A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, RATIFYING AN APPLICATION FOR A U.S. FIRE
ADMINISTRATION 2003 ASSISTANCE TO FIREFIGHTERS GRANT
FROM THE FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA)
TO PURCHASE FIFTY-FOUR (54) SELF-CONTAINED BREATIDNG
APPARATUSES (SCBA) AND SIXTY-FOUR (64) SPARE CYLINDERS;
AUTHORIZING THE EXPENDITURE OF FUNDS; ACCEPTING SAID
GRANT AWARD UPON NOTICE THEREOF; AUTHORIZING THE
EXECUTION OF ANY AND ALL DOCUMENTS NECESSARY FOR
ACCEPTANCE AND IMPLEMENTATION OF SAID GRANT UPON
NOTICE THEREOF; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the Federal Emergency Management Agency provides funding for the U.S.
Fire Administration 2003 Assistance to Firefighters Grant Program; and,
WHEREAS, the City Council of the City of Paris is desirous of processing a grant
application for the Assistance to Firefighters Program, at a total cost of $271,978.00, with
$244,781. 00 to be provided by grant and $27,197.00 to be provided by the City of Paris in the
form of local matching funds to purchase fifty-four (54) self-contained breathing apparatuses
(SCBA) and sixty-four (64) spare cylinders; and,
WHEREAS, the City Council is desirous of approving a further condition of said grant,
the same being in the form of an in-kind match whereby the City of Paris Fire Department would
be required to donate its current fifty (50) self-contained breathing apparatus (SCBA) to the
nineteen (19) volunteer fire departments scattered throughout Lamar County; and,
WHEREAS, the deadline for actual fIling of the grant application occurred prior to the
date of the next regular City Council meeting, and a timely application has been filed, subject to
City Council ratification; and,
WHEREAS, the City Council desires to authorize the Mayor, City Manager, Fire Chief,
and other appropriate City staff to accept and implement said grant (if same is received) without
further action of City Council; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all things
approved.

Section 2. That the fIling of an application to the Federal Emergency Management Agency
for a U.S. Fire Administration 2003 Assistance to Firefighters Grant in the amount of
$244,781.00, being approximately 90% of the estimated cost of the Assistance to Firefighters
Program, with the City of Paris providing $27,197.00 in funds to purchase fifty-four (54) self-
contained breathing apparatuses (SCBA) and sixty-four (64) spare cylinders, attached here as
Exhibit A, is hereby in all things ratified.
Section 3. That the Fire Chief of the City of Paris be, and he is hereby authorized, upon
formal notification and receipt of grant funds and subsequent purchase of new equipment, to
donate the City's fifty (50) current self-contained breathing apparatuses (SCBA) to the Lamar
County Volunteer Fire Association on behalf of the nineteen (19) volunteer fire departments
scattered throughout Lamar County, said donation being a condition of and a form of in-kind
match for the City of Paris to receive said grant.
Section 4. That the City Manager be, and he is hereby, appointed as the Authorized
Official of said project.
Section 5. That the Fire Chief be, and he is hereby, appointed as Project Director and is
hereby authorized to execute and deliver, on behalf of the City of Paris, all reports,
communications, assurances, and documents necessary for the completion of said project.
Section 6. That the Director of Finance be, and he is hereby, authorized and directed to
serve as the Financial Officer for said project and to receive and distribute funds for purposes of
the Assistance to Firefighters Program.
Section 7. That the Mayor, City Manager, Fire Chief, and the Finance Director be and
they are hereby authorized and directed to execute, on behalf of the City of Paris, any and all
documents necessary for acceptance and implementation of said grant upon notice of award thereof
by the Federal Emergency Management Agency, under the terms and conditions and in the forms
approved by the City Attorney, and to proceed with use of said funds upon receipt thereof for the
purposes stated herein and in accordance with the grant conditions.
Section 8. That this resolution shall be effective from and after its date of passage.

scored according to the priorities established by FEMA for the Assistance to Firefighters Grant Program. Once the initial
scoring is complete, the applications that are within the competitive range will be sent to panels for evaluation. The evaluation
panels will review applications in April and May. The panelists will score the applications according to financial need and cost
benefit criteria. Those applications th?~ are recommended for award will then be sent to FEMA for a final review. Grant awards
will begin in May and continue until all funds are awarded. Please remember that this is a competitive grant program.
Therefore, all applicants may not be awarded a grant. We plan to notify all applicants of the final disposition of their
applications by December 31,2003.

