2003-026-RES GRANTING A PETITION FOR ANNEXATION OF 11.316 ACRES ~ RESOLUTION NO. 2003-026 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, GRANTING A PETITION FOR ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 11.316 ACRES, MORE OR LESS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris is in receipt of a Petition for Annexation for the annexation of certain territory consisting of 11.316 acres, more or less; and, WHEREAS, the City Council finds and determines that the petition was signed by all of the qualified voters residing or owning property in the area requested to be annexed in compliance with Section 6 of the Charter of the City of Paris; and, WHEREAS, the City Council further finds and determines that the property requested to be annexed into the city of Paris is one-half mile or less in width, is contiguous to the existing city limit line, and is vacant and without residents or has fewer than three (3) qualified voters who reside on the property, in compliance with Section 43.028 of the Local Government Code; and, WHEREAS, the City Council further finds and determines that the petition is in proper form and in all things complies with the requirements of Section 43.028( c) of the Local Government Code and the applicable provisions of the City Charter; and, WHEREAS, the City Council further finds and determines that, in accordance with Section 43.028(d) of the Local Government Code, a hearing on the petition was had before the City Council after the 5th day but on or before the 30th day after the date the petition was filed with the City Clerk in order to hear the petition and the arguments for and against the annexation; and, WHEREAS, after hearing such petition and the arguments for and against the same, the City Council deems it appropriate to grant such petition to annex said territory into the city of Paris, Texas; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the Petition for Annexation, a copy of which is attached hereto and for all purposes incorporated herein, for the annexation of the following described property, to wit: Being all that certain tract of land situated in the City of Paris, Lamar County, Texas, a part of the Wesley Askins Survey, Abstract No.7, a part of the 100.00 acre tract of land conveyed to D. Wayne Brown, et aI., by deed recorded ~ ~ in Volume 939, Page 31 of the Lamar County Real Property Records, and a part of the 121.76 acre tract of land conveyed to D. Wayne Brown, et al., by deed recorded in Volume 949, Page 296 of the Lamar County Real Property Records, and being further described as follows: BEGINNING at an iron pin found at the Southeast comer of Lot 9, and being in the North line of Lot 8, Block D, of The Hills No.2 as shown by plat recorded in Envelope 364-D of the Lamar County Plat Records; THENCE North 380 54' 23" West a distance of 150.00 feet to an iron pin found at the Northeast comer of said Lot 9, Block D; THENCE North 51005' 37" East a distance of 59.26 feet to an iron pin set in the South Boundary Line of Abby Lane; THENCE North 380 54' 23" West, a distance of 200.00 feet to an iron pin found at the Northeast corner of Lot 9, Block E of said The Hills No.2; THENCE North 54054' 28" East a distance of 300.67 feet to an iron pin set for comer; THENCE North 51005' 37" East a distance of 511.48 feet to an iron pin set for corner in the West boundary line of North Hills Drive; THENCE North 53054 '04" East a distance of 60.10 feet to an iron pin set for corner in the East boundary line of said North Hills Drive; THENCE North 58032' 57" East a distance of 411.55 feet to an iron pin set for corner in the East Line of the 100' TXU Utility easement; THENCE South 64008 '23" East a distance of 420.41 feetto an iron pin set for corner in the East line of said Easement; THENCE South 580 32'57" West a distance of 630.37 feet to an iron pin found at Northeast corner of Lot 11, Block A, of The Hills No.1 as shown by plat recorded in Envelope 364-0 of the Lamar County Plat Records, said pin being in the West boundary line of said North Hills Drive; THENCE South 550 43'26" West a distance of 60.00 feet to an iron pin found at the Northeast corner of Lot 1, Block D, said The Hills No. I, said pin being in the West boundary line of said North Hills Drive; THENCE South 51005'37" West a distance of 516.09 feet to an iron pin found at the Northeast comer of Lot 5, Block D, said The Hills No.1; THENCE South 560 46'15" 201.00 feet to an iron pin found at the Northeast corner of Lot 8 and the Northwest corner of Lot 7, Block D, said The Hills No.1; THENCE South 51005'37" West a distance of 117.11 feet to the place of beginning, and containing 11.316 acres ofland, be, and the same is hereby, granted.
