 acre tract of land conveyed to D. Wayne Brown, et al., by deed recorded in Volume 949, Page 296 of the Lamar County Real Property Records, and being further described as follows: BEGINNING at an iron pin found at the Northeasterly corner of Lot 17, Block B, of The Hills Phase III as recorded in Envelope No. 371-C of the Lamar County Plat Records; THENCE South 580 32' 57" West a distance of 411.55 feet to an iron pin found for corner at the most Northwesterly corner of Lot 20, Block B, of said The Hills Phase III, said pin being in the Northeast R.O.W. of North Hills Drive; THENCE South 530 54' 04" West a distance of 60.10 feet to an iron pin found for corner at the most Northeasterly corner of Lot 1, Block E, of said The Hills Phase III, said pin being in the Southwest R.O.W. of said North Hills Drive; THENCE South 51005' 37" West, a distance of 511.48 feet to an iron pin found for corner at the most Northerly corner of Lot 6, Block E, of said The Hills Phase III, said pin being the most Westerly corner of Lot 5, Block E, of said The Hills Phase III; THENCE South 54054' 28" West a distance of 300.67 feet to an iron pin found for corner at the most Northerly corner of Lot 9, Block E, of The Hills Phase II as recorded in Envelope No. 364-D of the Lamar County Plat Records, said pin being the most Westerly corner of Lot 8, Block E, of said The Hills Phase III; THENCE South 510 05' 37" West a distance of 208.93 feet to an iron pin set for corner at the most Westerly corner of Lot 10, Block E, of said The Hills Phase II, said pin being in the Northeast R.O.W. of 33rd Street N.E.; THENCE North 440 12'46" West a distance of 58.31 feet to an iron pin set for corner in the Northeast R.O.W. of said 33rd Street N.E.; THENCE South 45047' 14" West a distance of 294.24 feet to an iron pin found for corner at the most Westerly corner of Lot 2, Block K, of said The Hills Phase II, said pin being in the Northeast line of Lot 8, Block K, of said The Hills Phase II; THENCE North 580 36'30" West a distance of 203.47 feet to an iron pin found for corner at the most Northerly corner of said Lot 8; THENCE South 71029'59" West a distance of 75.88 feet to an iron pin set for corner in the most Northerly line of said Lot 8; THENCE North 450 47' 14" East a distance of 363.20 feet to an iron pin set for corner; THENCE North 440 12'46" West a distance of 26.67 feet to an iron pin set for corner; THENCE around a curve to the right having a radius of 741.20 feet long, chord bears North 430 11' 45 " West a distance of 41.10 feet, an arc distance of 41.11 feet to an iron pin set for corner; THENCE North 510 05'37" East a distance of 1299.36 feet to an iron pin set for corner; THENCE South 89002'43" East a distance of 150.82 feet to an iron pin set for corner; THENCE South 640 08' 23" East a distance of 364.46 feet to the point of beginning and containing 13.635 acres of land, WHEREAS, said tract of land is contiguous and adjacent to the current city limits of the city of Paris, Texas, and is not more than one-half (112) mile in width; and, WHEREAS, said petition fully conformed with the requirements of Section 6 of the Charter of the City of Paris and Section 43.028 of the Local Government Code; and, WHEREAS, said petition was presented to the City Council on the 9th day of August, 2004; and, WHEREAS, after hearing such petition and the arguments for and against the same, the City Council adopted Resolution No. 2004-140 granting such petition to annex said territory into the city of Paris, Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. Section 3. That the City Clerk be, and she is hereby, directed to file with the County Clerk of Lamar County, Texas, a certified copy of this Ordinance accompanied by a copy of the Petition for Annexation. Section 4. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 5. That this ordinance shall become effective on October 1,2004.