Grant Requirements
Those applicants who are awarded a grant must"satisfy both legal and regulatory requirements of the Assistance
to Firefighters Grant Program. Some of the major requirements are:
1. Grantees must share in the cost of the grant activities. When a fire department submits their program narrative
and budget information, the total project cost should include the federal portion and the fire department's
match. The required match percentage is based on the population served. The matching requirement for a fire
department whose population is less than 50,000 is 1 0 percent. The matching requirement for a fire
department whose population served is 50,000 or more is 30 percent. You should provide adequate
information on the source of thE: matching funds and the match must be a cash match.
2. Grantees must report to an incident reporting system either through their State or at the Federal level through
the United States Fire Administration's National Fire Incident Reporting System (NFIRS) during the grant
period. If you already report to USFA or to the State. that is sufficient. If you do not report to USFA or the
State, you must start as soon as possible and report for a period of 12 months. USFA staff can assist you if
you are awarded a grant and have questions about NFIRS.
3. Grantees must agree to maintain expenditures at the average of their departments' expenditures in the
awarded grant program activity areas from the previous two years. Maintaining operating expenditures refers
to the fact that these funds are meant to be a supplement to existing funds not a replacement of funds in the
departments' current budgets. Therefore, on top of the federal grant (if selected) and the matching funds,
grantees must maintain the average of the last two years' spending levels on items for which the grantees
receive a grant during the grant period of performance. For example: Your department wins a grant that
includes a Wellness and Fitness Program. You want your firefighters to get the complete physical instead of
the rudimentary physical you normally provide. For the year of the grant, you have to pay what you normally
would pay for your physicals first. Then, the grant funds can be used to cover the extra. Another example
would be that your department received a training grant and your department usually spends 55,000 a year on
training. The grant can be used to cover training expenses over that 55,000.
4. Grant recipients must maintain their grant files and supporting documents for three years after the closure of
their grant.
5. All grantees must follow the audit requirements of OMS Circular A-133, Audits of States, Local Government,
and Non-Profit Organizations. The main. requirement of this OMS Circular is that grantees who expend
5300,000 or more in Federal funds (from all Federal sources) must have a single audit or independent audit
performed in accordance with the circular.

"Our Congressional leadership and the President have provided unprecedented resources for America's fire
service." U.S. Fire Administrator R. David Paulison said. "I encourage every fire department to identify their grant
program eligible needs to us in an application, so that we can effectively distribute these funds for the benefit of
the Nation's firefighters and the American public."
The leaders of our country have provided a way to meet the vast needs of the nation's firefighters and public
served by these often 'un-sung' heroes. And we are thankful, because we are in need!
The City of Paris Fire Department, located in rural Northeast Texas, is seeking $271,978.00 from the FEMA Fire

