RESOLUTION NO. 2004-151
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, APPROVING AND AUTHORIZING THE EXECUTION OF
AN AMENDMENT TO THE AGREEMENT FOR PROFESSIONAL
SERVICES WITH HAYTER ENGINEERING FOR PROFESSIONAL
ENGINEERING/DESIGN SERVICES RELATED TO THE DOWNTOWN
STREETSCAPE PROJECT, "STATEWIDE TRANSPORTATION
ENHANCEMENT PROGRAM" GRANT NO. CSJ-0901-29-017, PROJECT
STP 2000 (615) TE; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris did heretofore, on the 5th day of
August, 1999, in Resolution No. 99-100, authorize an application to be made to the Texas
Department of Transportation for the Statewide Transportation Enhancement Program grant; and,
WHEREAS, the City Council of the City of Paris did heretofore, on the 12th day of June,
2000, in Resolution No. 2000-073, accept the Grant Award entitled "Statewide Transportation
Enhancement Program" Grant No. CSJ-0901-29-017, Project STP 2000 (615) TE, in the total
amount of $805,920.00, requiring matching contribution of $201,480.00; and,
WHEREAS, the City Council of the City of Paris did heretofore, on the 9th day of July,
select Hayter Engineering to provide professional engineering/design services for the Downtown
StreetScape Project, "Statewide Transportation Enhancement Program" Grant No. CSJ-0901-29-
017, Project STP 2000 (615) TE; and,
WHEREAS, the City Council of the City of Paris did heretofore, on the 13th day of
August, 2001, in Resolution 2001-122, approve an Agreement for Professional Services with
Hayter Engineering, Inc. for professional engineering/design services related to the Downtown
StreetScape Project; and,
WHEREAS, plans and specifications were prepared by Hayter Engineering, with the title
being given thereto of the "Downtown StreetScape Project," Federal Project STP 2000 (615) TE,
CSJ #090 1-29-017, which plans and specifications were approved by adoption of Resolution No.
2003-146 on September 8,2003; and,
WHEREAS, the City Council desires to approve an amendment to the aforesaid
Agreement for Professional Services to authorize additional engineering services associated with
the Project; and,
WHEREAS, the form of the Amendment to Agreement for Professional Services with
Hayter Engineering, attached hereto as Exhibit A, should, in all things, be approved, and the City
Manager should be authorized to execute the same; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the fmdings set out in the preamble to this resolution are hereby in all
things approved.
Section 2. That the form of the Amendment to the Agreement for Professional Services
with Hayter Engineering, attached hereto as Exhibit A, for additional professional
engineering/design services related to the Downtown StreetScape Project, "Statewide
Transportation Enhancement Program" Grant No. CSJ-090 1-29-017 , Project STP 2000 (615) TE,
be, and the same is hereby, approved.
Section 3. That the Mayor be, and he is hereby, authorized and directed to execute, on
behalf of the City of Paris, the Amendment to the Agreement for additional Professional Services
with Hayter Engineering, under the terms and conditions and in the form shown in Exhibit A,
attached hereto.
Section 4. That this resolution shall be effective from and after its date of passage.

REFERENCE: Phase II - Downtown Streetscape Project
Supplemental Agreement for Professional Services

Dear Mayor Fendley:
The low bid which was received on the Downtown Streetscape project was approximately
$150,000 under budget. With this phase almost complete we now know that funds are available
for a second phase to this project. This second phase will add approximately one-half block of
sidewalk and lighting from the N.E., S.E. & S.W. comers of the square in both directions on both
sides of the street.
Phase II will require additional professional services. Therefore, we are submitting this letter as a
supplement to our original agreement for review and approval. The change order to implement
this extra work, in the amount of $146,813.30 will represent a 24% increase in the contract with
Encino Landscape, Inc. Because of the magnitude of the change order TxDOT and TDLR review
and approval of the Phase II design will be required. The following are the services that we
anticipate and their cost:

Per Section 2.6 additional services anticipated during Phase II include construction materials
testing, with an estimated cost being $975. Additionally, because the area of the Phase II work is
outside of the area defined by the original Environmental Assessment (EA), an updated EA will
be required to include Phase II, with an estimated cost of$I,900.
The terms and conditions of the original agreement also apply to this supplement. The Exhibit A
Schedule of Per Diem Rates will remain unchanged.
If this meets with Council approval, please return one signed copy. We look forward to working
with the City on the successful completion of Phase II.
