RESOLUTION NO. 2004-122
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, GRANTING A PETITION FOR ANNEXATION OF
CERTAIN TERRITORY CONSISTING OF 11.613 ACRES, MORE OR LESS;
MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE
SUBJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris is in receipt ofa Petition for Annexation
for the annexation of certain territory consisting of 11.613 acres, more or less; and,
WHEREAS, the City Council finds and determines that the petition was signed by all of the
qualified voters residing or owning property in the area requested to be annexed in compliance with
Section 6 of the Charter of the City of Paris and filed with the City of Paris on June 10,2004,2004;
and,
WHEREAS, the City Council further finds and determines that the property requested to be
annexed into the city of Paris is one-half mile or less in width, is contiguous to the existing city limit
line, and is vacant and without residents or has fewer than three (3) qualified voters who reside on
the property, in compliance with Section 43.028 of the Local Government Code; and,
WHEREAS, the City Council further finds and determines that the petition is in proper form
and in all things complies with the requirements of Section 43 .028( c) ofthe Local Government Code
and the applicable provisions of the City Charter; and,
WHEREAS, the City Council further finds and determines that, in accordance with Section
43 .028( d) of the Local Government Code, a hearing on the petition was had before the City Council
on July 12,2004, after the 5th day but on or before the 30th day after the date the petition was filed
with the City Clerk in order to hear the petition and the arguments for and against the annexation;
and,
WHEREAS, after hearing such petition and the arguments for and against the same, the City
Council deems it appropriate to grant such petition to annex said territory into the city of Paris,
Texas; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all things
approved.
Section 2. That the Petition for Annexation, a copy of which is attached hereto and for all
purposes incorporated herein, for the annexation of the following described property, to wit:
Being all that certain tract of land situated about 2.5 miles North 300 East
of the City of Paris, County of Lamar, and State of Texas, a part of the Reddin
Russell Survey #786, and being a part of a called 130.5 acre tract of land conveyed
to May Belle Dunnagan by deed recorded in Vol. 210, Page 286, of the Deed
Records of said County and State.
Beginning at a 3/8" iron pin (f) for comer at an original el comer of said
Dunnagan 130.5 acre tract, said comer being the Northeast comer of a called 18.4
acre tract ofland conveyed to Richard B. Swint by deed recorded in Vol. 526, Page
880, of said Deed Records, said 18.4 acre tract of land originally being a part of
said Dunnagan 130.5 acre tract, said comer also being the Northerly Northwest
comer of a called 99.54 acre tract of land conveyed to Townwood Development
Co., Inc., by deed recorded in Vol. 511, Page 188, of the Real Property Records of
said County and State.
THENCE South 89043'26" West along a fence along the North Boundary
Line of said Swing 18.4 acre tract a distance of 318.31 feet to a W' capped (JMN -
4025) iron pin (s) for comer, said comer being Easterly a distance of 344.24 feet
from a Y2" iron pin (f) at the Northwest comer of said Swint 18.4 acre tract;
THENCE North 30013'29" East a distance of 607.17 feet to a W' capped
(JMN - 4025) iron pin (s) for comer;
THENCE West a distance of 345.41 feet to a W' capped (JMN - 4025) iron
pin (s) for comer;
THENCE North 37014'01" East along the East Boundary Line of Still house
Road / Lamar County Road 41100 a distance of70.99 feet to a W' iron pin (f) for
comer;
THENCE East a distance of 1000.00 feet to a W' capped (JMN - 4025) iron
pin (s) for comer;
THENCE South a distance of589.19 feet to a~" capped (JMN - 4025) iron
pin (s) for comer;
THENCE North 89011'58" West along a fence along a South Boundary
Line of said Dunnagan 130.5 acre tract and along the Northerly North Boundary
Line of said Townwood 99.54 acre tract, a distance of 684.95 feet to the place of
beginning and containing 505,848.03 square feet ofland, or 11.613 acres ofland.

Section 3. That this resolution shall be effective from and after its date of passage.
