RESOLUTION NO. 2001-063
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, ACCEPTING THE DONATION OF ONE PORTABLE
BUILDING FROM THE PARIS INDEPENDENT SCHOOL DISTRICT FOR
USE BY THE PARIS POLICE DEPARTMENT; AUTHORIZING THE
EXECUTION OF AN INTERLOCAL AGREEMENT WITH THE PARIS
INDEPENDENT SCHOOL DISTRICT FOR THE ACCEPTANCE OF SAID
PORT ABLE BUILDING; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Paris Independent School District has declared as surplus one (I) portable
building and has offered to donate the same to the Paris Police Department to be used to expand the
Police Department facilities at 811 Bonham Street; and,
WHEREAS, the generosity of the Paris Independent School District is appreciated, and it
is deemed to be in the best interests of the citizens of Paris that such donation be accepted; and,
WHEREAS, the form of the Interlocal Agreement with the Paris Independent School District
for the acceptance by the City of Paris of said portable building, attached hereto as Exhibit A, should
in all things be approved, and the Mayor should be authorized to execute the same; NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all things
approved.
Section 2. That the donation by the Paris Independent School District of one (I) surplus
portable building to be used to expand the Paris Police Department facilities at 811 Bonham Street
be, and the same is hereby, accepted.
Section 3. That the form of the Interlocal Agreement with the Paris Independent School
District for the acceptance by the City of Paris of said portable building, attached hereto as Exhibit
A, be, and the same is hereby, approved.
Section 4. That the Mayor be, and he is hereby, authorized and directed to execute, on behalf
of the City of Paris, the Interlocal Agreement, under the terms and conditions and in the form shown
in Exhibit A attached hereto.
Section 5. That this resolution shall be effective from and after its date of passage.

INTERLOCAL AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF LAMAR
WHEREAS, Chapter 791 of the Local Government Code authorizes local governments,
including municipalities and independent school districts, to enter into interlocal agreements to
perform governmental functions and services; and,
WHEREAS, the purpose of Chapter 791 and the contracts authorized therein is to increase
the efficiency and effectiveness of local governments by authorizing them to enter into said
contracts; and,
WHEREAS, the City of Paris and the Paris Independent School District desire to enter
into an interlocal agreement whereby the Paris Independent School District will donate to the City
of Paris one surplus portable building with the understanding that such building shall be located
at the City's Police Station complex and shall be utilized for Police Department purposes to the
benefit of the Paris Independent School District and to the citizens of the City of Paris; and,
WHEREAS, the City of Paris desires to gratefully accept said donation and to utilize said
surplus portable building as agreed to by the parties;
WHEREFORE, premises considered, the CITY OF PARIS, PARIS, TEXAS, a
municipal corporation, acting by and through its Mayor, duly authorized, hereinafter called
CITY, and the PARIS INDEPENDENT SCHOOL DISTRICT BOARD OF EDUCATION,
acting by and through its President, duly authorized, hereinafter called PISD, do hereby contract
and agree as follows:
1. PISD agrees to donate and CITY agrees to accept one (I) portable building which
is currently located on a PISD campus.
2. CITY agrees to move the one (1) portable building to 811 Bonham Street to be
used for expanding the Police Department facilities.
3. CITY agrees to repair fences and generally restore the school's property to a
similar condition as existed prior to the moving of the building.
EXHIBIT A
4. The parties hereto covenant and agree that the actions authorized herein constitute
governmental functions or services that each party to the contract is authorized to
perform individually.
5. The parties hereto covenant and agree that this contract shall be authorized by the
governing body of each party to the contract.
6. The parties hereto hereby agree that each party paying for the performance of
governmental functions or services hereunder shall make those payments from
current revenues available to the paying party.
7. The parties to the agreernent covenant and agree that to the extent any compensation,
if any, shall be due any performing party hereunder, such compensation shall be
deemed as fairly compensating the performing party for the services or functions
performed hereunder.
8. The term of this contract shall be from the date of the last signature of execution
hereof and shall end the date the parties hereto perform the services authorized
hereunder.
EXECUTED this 14th day of May, 2001, by the City of Paris and this _ day of
200 I, by the Paris Independent School District, in duplicate originals, effective the date of the last
signature hereto.
