2002-153-RES AWARD BID FOR PERFORMING ALL WORK REQUIRED FOR GROUNDS MAINTENANCE ON SPECIFIED COP PRKS AND FACILITIES RESOLUTION NO. 2002-153 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AWARDING THE BID FOR FURNISHING LABOR, MATERIALS, AND EQillPMENT AND FOR PERFORMING ALL WORK REQillRED FOR GROUNDS MAINTENANCE ON SPECIFIED CITY OF PARIS PARKS AND FACILITIES; AUTHORIZING THE EXECUTION OF THE AGREEMENT FOR GROUNDS MAINTENANCE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris did heretofore, on the 12th day of August, 2002, in Resolution No.2002-132, authorize the advertisement for bids for furnishing labor, materials, and equipment and for performing all work required for grounds maintenance on specified City of Paris parks and facilities, which bids were received until 3:00 p.m., Tuesday, September 3,2002; and, WHEREAS, the best bid for performing such work was made by Jack Ray Barton, and he should be awarded the bid for the same; and, WHEREAS, the form of the Agreement for Grounds Maintenance, attached hereto as Exhibit A, should, in all things, be approved, and the Mayor of the City of Paris should be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the bid by Jack Ray Barton for furnishing labor, materials, ~nd equipment and for performing all work required for grounds maintenance on specified City of Paris parks and facilities, in the amount of $32,750.00, be, and the same is hereby, accepted and let. Section 3. That the form of the Agreement for Grounds Maintenance between the City of Paris and Jack Ray Barton, attached hereto as Exhibit A, be, and the same is hereby, approved. Section 4. That the Mayor of the City of Paris be, and he is hereby, authorized and directed to execute, on behalf of the City of Paris, the Agreement for Grounds Maintenance with Jack Ray Barton for a term of five (5) years, beginning on October 1, 2002, and ending on September 30, 2007, upon the terms and conditions and in the form shown in Exhibit A, attached hereto. Pfiester, duly authorized, hereinafter called CITY, and JACK RAY BARTON, hereinafter called CONTRACTOR, do hereby contract and agree as follows: 1. CONTRACTOR agrees to provide grounds maintenance in accordance with the specifications attached hereto as Exhibit A, together with those which may be issued as supplements thereof. 2. That, in consideration of the faithful compliance with the terms and conditions of this Agreement, the CITY shall pay to the CONTRACTOR, at the times and in the manner provided in said specification, the total sum of Thirty-two Thousand Seven Hundred Fifty and no/loo Dollars ($32,750.00), which sum is subject, however, to increase or decrease in such proportion as the quantities named in said proposal are so changed. 3. That this contract shall be for a term of five (5) years, commencing on October 1, 2002, and ending on September 30, 2007. 4. That the contract documents which are hereby made a part of this Agreement by the actual attachment or by this reference thereto are as follows: Exhibit A Exhibit B Exhibit C Specifications Invitation to Bid Bid Form submitted by CONTRACTOR 5. That CONTRACTOR must, at all times during the term of this Agreement, keep and maintain in full force and effect a policy or policies of insurance, providing at least $250,000.00 per person and $500,000.00 for any single occurrence for bodily injury or death and $100,000.00 for any single occurrence for injury to or destruction of property, indemnifying all persons for any and all damages, personal injuries, or property damages sustained as the result of the negligence of CONTRACTOR, its agents, servants, or employees, and shall pay all premiums due thereon when due. It is expressly provided that such insurance policy or policies shall and must be written and issued by a reputable insurance company or companies, with CITY as an additional insured effective while CONTRACTOR is on property owned by CITY, subject to approval by the City Attorney of the City of Paris, and CONTRACTOR or its insurance carrier or carriers shall deliver Page 1 of 3 EXHIBIT Pi a copy of any such policies to the City Clerk of the City of Paris, 150 1st Street S.E., Paris, Texas 75460, or furnish to said City Clerk a current letter or certificate from such company or companies, evidencing the fact that such insurance is in full force and effect at all times during this Agreement, and any extensions hereof, and specifically noting thereon that CITY is an additional insured while CONTRACTOR is on property owned by CITY. All such policies shall be written so that the CITY will be notified of cancellation or of any restrictive amendment of the policies at least thirty (30) days prior to the effective date of such cancellation or amendment. Notice shall be by certified mail, return receipt requested, addressed to the CITY at the following address: City Clerk, City of Paris, P. O. Box 9037, Paris, Texas 75461-9037. 6. CITY and CONTRACTOR have the right to unilaterally terminate this agreement at any time upon sixty (60) days written notice to the other party. CITY retains the right to terminate this agreement upon thirty (30) days written notice to CONTRACTOR for failure to perform the services required hereunder. During the growing season, all areas will have maintenance (mowing) performed a minimum of one (1) time per week, or as needed basis determined by the Parks Superintendent. 2. Contractor is responsible for the following: Mow all existing grass or turf on property; weed-eat around all fence lines, trees, tables, pavilions, playground equipment or other applicable structures on property; edge all applicable concrete including curb and sidewalks; remove all clippings; blow dust, clippings and leaves off hard surface areas; trim applicable hedges and shrubs on property; remove weeds, debris and leaves from any applicable flower beds. 3. The City of Paris will be responsible for fertilizing listed properties and pruning any existing trees. 4. Bidders must have a minimum of two (2) years experience in commercial grounds maintenance operations. 5. Bidders should include a list of references for whom they have performed grounds maintenance during the past two (2) years. 6. Bidders must have current liability and workman's compensation insurance. 7. Bidders must use the attached bid form. 8. Bidders must currently own or operate landscape company at the time of bid and equipment capable of performing the work required. 9. Upon bid award, the total annual payment shall be divided by 12 months and paid to the contractor on a monthly basis. 10. Bidders are encouraged to contact the Superintendent of Parks or the Director of Public Works at 784-9289 for assistance determining property boundaries. 11. The City of Paris reserves the right to reject any or all bids, to waive any informality in bidding, and to award the bid as may be advantageous to the City. Bids will be received until 3:00 P.M. on Tuesday, September 3,2002, at which time all bids will be publicly opened at the City of Paris City Hall Building, 135 pI SE, Paris, Texas, read aloud, tabulated and referred to the City Council for consideration. All bids must be submitted on City of Paris bid form(s). Information, specifications and bid forms may be obtained at the Office of the City Manager, City Hall, 135 I sl SE, Paris, Texas 75460. Those submitting bids are notified of city exemption from otherwise applicable sales and excise taxes. The City of Paris reserves the right to reject any and all bids, to waive any informality in bidding, and to award bids as may be advantageous to the City.