Operations and Firefighter Safety Program to purchase the following personal protective equipment: 54 Self-
Contained Breathing Apparatus (SCBA), 64 spare cylinders. The addition of this important safety equipment will
allow us to provide equipment that is in total compliance to OSHA, NIOSH and NFPA standards, which in turn
will assist our efforts in better protecting our valued personnel and in serving the people of our community and
the surrounding area. For the last two years, the Paris t"ire Department has been working toward a total
transition from the old BMR (Belt Mounted Regulator) style SCBA to the newer. more technologically-advanced
MMR (Mask Mounted Regulator) style of SCBA that meets NIOSH approval and the requirements of NFPA
1981. With the ever-increasing risk of possible terrorist action within the United States and the associated
dangers to first responders, it is important that we provide our staff with SCBA equipment that has a high
resistance to chemical penetration and permeation and that is appropriate for use against CBRN agents.
However, procuring the necessary funds at the local level to complete such a transition has been impossible
given the economic strain of our area. That is why this grant is so important to us.
We average approximately 150 to 180 structure fires out of an average annual total call volume of 1550 to 1650
calls. Our SCBA experience heavy use as we service a city of 43.5 square miles with a population in excess of
25,000. The city has a large concentration of older homes and structures. a large downtown square area with
old (1916-era) multi-story buildings, two major hospital facilities of five and seven stories, multiple hospital
service and medical aide buildings. seven nursing home facilities, six major industrial complexes, a large
ammonia nitrate and agriculture fertilizer facility, an agricultural chemical retailer and a host of other commercial
and light industrial businesses. Though the City of Paris has a formal Mutual Aide agreement with Lamar
County, in the event of a major disaster, the city would be and is the primary source of expertise, mitigation
equipment and staffing.
The following table gives a visual representation of cities that are of comparable size to Paris and statistical
information in regards to population, fire department budget, nLlmber of personnel. number of total alarm
responses and number of structure fires during last fiscal year:

Of the cities compared. Paris has the least budget and next to least number of personnel, but responded to the
most structure fires. This should help to validate the need for the SCBA. The overall goal of this department is to
purchase sufficient SCBA with extra bottles so that we can efficiently equip 100 percent of our entire firefighting
staff. Currently,we are forced to equip only first-line personnel and keep other SCBA in reserve. We are a
smaller department with minima! staffing. Because the City of Paris is geographically isolated from any city and
fire department of comparable size we are forced to be self-sufficient. On many occasions we have had to call in
additional staffing (from our off-duty ranks) to support suppression/mitigation efforts. The ability to provide each
employee with his/her own NIOSH approved,SCBA would greatly increase the overall safety capabilities of this
department. expedite mitigation efforts. provide the necessary SCBA for use with Haz-Mat and CBRN incidents
and assist us in providing better service for our community and area.
Budget Activity Explanation
The City of Paris Fire Department will utilize the $271,978.00 in FEMA funding to purchase the following
personal protective equipment to efficiently equip 100 percent of our entire firefighting staff:

. 64 spare cylinders
We realize that the overall request of 5271 ,978.00 represents an extensive amount of funding (if you say it real
fast it doesn't seem quite so bad though!). However, given the increased purchase price of new SCBA due fo
the manufacturers' efforts at complying to mandated changes and enhancements as required by NFPA and
other regulatory agencies, the total number of packs needed and the total number of extra cylinders needed, we
truly feel that the request is warranted. This extensive cost is the very reason we have not been able to
accomplish the wholesale transition to the newer and safer SCBA through the standard city budgetary process.
If we cannot procure this much needed grant, then this department will not be able to complete the wholesale
transition for several years as we try to replace the equipment a little at a time. Such action would force us to
utilize SCBA of at least two (2) different brands and types, which could greatly compromise personnel safety.
The most important aspect of this request is that it will allow for a 100 percent - one time transition in which this
department can replace all our current SCBA with a new more technologically advallced model. We are
currently on course in our efforts to provide specialized training to our personnel to enhance our ability to
respond to and properly mitigate incidents related to WMD, CBRN and terrorist actions, and our total success

