RESOLUTION NO. 2001-007
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, DECLARING AN EMERGENCY FOR PURPOSES OF
PURCHASES PURSUANT TO SECTION 252.022 OF THE LOCAL
GOVERNMENT CODE REGARDING THE LOCAL DISASTER SO
DECLARED BY THE CITY OF PARIS IN PRIOR RESOLUTION NO. 2001.
001; PROVIDING FOR IMPLEMENTATION OF EMERGENCY
PROCUREMENT PROCEDURES; AUTHORIZING THE CITY MANAGER
TO UNDERTAKE NECESSARY PROCUREMENT ACTIONS; MAKING
OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND
DECLARING AN EFFECTIVE DA TE.
WHEREAS, the city of Paris, Texas, on the 25th day of December, 2000, and continuing
thereafter, suffered widespread and severe damage, injury, and loss ofIife or property resulting from
extreme winter conditions and ice storms; and,
WHEREAS, the City Council of the City of Paris has previously adopted Resolution No.
2001-001 on January 8, 2001, declaring a local disaster in the city of Paris pursuant to Section
418.108 of the Disaster Act of 1975 as a consequence of said severe winter conditions and ice
storms; and,
WHEREAS, as a result of said declaration, the City Council of the City of Paris has
determined that extraordinary measures must be taken to alleviate the suffering of people and to
protect or rehabilitate property; and,
WHEREAS, the City Council finds and determines that the City has applied for emergency
assistance through appropriate State and Federal agencies, and has been advised that, in order to
qualify for ninety percent (90%) funding on debris removal within the city of Paris, the City must
complete the process of contracting for such debris removal services and compete the actual process
of debris removal by or before March 9, 2001; and,
WHEREAS, because of the severe damage and the emergency need to expeditiously contract
for and remove debris and undertake other activities to be performed by contractors within the city
as a consequence of the aforesaid extreme winter conditions and ice storms, and to qualify for the
maximum funding to assist the City in such emergency actions, the City Council finds and
determines that it is necessary to declare an emergency pursuant to Section 252.022 of the Local
Government Code regarding procurements; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all things
approved.
Section 2. That the City Council finds and determines that the aforesaid severe winter
conditions and ice storms constitute a public calamity requiring the immediate appropriation of
money in support of procurements to relieve the necessity of the municipality's residents or to
preserve the property of the municipality.
Section 3. That the City Council find and determines that the aforesaid severe winter
conditions and ice storms justify procurements necessary to preserve or protect the public health or
safety of the municipality's residents.
Section 4. That the City Council finds and determines that because of the extreme winter
conditions and ice storms procurements are necessary because of unforseen damage to public
machinery, equipment, or other properties.
Section 5. That the aforesaid severe winter conditions and ice storms constitute an
emergency and urgent public necessity justifying utilization of emergency procurement procedures
designed to allow the City to contract as soon as possible, but in full compliance with State and
Federal regulations related to emergency procurements in support of disasterrelief, and still allowing 0
for informal competition among contractors and bidders.
Section 6. That the City Manager be, and he is hereby, authorized to undertake any and all
measures reasonably necessary to utilize force account and City staff resources, or to contract with
qualified contractors for debris removal and other emergency actions necessitated by the severe
winter conditions and ice storms, subject to the terms and provisions of this resolution requiring
compliance with all applicable State and Federal regulations regarding emergency procurement
during disaster conditions, and furtherto pursue informal competition among bidders and contractors
for such services.
Section 7. That this resolution shall take effect immediately from and after its passage.
