2004-043-ORD PROVIDING EXTENSION OF CERTAIN BOUNDARY LIMITS OF COP AND ANNEXATION OF 3.662 ACRES ORDINANCE NO. 2004-043 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 3.662 ACRES, MORE OR LESS, AS REQUESTED BY PETITION OF THE OWNERS THEREOF; GRANTING TO SAID TERRITORY AND TO ALL FUTURE INHABITANTS OF SAID PROPERTY ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID FUTURE INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF THE CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a petition of annexation has been duly signed and acknowledged by each and every person or corporation having an interest in the following described territory, to-wit: Being all that certain tract ofland situated in the City of Paris, Lamar County, Texas, a part of the Wesley Askins Survey, Abstract #7, conveyed to Wayne D. Brown by deed recorded in Volume 1240, Page 25, of the Lamar County Real Property Records and being further described as follows: Beginning at an iron pin found for comer in the North Line of Abby Lane, and in the center of a creek, said being the most Southerly Southwest comer of a tract of land conveyed to Bradley K. Drake and wife, Julie L. Drake by deed recorded in Volume 1110, Page 294, of the Lamar County Real Property Records; Thence South 45038'18" West along the South line of Brown tract and along the North line of Abby Lane a distance of 175.00 feet to an iron pin set for the Easterly Southeast comer of a tract of land conveyed to Michael S. Kennedy and wife, Jana F. Kennedy by deed recorded in Volume to07, Page 327, of the Lamar County Real Property Records; Thence North 44022' West along the Southwest line of Brown tract to the most Westerly comer of Brown tract and along the most Easterly line of said Kennedy in all a distance of 599.63 feet to an iron pin found in the South line of a tract of land conveyed to Wayne D. Brown by deed recorded in Volume 949, Page 296, of the Lamar County Real Property Records; Thence North 28037' East a distance of207.09 feet to an iron pin found for comer in the center of said creek; Thence Southeasterly generally with the center of said creek the following: South 750 13' 59" East a distance of 150.99 feet; North 50033' 20" East a distance of23.85 feet; South 73055' 55" East a distance of61.14 feet; North 880 13' 17" East a distance of38.34 feet; South 310 18' 27" East a distance of 38.21 feet; South 190 31' 47" East a distance of 21.07 feet; South 17042' 23" West a distance of 48.93 feet; South 4048' West a distance of 59.88 feet; South 300 27' 03" East a distance of53.16 feet; South 11023' 35" East a distance of 52.37 feet; South 430 51 '58" East a distance of 176.41 feet; South 140 37' 01" East a distance of 68.1 0 feet to the place of beginning containing 3.662 acres of land; and, WHEREAS, said tract ofland is contiguous and adjacent to the current city limits of the city of Paris, Texas, and is not more than one-half (112) mile in width; and, WHEREAS, said petition fully conformed with the requirements of Section 6 of the Charter of the City of Paris and Section 43.028 of the Local Government Code; and, WHEREAS, said petition was presented to the City Council on the 12th day of July, 2004; and, WHEREAS, after hearing such petition and the arguments for and against the same, the City Council adopted Resolution No. 2004-123 granting such petition to annex said territory into the city of Paris, Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the following described property, to-wit: Being all that certain tract ofland situated in the City of Paris, Lamar County, Texas, a part of the Wesley Askins Survey, Abstract #7, conveyed to Wayne D. Section 3. That the City Clerk be, and she is hereby, directed to file with the County Clerk of Lamar County, Texas, a certified copy of this Ordinance accompanied by a copy of the Petition for Annexation. Section 4. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 5. That this ordinance shall become effective on October 1,2004.
