2001-004-RES APPROVING EXTENSION OF TIME OR COMPLETION OF LAKE CROOK MASTER PLAN STUDY RESOLUTION NO. 2001-004 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AN EXTENSION OF TIME FOR COMPLETION OF A LAKE CROOK MASTER PLAN STUDY AND SUBMITTAL OF SAID STUDY TO THE CITY OF PARIS BY C. T. BRANNON CORPORATION; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris by adoption of Resolution No. 2000-083 on June 12, 2000, has previously accepted a proposal for professional services and awarded a professional services contract to C. T. Brannon Corporation for the development of a Lake Crook Master Plan; and, WHEREAS, as provided in the aforesaid original agreement, it was anticipated the report and master plan would be completed following public hearings conducted by the City Council to seek public input on the possible uses for the aforesaid Lake Crook property; and, WHEREAS, the City Council desires to extend the date for completion of the aforesaid master plan to accommodate public hearings as deemed appropriate by the City Council; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That Addendum Number One to the existing Professional Services Contract between the City of Paris and C. T. Brannon Corporation for the performance of a Master Plan Study for the use of Lake Crook, attached hereto as Exhibit A and for all purposes incorporated herein, be, and the same is hereby, in all things approved. Section 3. That this resolution shall be effective from and after its date of passage. PASSED AND APPROVED this 8th day of January, 2001. T. BRANNON CORPORATION AND THE CITY OF PARIS. PARIS. TEXAS WHEREAS, by adoption of Resolution No. 2000-083 on June 12, 2000, the City Council of the City of Paris, Texas, approved and accepted a proposal of the Brannon Corporation for professional services for the development of a Lake Crook Master Plan and awarded a professional services contract to said corporation for the purposes of development of a master plan for Lake Crook; and, WHEREAS, SECTION 1. B. of said professional services contract provided for completion of the study and preparation of a report and recommendations by or before January 15, 2001, conditioned upon and subject to an extension depending on the number and time of public hearings scheduled to solicit public input as to the potential uses of said property; and, WHEREAS, the City of Paris, designated as "Owner" in the original contract, and the C. T. Brannon Corporation, designated as "Engineer" in the original contract, agree that the time frame for completion of the study should be extended, dependent upon the number and time of subsequent public hearings conducted by the City of Paris to solicit further input from the general public as to the uses of said property; NOW, THEREFORE, FOR AND IN CONSIDERATION OF THESE PREMISES, the City of Paris as Owner and the C. T. Brannon Corporation as Engineer, agree as follows: Section 1. That SECTION LB. of the original professional services contract between Owner and Engineer as referenced herein, shall be and is hereby, amended to provide that Engineer shall complete the Master Plan and present a final report to the City of Paris, as outlined in the original agreement, no later than forty-five (45) days following the last public hearing conducted by the City of Paris soliciting input from the general public as to the proposed uses of the Lake Crook property. Section 2. That all other terms and provisions of the original agreement, not in conflict with the terms and provisions of this agreement, shall remain in full force and effect. Section 3. That this extension oftime to complete and present the final report shall not incur additional cost to the City of Paris, subject to the standard engineering fee and other fees previously agreed to in the original agreement. Section 4. That this agreement shall become effective from and after its date of execution by the parties hereto.
