RESOLUTION NO. 2004-190
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, GRANTING A PETITION FOR ANNEXATION OF
CERTAIN TERRITORY CONSISTING OF 8.448 ACRES, MORE OR LESS;
MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE
SUBJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris is in receipt of a Petition for Annexation
for the annexation of certain territory consisting of 8.448 acres, more or less; and,
WHEREAS, the City Council finds and determines that the petition was signed by all ofthe
qualified voters residing or owning property in the area requested to be annexed in compliance with
Section 6 ofthe Charter of the City of Paris; and,
WHEREAS, the City Council further finds and determines that the property requested to be
annexed into the city of Paris is one-half mile or less in width, is contiguous to the existing city limit
line, and is vacant and without residents or has fewer than three (3) qualified voters who reside on
the property, in compliance with Section 43.028 of the Local Government Code; and,
WHEREAS, the City Council further finds and determines that the petition is in proper form
and in all things complies with the requirements of Section 43 .028( c) ofthe Local Government Code
and the applicable provisions of the City Charter; and,
WHEREAS, the City Council further finds and determines that, in accordance with Section
43 .028( d) ofthe Local Government Code, a hearing on the petition was had before the City Council
after the 5th day but on or before the 30th day after the date the petition was filed with the City Clerk
in order to hear the petition and the arguments for and against the annexation; and,
WHEREAS, after hearing such petition and the arguments for and against the same, the City
Council deems it appropriate to grant such petition to annex said territory into the city of Paris,
Texas; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all things
approved.
Section 2. That the Petition for Annexation, a copy of which is attached hereto and for all
purposes incorporated herein, for the annexation of the following described property, to wit:
Being all that certain tract of land situated in Lamar County,
Texas, a part of the Wesley Askins Survey, Abstract No.7, a part
of the 100.00 acre tract of land conveyed to D. Wayne Brown, et
al., by deed recorded in Volume 939, Page 31 of the Lamar County
Real Property Records, and a part of the 121.76 acre tract of land
conveyed to D. Wayne Brown, et al., by deed recorded in Volume
949, Page 296 of the Lamar County Real Property Records, and
being further described as follows:
Beginning at an iron pin found for comer at the most
Northeasterly comer of Lot 17, Block B, of The Hills Phase ill as
recorded in Envelope No.3 71-C of the Lamar County Plat Records;
Thence South 58032'57" West a distance of 411.55 feet to an
iron pin found for comer at the most Northwesterly corner of Lot 20,
Block B, of said The Hills Phase ill, said pin being in the Northeast
RO.W. of North Hills Drive;
Thence South 53054'04" West a distance of60.1O feet to an
iron pin found for corner at the most Northeasterly comer of Lot 1,
Block E, of said The Hills Phase ill, said pin being in the Southwest
RO.W. of North Hills Drive;
Thence South 51005' 3 7" West a distance of 511.48 feet to an
iron pin found for comer at the most Northeasterly comer of Lot 6,
Block E, of said The Hills Phase III, said pin being the most
Northwesterly corner of Lot 5, Block E, of said The Hills Phase ill;
Thence South 54054'28" West a distance of300.67 feet to an
iron pin found for comer at the most Northeasterly comer of Lot 9,
Block E, of The Hills Phase IT as recorded in Envelope No. 364-D, of
the Lamar County Plat Records, said pin being the most
Northwesterly corner of Lot 8, Block E, ofthe Hills Phase ill;
Thence South 51005'37" West a distance of208.93 feet to an
iron pin found for comer at the most Northwesterly comer of Lot 10,
Block E, of The Hills Phase II, said pin being in the Northeast
RO.W. of 33rd Street N.E.;
Thence North 44012'46" West a distance of58.31 feet to an
iron pin set for comer in the Northeast RO.W. of 33rd Street N.E.;
Thence South 45047' 14" West a distance of294.24 feet to an
iron pin found for comer at the most Northwesterly comer of Lot 2,
Block K, of said The Hills Phase II, said pin being in the Northeast
line of Lot 8, Block K, of said The Hills Phase II;
Thence North 58036'30" West a distance of203.47 feet to an
iron pin found for comer at the most Northerly corner of said Lot 8;
Thence South 71029'59" West a distance of75.88 feet to an
iron pin set for corner in the most Northerly line of said Lot 8;
Thence North 45047'14" East a distance of363.20 feet to an

Thence North 44012'46" West a distance of26.67 feet to an

Thence around a curve to the right having a radius of 741.20 feet, long chord
bears North 43011 ' 45" West a distance of 41.10 feet, an arc distance of 41.11 feet to

Thence North 51005'37" East a distance of 50.06 feet to a point for corner;
Thence around a curve to the left having a radius of691.20 feet, long chord

TO THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL OF THE
CITY OF PARIS, PARIS, TEXAS:
This petition is presented to the Mayor and Members of the City Council pursuant to the
terms and provisions of Section 43.028 of the Local Government Code, entitled "Authority of
Municipalities to Annex Partially Occupied Area on Petition of Area Land Owners," as well as the
requirements of Section 6 of the Charter of the City of Paris.
The undersigned owners of the hereinafter described tract or tracts ofland which are vacant
and without residents, or on which less than three qualified voters reside, hereby petition the Mayor
and Members of the City Council of the City of Paris, as the governing body of the City of Paris, to
extend the present city limits so as to include as part of the city of Paris the property described by
metes and bounds on Exhibit A, attached hereto.
We certify that the property described on Exhibit A, attached hereto, is contiguous and
adjacent to the current city limits of the city of Paris, is not more than one-half mile in width, and
that this petition is signed and duly acknowledged by each and every person or corporation having
an interest in said land.
We further certify that this petition is filed by all of the qualified voters residing or owning
property in the area requested to be annexed and that the below signatories own all of the area being
requested to be annexed.
