RESOLUTION NO. 7001-071
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, GRANTING A PETITION FOR ANNEXATION OF
CERTAIN TERRITORY CONSISTING OF 48.42 ACRES, MORE OR LESS;
MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE
SUBJECT; AND PROVIDING AN EFFECTIVE DA TE.
WHEREAS, the City Council of the City of Paris is in receipt of a Petition for Annexation
for the annexation of certain territory consisting of 48.42 acres, more or less; and,
WHEREAS, the City Council finds and determines that the petition was signed by all of the
qualified voters residing or owning property in the area requested to be annexed in compliance with
Section 6 of the Charter of the City of Paris; and,
WHEREAS, the City Council further finds and determines that the property requested to be
annexed into the city of Paris is one-half mile or less in width, is contiguous to the existing city limit
line, and is vacant and without residents or has fewer than three (3) qualified voters who reside on
the property, in compliance with Section 43,028 ofthe Local Government Code; and,
WHEREAS, the City Council further finds and determines that the petition is in proper form
and in all things complies with the requirements of Section 43.028(c) of the Local Government Code
and the applicable provisions of the City Charter; and,
WHEREAS, the City Council further finds and determines that, in accordance with Section
43.028(d) of the Local Government Code, a hearing on the petition was had before the City Council
after the 5th day but on or before the 30th day after the date the petition was filed with the City Clerk
in order to hear the petition and the arguments for and against the annexation; and,
WHEREAS, after hearing such petition and the arguments for and against the same, the City
Council deems it appropriate to grant such petition to annex said territory into the city of Paris,
Texas; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section I. That the findings set out in the preamble to this resolution are hereby in all things
approved.
Section 2. That the Petition for Annexation, a copy of which is attached hereto and for all
purposes incorporated herein, for the annexation of the following described property, to wit:
Being all that certain tract of land located 4.5 miles 480 East of the City of
Paris, Lamar County, Texas; being a part of a 128.76 acre tract; being a part of the
Wesley Askins Survey, Abstract No, 7; being a part of a called 138.5 acre tract of
land conveyed to C, L. Darnell by deed dated February 5, 1984, and recorded in
Volume 667, Page 682 of the Deed Records of Lamar County, Texas; and being more
particularly described as follows:
BEGINNING at a point in the existing city limit line of the city of Paris as
described in Tract 5 of Ordinance No. 97-059, passed and adopted by the City
Council of the City of Paris on December 15,1997, said point being a distance of 500
feet from the centerline ofF.M. Highway 195 and being located in an existing fence
line found in the west line of the said 128.76 acre tract of land and the east line of a
3 acre tract of land conveyed to John L. Simmons and wife, Brenda C. Simmons, on
May 10, 1993, and recorded in Volume 359, Page 10 of the Lamar County Real
Property Records, and the east line of a 1.52 acre tract of land conveyed to John L.
Simmons and wife, Brenda C, Simmons, on May 10,1993, and recorded in Volume
359, Page 10 of the Lamar County Real Property Records;
THENCE North 30 32' 48" West with said existing fence line and the east line
of said 3 acre tract of land and the east line of said 1,52 acre tract of land a distance
of 128.70 feet, more or less, to a found iron rod;
THENCE North 880 59' 35" West with the South line of said 128.76 acre tract
of land and the north line of the said 1.52 acre tract of land a distance of 553.34 feet
to a found iron rod at the northwest comer of the said 1.52 acre tract of land;
THENCE North 10 10' 07" West with a fence a distance of 96.46 feet to a
found iron rod;
THENCE South 890 15' 49" West with a fence a distance of 633.26 feet to a
found iron rod at the southwest corner of the said 128,76 acre tract of land;
THENCE North 60 40' 54" West with a fence a distance of 2.50 feet to a
found iron rod;
THENCE North 00 45' 03" West with a fence a distance of 1194.33 feet to a
set iron rod;
THENCE North 880 57' 03" East with a fence a distance of 83.63 feet to a
found iron rod;
THENCE North 00 35' 52" West a distance of 141.12 feet to a point for
comer;
THENCE East a distance of 385.5 feet to a point for comer;
THENCE North 00 35' West a distance of 140.0 feet to a point for comer;
THENCE East a distance of 1050.0 feet to a point for comer;
THENCE South 460 14' East a distance of 207,88 feet to an iron pin found
for comer;
THENCE South a distance of 876,40 feet to an iron pin found for corner;
THENCE South 60 00' 57" West to a point in the existing Paris city limit line
as described in Tract 5 of said Ordinance No. 97-059, said point being a distance of
500 feet from the centerline of F. M. 195;
THENCE southwesterly along the existing city limit line, being at all times
a distance of 500 feet from the centerline ofF. M, 195, to the point of beginning, and
containing 48,42 acres, more or less,
be, and the same is hereby, granted.
Section 3. That this resolution shall be effective from and after its date of passage.