hinges on the success of this grant. It is paramount that we receive the necessary funding.
Community/Department Benefits
Not only will the FEMA funding greatly benefit the immediate city, but will also provide benefits to the entire
county. The City of Paris and Lamar County have recently entered into a mutual aid agreement (Resolution No.
2002-196). The purpose of the agreement is to provide mutual aid between the city and county in meeting any
emergency or disaster from enemy attack or other cause, natural or otherwise and recognizes that the prompt,
full and effective utilization of the resources of the respective city and county is essential to the safety, care and
welfare of the people thereof in the event of a major emergency or disaster. In addition to mutual aid benefits,
the procurement of this much-needed equipment will have a widespread effect on area volunteer fire
departments. As a gesture of local assistance, the City of Paris is pledging to donate all 50 of our current SCBAs
to the 19 volunteer fire departments scattered throughout Lamar County. These volunteer departments are
located in the rural areas of our county and are in serious need of this type equipment. They receive limited
financial support from the county and are forced to purchase their own equipment primarily with out-of-pocket
funds or by relying on donations. The SCBA that the City of Paris would donate are currently operational, within
the manufacturer's standards, and have been well maintained. However. the manufacturer plans to discontinue
sales of this model SCBA by December 31. 2003 and the sale of parts after 2009. Though use of this equipment
will gradually diminish (because of non-availability of parts after 2009). the volunteer departments could greatly
benefit in the short term and over the next few years with free availability now. Donating the SCBAs to the
volunteer departments would provide them with much-needed safety equipment that they simply do not have the
funds to purchase otherwise. The donated SCBA will greatly enhance their ability to provide service for their
communities by providing necessary equipment for interior attack fire mitigation and the ability to respond to a
larger number of hazards, provide for the individual protection of the volunteer firefighters themselves and in the
event of a large scale disaster could enhance their ability to provide mutual assistance to the City of Paris. By
helping them, we help ourselves.
Need for Additional Funding
Given the poor economic condition of our area, l;>rocuring the necessary funds at the local level has been
impossible. The FEMA funding is crucial to us'
The overall projected cost to purchase the new SCBA equipment needed for our 54 person suppression staff is
S271,978.00. The city does not have the funding available to cover an expenditure of that magnitude in the
overall budget. That is why this grant is so vitally important to us. Furthermore, the City of Paris implemented a
reduction to fire department staffing last fiscal year and, as a means to further reduce expenditures, is
researching the possibility of further reducing current emergency services staffing if the projected budget
shortfall for 2003/2004 does not diminish. In addition, the State of Texas has directed a seven percent budget
reduction across the board in discretionary spending and the federal government is proposing a 10 percent
reduction in discretionary spending for the upcoming year. All this translates into a potential reduction of services
for the City of Paris with very minimal funds available for equipment purchase.
In preparing for and equipping ourselves for 'i1 possible terrorist act. CBRN incident. and/or a Weapons of Mass
Destruction (WMD) incident, we are desperate for the funds to complete a wholesale transition from the old BMR
(Belt Mounted Regulator) style SCBA to the newer, more technologically-advanced MMR (Mask Mounted
Regulator) style of SCBA, which meets NIOSH approval and the requirements of NFPA 1981.
Additional Information
The City of Paris Fire Department first applied for FEMA funding during the last fiscal year (2002-2003). Our
plan then was the same as it is now, to procure sufficient funding to complete this very necessary SCBA
transition. Yes, we failed to be successful last year, but our need for this life-saving equipment has not changed
nor has it diminished!
For the last two years. we have presented our case to city management during the budgetary process, but again
have not been able to procure the funds necessary to obtain the equipment. However, there is good news! We
have been able to procure the matching funds necessary to help secure this grant. City management supports
the need for this SCBA change and is willing to commit to providing the matching fund portion of the overall cost,
but simply has not been able to provide funding for the project in totality. Gentlemenlladies, we have a small
window of opportunity in which to complete this very necessary project. As stated earlier, our current SCBA
ma~ufacturer plans to discontinue the model of SCBA that we are using and will not provide replacement parts
after a few years. For this department to progress and to be able to provide the services that this community and
area are in vital need of depends, to a great deal, on the success of this grant process. We implore you to
consider the urgency of our request and respond in a positive and expeditious manner. Please help us help our
neighbors.

(A) The applicant certifies that it will continue to provide a drug-free workplace by:
(a) Publishing a statement notifying employees that the unlawful manufacture,
distribution, dispensing, possession, or use of a controlled substance is prohibited in
the grantee's workplace and specifying the actions that will be taken against
employees for violation of such prohibition;
(b) Establishing an on-going drug free awareness program to inform employees

(1) The dangers of drug abuse in the workplace;
(2) The grantees policy of maintaining a drug-free workplace:

the grant to be given a copy of the statement required by paragraph (a);
