2001-075-RES APPROVING/AUTHORIZING CITY MANAGER TO EXECUTE AND CITY CLERK TO ATTEST TO CONTRACT BETWEEN COP AND FAMILY HAVEN CRISIS AND RESOURCE CTR RESOLUTION NO. 2001-075 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST TO A CONTRACT BETWEEN THE CITY OF PARIS AND FAMILY HAVEN CRISIS AND RESOURCE CENTER, INC., TO PROVIDE SERVICES UNDER A CRIMINAL JUSTICE DIVISION GRANT TO THE CITY OF PARIS TO PREVENT AND PROSECUTE VIOLENT CRIME AGAINST WOMEN; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Office of the Governor, Criminal Justice Division, has issued a grant award to the City of Paris entitled "Violent Crimes Against Women Unit" Grant, No. WF-99-V30-13420- 03, for the period beginning June 1,2001, and ending May 31, 2002, in the total amount of $78,594.00, requiring a matching contribution of$26,986.00 in the form of in-kind services on the part ofthe City of Paris; and, WHEREAS, the City Council did heretofore, on the 11th day of June, 2001, in Resolution No. 2001-074, authorize the acceptance of said grant; and, WHEREAS, as part of the services to be provided under said grant, the City of Paris has identified the need to contract with Family Haven Crisis and Resource Center, Inc., to act as a service provider in aid ofthe aforesaid Crirninal Justice Division Grant No. WF-99- V30-13420-03, to provide services as specified in said proposed contract to women who are the victims of violent crime; and, WHEREAS, the City Council desires to approve and authorize the City Manager to enter into the aforesaid contract between the City of Paris and Family Haven Crisis and Resource Center, Inc. in furtherance of the grant purposes as set out in said agreement; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the City Manager be, and is hereby, authorized to execute, and the City Clerk to attest to, a contract between the City of Paris and Family Haven Crisis and Resource Center, Inc., a copy of which said contract is attached hereto as Exhibit A and for all purposes incorporated herein, to retain Family Haven Crisis and Resource Center, Inc. as a service provider in aid of Criminal Justice Division Grant No. WF-99- V30-13420-03 in working with representatives of the City of Paris Police Department to provide services to assist in the reduction and prosecution of violent crimes against women and to provide other services as set out in said agreement. STATE OF TEXAS ) ) COUNTY OF LAMAR ) 1. This contract is by and between the CITY OF PARIS, PARIS, TEXAS, Grantee, and FAMILY HAVEN CRISIS AND RESOURCE CENTER, INC., Service Provider, and in aidofCJD Grant No. WF-99-V30-13420-03, titled; Violent Crimes Against Women Unit. It is understood by all parties that payment obligations created by this contract are conditioned upon the availability of State or Federal funds appropriated or allocated for the payment of such obligations. The term of this contract commenced on June 1,2001, and shall end on May 31, 2002, unless extended or terminated as otherwise provided for in this contract. 2. The City of Paris Police Department is responsible for closely monitoring Family Haven and the exercise of reasonable care to enforce all terms and conditions of the grant. Family Haven agrees to fully cooperate in the monitoring process. 3. Requirements of the Uniform Grant and Contract Management Standards (UGCMS) promulgated pursuant to Section 783 of the Government Code are adopted by reference as part of this contract, including the contract provision as in Section 36, Common Rule of OMB, of the above standards. The City of Paris shall assist Family Haven to establish a set of records that comply with the requirements of this grant and periodically inspect such records to ensure that they are properly kept. Records shall be retained for at least THREE (3) YEARS following the closure of the most recent audit report and until any outstanding litigation, audit, or claim has been resolved. Records are subject to inspection by CJD, or any state or federal agency authorized to inspect the same. 4. Family Haven will furnish a full time liaison to work with a full time police investigator to assist in the reduction and prosecution of violent crimes against women. The Family Haven Liaison will: A. Coordinate daily with Paris Police Crimes Against Women officer to receive new referrals and track follow-up on open cases. B. Coordinate all services to victims of violent crime within the city of Paris, which includes counseling, accompaniment, transportation, and advocacy with the criminal justice system and the Paris Police Department. EXHIBIT A C. Assist with all phases of protective orders and other legal matters relating to Family Haven clients within the city of Paris. D. Coordinate with the Paris Police Department on needs assessment and cross training for law enforcement and Family Haven staff and volunteers. E. Act as primary liaison with all criminal justice offices concerning victims ofviolent crime within the city of Paris. F. Be on-call as needed; conduct individual counseling with victims, including crisis intervention, goal setting, and referral to other social service agencies and the criminal justice system, as needed. These services include individual, group, and telephone counseling sessions, as well as providing assistance in obtaining Victims Compensation; conducting or arranging for counseling of other family members as requested; completing and maintaining all required forms and case notes relating to Family Haven clients. G. Assist with public education and public relation efforts of Family Haven within the city of Paris. H. The goal of the Crimes Against Women Unit is to reduce total crimes against women/domestic violence by ten percent (10%) during the grant period. A quarterly review of the status of the goals will be held by Family Haven and the Paris Police Department. 5. Payment for the above to Family Haven will not exceed $29,090.00 annually and will be on a reimbursement basis payable in a quarterly amount as show below: A. June 2001, July 200 I, and August 200 I to be paid on September 1,2001 ($7,272.50) B. September 2001, October 200 1, andNovember2001 to be paid on December 1, 2001 ($7,272.50) C. December 2001, January 2002, and February 2002 to be paid on March 1,2002 ($7,272.50) D. March 2002, April 2002, and May 2002 to be paid on June 1,2002 ($7,272.50) 6. Billing for the above will be provided in the same manner as it would be provided for customary purchases in the absence of a grant and shall consist of a statement of the service or other items provided and the basis for the billing rate. Family Haven will submit to the City of Paris an itemized bill for services rendered, travel expenses, and supply costs under the grant agreement. 7. In the event of a default by Family Haven, the City of Paris may cancel or suspend the contract and Family Haven shall be entitled to recover for all services provided or materials delivered prior to the cancellation date (or unused materials may be returned) and shall repay any funds advanced for services not yet rendered. 8. All licenses, legal certifications, or inspections required for the services, facilities, equipment, or materials, and all applicable state and federal laws and local ordinances must be complied with by Family Haven. Failure to comply with this requirement shall be treated as a default. 9. This contract shall automatically terminate on the grant expiration date or any extension date thereof granted by CJD or upon termination of the underlying grant by CJD.
