RESOLUTION NO. 2003-021
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, AWARDING THE BID AND AUTHORIZING THE
EXECUTION OF A CONTRACT FOR THE CONSTRUCTION OF THE
WATER LINES ASSOCIATED WITH THE CONSTRUCTION OF A NEW
ELEVATED WATER STORAGE TANK - BONHAM STREET; MAKING
OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT;
AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris did heretofore, on the 9th day of
December. 2002. in Resolution No. 2002-178, approve the advertisement for bids for furnishing
plant, labor, materials, and equipment and for performing all work required for the water lines
associated with the "Elevated Water Storage Tank - Bonham Street Project," which bids were
received until 3:00 o'clock p.m., Thursday, the 9th day of January, 2003; and,
WHEREAS, the best bid for such construction was made by Buster Paving, a division of
APAC - Texas, Inc., of Sulphur Springs, Texas, and it should be awarded the bid for the same;
and,
WHEREAS, the form of the contract for such construction project, attached hereto as
Exhibit A, should, in all things, be approved, and the Mayor should be authorized to execute the
same; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all
things approved.
Section 2. That the bid of Buster Paving, a division of APAC - Texas, Inc., for
construction of the associated water lines for the "Elevated Water Storage Tank - Bonham Street
Project, " in the amount of $1 ,834,517 .60, be, and the same is hereby, accepted and let conditioned
upon said contractor meeting all of the terms and specifications included in the bid documents.
Section 3. That the form of the contract with Buster Paving, a division of APAC - Texas,
Inc., attached hereto as Exhibit A, be, and the same is hereby, approved.
Section 4. That the Mayor be, and he is hereby, authorized and directed to execute, on
behalf of the City of Paris, the contract with Buster Paving, a division of APAC - Texas, Inc.,
upon the terms and conditions and in the form shown in Exhibit A, attached hereto.
Section 5. That this resolution shall be effective from and after its date of passage.

CONTRACT AGREEMENT
CITY OF PARIS, TEXAS
24" RCCP WATER TRANSMISSION LINE
BID NO. 82.49
THIS AGREEMENT, made and entered into this day of .2003, by and
between the City of Paris, County of Lamar, Texas, Party of the First Part, hereinafter referred to as the
"City", and Party of the Second Part, hereinafter referred to as the
'Contractor" for the 24" RCCP Water Transmission Line. Bid No. 82.49.
WITNESSETH:
ARTICLE 1. It is hereby mutually agreed that for and in consideration of the payments as provided for
herein to the Contractor by the City, the said Contractor shall fumish all labor, equipment, and material
(except as otherwise specified above) and shall perform all work necessary to complete the
improvements in a good and substantial manner, ready for use, within the specified time for completion
of three hundred (300) calendar davs. The work shall be in strict accordance with this Contract, a
copy of which is filed pursuant to law in the office of the City Clerk.
ARTICLE 2. It is hereby further agreed that in consideration of the faithful performance of the work by
the Contractor, the City shall pay the Contractor the compensation due him by reason of said faithful
performance of the work at stated intervals and in the amount certified by the City Engineer, in
accordance with the provisions of this Contract.
ARTICLE 3. It is hereby further agreed that, at the completion of the work and its acceptance by the
City, all sums due the Contractor by reason of alterations or modifications of the original Contract or by
reason of 'Extra Work" authorized underthis Contract, will be paid the Contractor by the City after said
completion and acceptance.
ARTICLE 4. It is hereby further agreed that any reference herein to the 'Contract" shall include all
"Contract Documents" as the same are listed and described in Paragraph 1.9 of SECTION: GENERAL
CONDITIONS bound herein, and said "Contract Documents' are hereby made a part of this
Agreement as fully as if set out at length herein, and that this Contract is limited to the items in the
Proposal as signed by the "Contractor" and included in the 'Contract Documents".
ARTICLE 5. The Contractor agrees to perform all of the work described in the Contract Documents for
the unit prices and lump sums as submitted in the Bid, in the total amount of
($ ), taking
into consideration additions to or deductions from the Total Bid by reason of alterations or
modifications of the original quantities or by reason of "Extra Work" authorized under this Agreement in
accordance with the provisions of the Contract Documents.
ARTICLE 6. The Contractor agrees that the sum of Five hundred Dollars ($500.00) in Liquidated
Damages will be deducted from the Contract price by the City for each calendar day that the work
remains incomplete beyond the Contract time for completion, or within such extra time as may have
been allowed by an extension approved by the City.
