2001-008-RES GRANTING PETITION FOR ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 14.563 (CALLED 15.231) ACRES RESOLUTION NO. 2001-008 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, GRANTING A PETITION FOR ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 14.563 (CALLED 15.231) ACRES, MORE OR LESS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DA TE. WHEREAS, the City Council of the City of Paris is in receipt of a Petition for Annexation for the annexation of certain territory consisting of 14.563 (called 15.23) acres, more or less; and, WHEREAS, the City Council finds and determines that the petition was signed by all of the qualified voters residing or owning property in the area requested to be annexed in compliance with Section 6 of the Charter of the City of Paris; and, WHEREAS, the City Council further finds and determines that the property requested to be annexed into the city of Paris is one-half mile or less in width, is contiguous to the existing city limit line, and is vacant and without residents or has fewer than three (3) qualified voters who reside on the property, in compliance with Section 43.028 of the Local Government Code; and, WHEREAS, the City Council further finds and determines that the petition is in proper form and in all things complies with the requirements of Section 43.028(c) of the Local Government Code and the applicable provisions of the City Charter; and, WHEREAS, the City Council further finds and determines that, in accordance with Section 43 .028( d) of the Local Government Code, a hearing on the petition was had before the City Council after the 5th day but on or before the 30th day after the date the petition was filed with the City Clerk in order to hear the petition and the arguments for and against the annexation; and, WHEREAS, after hearing such petition and the arguments for and against the same, the City Council deems it appropriate to grant such petition to annex said territory into the city of Paris, Texas; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the Petition for Annexation, a copy of which is attached hereto and for all purposes incorporated herein, for the annexation of the following described property, to wit: Being all that certain tract of land situated in the City of Paris, Lamar County, Texas, a part of the Wesley Askins Survey, Abstract No.7, a part of the 100.0 acre tract of land conveyed to D. Wayne Brown, et ai, by deed recorded in Volume 939, Page 31, Lamar County Real Property Records, and a part ofthe 121.76 acre tract of land conveyed D. Wayne Brown, et ai, by deed recorded in Volume 949, Page 296, Lamar County Real Property Records, and being further described as follows: BEGINNING at a point in the existing city limit line of the city of Paris as described in Tract 5 of Ordinance No. 97-059, passed and adopted by the City Council of the City of Paris on December 15,1997, said point being a distance of500 feet from the centerline of F.M. Highway 195 and being located in the northeast boundary line of the North Hills Road, said road being a part of the 15.213 acre tract of land described on the Final Plat of The Hills No.1, filed with the County Clerk of Lamar County on January 18, 2001; THENCE southwesterly along the existing city limit line of the city of Paris as described in said Ordinance No. 97-059 a distance of approximately 60 feet to a point in the southwest boundary line of said North Hills Road; THENCE North 320 47' 00" West to an iron pin set for corner, said point being a distance of approximately 580.84 feet from the northwest line of P.M. Highway 195; THENCE South 510 05' 37" West a distance of 828.56 feet to an iron pin found for corner; THENCE South 490 10' 40" West a distance of 161.16 feet to an iron pin set for corner; THENCE North 560 53' 12" West a distance of 256.24 feet to an iron pin set for corner; THENCE North 17033' 30" East a distance of 241.89 feet to an iron pin set for corner in a curve to the left having a radius of 384.25 feet; THENCE southeasterly with a portion of said curve having a long chord bearing South 720 32' East a distance of 2.36 feet, an arc distance of 2.36 feet to an iron pin set for corner; THENCE North 51005' 37" East a distance of 187.25 feet to an iron pin set for corner; THENCE North 560 48' 15" East a distance of201.0feetto an iron pin set for corner; THENCE North 51005' 37" East a distance of 516.09 feet to an iron pin set for corner; THENCE North 550 43' 26" East a distance of 60.02 feet to an iron pin set for corner; THENCE North 580 32' 57" East a distance of 780.72 feet to an iron pin set for corner in the east line of said 100 acre Brown tract and the west line of a tract conveyed to J. H. Darnell by deed recorded in Volume 341, Page 273, Lamar County Deed Records; THENCE South 000 34' 23" East with said common line a distance of 411.82 feet to an iron pin found for corner; THENCE South 580 32' 57" West a distance of 561.15 feet to an iron pin found for corner; THENCE South 320 47' 00" East along the northeast boundary line of said North Hills Road to the place of beginning in the existing city limit line of the city of Paris as described in said Ordinance No. 97 -059, containing approximately 14.563 acres ofland, more or less. Said tract described herein being known as The Hills No. 1 as shown on the Final Plat of said subdivision filed with the County Clerk of Lamar County on January 18, 2001. be, and the same is hereby, granted.
