St. Paul Baptist Church has established the Ralph Rogers School for Success at the church with daycare and preschool classes being offered immediately. The request is for drop off time of 7:30 to 8:30 AM and pickup times of 2:45 PM to 4:00 PM. The school zone was presented to the Traffic Commission February 3, 2009 and they recommended an ordinance change to establish the school zone from the 300 to 400 block of NE 2°d Street. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ESTABLISHING A SCHOOL ZONE SPEED LIMIT OF TWENTY (20) MILES PER NOUR FOR TNE 300 TO 400 BLOCK OF NE 2ND STREET BETWEEN PINE BLUFF AND BOOTH STREETS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Paris Traffic Commission is charged with the responsibility to study and evaluate reasonable rates of speed on City streets and roadways; and, WHEREAS, the Traffic Commission, at its regular meeting of February 3, 2009, considered and evaluated a request to establish a school zone speed limit of twenty (20) miles per hour for the 300 to 400 block of NE 2nd Street between Pine Bluff and Booth Streets for the private school and a day care and pre-school classes at St. Paul Baptist Church; and, WHEREAS, having done so found and determined that the establishment of a school zone in this area is necessary to protect the health and safety and is in the best interests of the citizens of the City of Paris and have so recommended the speed adjustment to the City Council of the City of Paris; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That a school zone is hereby established as follows: In the 300-400 block of NE 2°d Street (between Pine Bluff and Booth Streets), a school zone speed limit of twenty (20) miles per hour from 45 minutes before school opens until classes begin; and for a 30 minute period following the end of the school day. Section 3. The Director of Public Works is hereby authorized to post appropriate signs indicating the school zone speed limit for this roadway. Section 4. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 6. That it is the intention of the City Council of the City of Paris that this ordinance, and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 7. That any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor, and, upon conviction, shall be fined in accordance with the provisions of Section 1-6 of the City of Paris Code of Ordinances, and each and every day's continuance of any violation of the above-enumerated sections shall constitute and be deemed a separate offense. Section 8. Introduced and read on first reading on February 23, 2009, at a regular meeting of the City Council of the City of Paris and read and passed on second reading on March 9, 20098, at a regular meeting of the City Council of the City of Paris; the same being two (2) separate regular meetings of the City Council of the City of Paris. Section 9. That this ordinance shall become effective from and after its passage of the second reading and publ,ication as required by law. Bee Garmon 2. Tom Calabria 3. Jon McFadden 4. Ray Banks 5. Stephen Holmes The city staff was represented by Assistant Chief of Police Bob Hundley. The meeting was called to order at 5:18 by Senior Commission Member Jon McFadden in Mr. Kimbrough's absence. A quorum was established by 4 members being present. Mr. McFadden asked the commission members to review the submitted minutes of the August 5th, 2008 meeting. Mr. Banks made a motion to approve the minutes which was seconded by Mr. Holmes and passed 5-0. Mr. McFadden moved to item #3 regarding nomination and election of a vice chairman for the traffic commission. Mr. Banks nominated Mr. McFadden for the position and the members of the commission moved by acclamation to close nomination and for Mr. McFadden to serves in this position. This passed 4-0 Item #4 had been tabled at last month's meeting. Mr. McFadden asked for a motion to remove from the table, Mr. Banks made the motion, Mr. Holmes seconded and the vote was unanimous. Asst. Chief Hundley passed out diagrams prepared by the City of Paris engineering office. Unfortunately, the engineer had determined that Main Street was wide enough for parking upon only one side of the street. Asst. Chief Hundley's recommendation to the Commission was to allow the no parking area to remain in place on both sides of the street. Some commission members were not in attendance and Mr. Holmes made a motion to place the item back on the table until such time that the full commission was available for review. That motion was seconded by Mr. Banks and it passed 4-0. Item #5 was brought forth by Mr. McFadden regarding a no parking area on NE 35th Street. Asst. Chief Hundley explained that 35th already has a no parking area on the easj ~cyrb line that stops for no apparent reason in the 300 block. This reque~t1rs to continue the no parking area along the east curb to the 400 block. Mr. Holmes made a motion to approve the no parking zone as presented, f1W101 D 6 seconded by Mr. Banks and approved with a 5-0 vote as commission member Dr. Calabria had arrived. Item #6 was an informational item only. Asst. Chief Hundley reported back to the group regarding a contact with Leroy Snow, manager of the Mirabeau properties regarding the anticipated re-work of the shopping center parking lot. Mr. Snow was contacted regarding the southernmost entrance / exit of the shopping center and the occurrence of 15 collisions that had taken place in that area, primarily with people using the cross over just a short distance south of the shopping center. Mr. Snow stated that there were no plans on closing that entrance / exit, nor would they consider that. Item #7 was brought before the commission by Mr. McFadden regarding a request to remove the cross over in the 5000 block of the SE Loop due to the number of collisions that had taken place there. Asst. Chief Hundley presented information that of the 15 collisions, 9 had been injury accidents and no fatalities. The amount of traffic that leaves the Shopping center and the anticipated re- opening of the loop traffic after the construction of the Pine Mill Road overpass wilt mean that more traffic will be attempting multiple lane changes in a short distance to get to the crossover. The Commission was asked to consider having TxDOT remove this crossover, augment the cross over in the 5500 block that would allow traffic more time to make appropriate lane changes in the longer distance. Mr. Banks made a motion to request TxDOT to erect some type of curb or barrier that would prohibit traffic from the shopping center attempting to use this crossover.
