2003-037-RES APPROVE CITY MGR TO NEGOTIATE CONTRACT FOR ASBESTOS REMOVAL AT UARCO BLDG ~ ~ , RESOLUTION NO. 2003-037 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AUTHORIZING THE CITY MANAGER AND THE CITY ENGINEER TO SOLICIT PROPOSALS AND NEGOTIATE A CONTRACT IN ACCORDANCE WITH STATE LAW FOR ASBESTOS REMOVAL AT THE UARCO BUILDING, WHICH WILL BE CONVERTED TO A LAW ENFORCEMENT CENTER FOR POLICE, COURT, AND JAIL FACILITIES; AND SIMILAR ASBESTOS REMOVAL AT THE CITY HALL /OLD CENTRAL FIRE STATION; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris did heretofore, on the 1st day of May, 2000, in Resolution No. 2000-058, authorize the execution of a professional services contract with Brinkley Sargent Architects for the performance of a needs assessment study and plan for a police and municipal courts center for the City of Paris; and, WHEREAS, the City Council did heretofore, on the 13th day of November, 2000, in Resolution No. 2000-160, accept and approve such study and authorize the City Manager and City Attorney to negotiate and the Mayor to execute a professional services contract with Brinkley Sargent Architects for preliminary design and planning services in furtherance of a potential new Police and Municipal Courts facility; and, WHEREAS, the City Council did heretofore, on the 8th day of April, 2002, in Resolution No. 2002-068, authorize the City Manager to execute a Real Estate Purchase Agreement for the purchase of property located at Collegiate Drive and Clarksville Street, known as the "UARCO" property; and, WHEREAS, as part of the City's due diligence on the "DARCO" property, the City contracted with ETTL Engineers and Consultants to perform site assessments, including an asbestos survey; and, WHEREAS, ETTL advised the City of Paris during such due diligence process that asbestos had been located in certain accessible areas of the "UARCO" building, and the City Engineer and the City Manager have requested the City Council to authorize the solicitation of requests for proposals for asbestos removal at the DARCO building; and, WHEREAS, the City contracted with ETTL Engineers and Consultants to additionally perform an asbestos survey at the City Hall/old Central Fire Station building, and they have likewise advised the City of Paris that asbestos has been located in certain accessible areas of this building as well; and, ~ WHEREAS, the City Council ofthe City of Paris finds and determines that the performance of asbestos removal at the DARCO building and the City HaIl/old Central Fire Station building would be in the best interests of the citizens ofthe City of Paris; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the City Manager and the City Engineer are hereby authorized to solicit proposals for the performance of asbestos removal at the "DARCO" building, which will be converted to a law enforcement center for police, court, and jail facilities, and the City Hall/old Central Fire Station building, Section 3. That, upon receipt of said proposals, the City will comply with State law regarding pursuit ofthe negotiation of a contract for said services. Section 4. That, following negotiation of said contract, the City Manager and the City Engineer will present a contract to the City Council for approval to perform the aforesaid asbestos removal. Section 5. That funds for said asbestos removal from the "DARCO" building shall be taken from Combination Tax and Revenue Certificates of Obligation, Series 2002. Section 6. That funds for said asbestos removal from the City Hall/old Central Fire Station building shall be taken from other funds. Section 7.
