I assumed my present duties March 1996, and i feel privileged to have served and
worked with Anthony Bethel and the Health Department staff. I will carry pleasant

On January 30, 2009, Midcontinent Express Pipeline LLC (MEPY4&8• Shwlication with the
Federal Energy Regulatory Commission (FERC) requesting authorization to expand the
capacity of the MEP system by constructing and operating additional facilities at three
previously certificated compressor stations located in Lamar and Cass Counties, Texas and
Hinds County, Mississippi. Also included as part of the project would be the installation of a
filter/separator at an existing compressor station in Union Parish, Louisiana. This filing begins a
formal review process of the project by the FERC. Enclosed are materials that explain the
project and how the FERC review process may affect you.
We expect that construction of the expansion facilities will have minimal or no effect on existing
landowners and communities, and MEP is actively engaged in consultations and coordination
with the affected federal, state and local government agencies. Because many landowners
have had questions about noise impacts from station operations, we are including a comparison
chart with this packet. In most cases, the noise abatement equipment on the additional engines
will maintain noise levels at essentially the same levels as in the original plans. The attached
chart illustrates the impacts of noise at each site.

Describe the Midcontinent Express Pipeline Expansion project.
On Juiy 25, 2008, tl-ie FERC issued to MEP a certificate of public convenience and necessity
authorizing MEP to construct and operate an approximately 502-mile pipeline and certain other
facilities. On December 30, 2008, MEP filed an amendment ta the certificate issued on July 25'h,
requesting authorization to change the location of one proposecf compressor station to a new
location 3.5 miles to the east, and authorize the substitution and installation of two larger
compressor units at another compressor station. On January 30, 2009, MEP filed for another
certificate of public convenience and necessity au±horizing MEP to expand the its systern capacify
in Zone 1 from 1,532,000 Dekatherms per day (Dth/day) to 1,832,500 Dth/day by authorizing an
increase in horsepower af three previously certificated compressor stations, in Lamar and Cass
Counties, Texas, and Hinds County, Mississippi, and installing a filterlseparator at another
certificated compressor station located in Union County, Louisiana. The request to amend the
original certificate filed on December 30, 2008 and the request to expand Zone 1 system capacify
filed on January 30, 2009, are pending before the Commission.
What facilities will be included in the Expansion project?
The facilities that are part of this project (which are only those facilities reques#ed in the January
30, 2009 filing) include: (i) one new 6,135 horsepower compressor unit at the Lamar Compressor
Station located in Lamar County, Texas; (ii) two new 8,180 horsepower each compressor units at
the Atlanta Compressor Station in Cass County, Texas; (iii) one new 6,135 horsepower
compressor unit at the Vicksburg Compressor Station in Hinds County, Mississippi; and (iv) one
inlet filterlseparator at the Perryville Compressor Station in Union County, Louisiana.
Why are these facilifies needed?
7hese facilities are necessary, among other things, to increase the capacity of Zone 1 on the
MEP system from its pre-approved expansion capacity of approximately 1,532,000 Dth/day to
approximafely 1,832,500 Dth/day and provide shippers on the MEP system with new pipeline
infras#ructure to transport natural gas out of the growing shale basins. This will create additional
supply assucance deliverability for the Southeast and Florida markets.
Who approves this project and how long will it take?
MEP submitted its Application to the FERC on January 30, 2009. It is expected that the FERC
will issue a certificate authorizing the expansion project within the next six to nine monfhs.
The Application contains more information on the project, the impack on the environment, as well
as other project-related issues. We encourage you to review the Application at one of local
libraries listed in this packet. The application also is availabte electronically on the FERC website
at www.ferc.qov. A link to the filing is provided on the project website at
www.midconfinentexpress.com. You may review the application at your convenience. MEP
an#icipates ongoing communication between the FERC and affected landowners throughout the
review period. A review of landowner and environrnental issues is a part of the overall FERC
application pracess.
How will the project impact you and your properEy?
Construction of the expansion facilities will have a minimal or no effect on existing landowners
and communities. MEP is actively engaged in consultations and coordination with the affected
federal, state and local government agencies. As you may review in more detail in the

Application filing, the additionai horsepower at the three compressor stations will be built with
additional noise abatement equipment. Therefore, the noise impacts on landowners will be very
similar to those in the initially approved project.
About the Company
MEP, with one of its offices in Downers Grove, illinois, is a limited fiability company organized
under the laws of the Delaware Limited Liability Act. MEP is jointly owned by Kinder Morgan
Energy Partners, L.P. and ETC Midcontinent Express Pipeline LLC. MEP does not currently own
any pipeline facilities and is not currently engagsd in any natura) gas transportation operations.
Upon completion of the MEP facilities and commencement of service authorized thereunder,
MEP will be a"natural-gas company" engaged in the transportation of nafural gas in interstate
commerce and subject to the Commission's jurisdiction under the Natural Gas Act.

Landowner Rights
The FERC requires MEP to provide a brief summary of your rights at the FERC and in
proceedings under the eminent domain rules of your state. The following summaries should not
be construed as legal advice, but only as summary descriptions for this limited purpose.
Riqhts at the FERC
The enclosed pamphlet "An Interstate Natural Gas Facility On My Land? What Do I Need To
Know?" explains the FERC's approval process and yaur rights as an affected landowner. There
are severai ways a landowner may become involved in the FERC review process. In addition to
being able to view the application at area libraries or through the FERC's website, any landowner
who rnay be affected by the pipeline project may request a copy of the application by contacting
MEP. A landowner may become directly involved in the review process by submitting written
comments to the FERC and/or intervening in MEP's docket at the FERC. A landowner may file
comments with the FERC at any stage in the environmenfal review process. The FERC
addresses landowner comments, both written and oral, in the environmental review documents or
the final order, and wiil place commenters on a mailing list to receive environmentaf documents
related to the application. A landowner who chooses to file as an intervenor becomes involved in
the proceeding in a more formai manner. An intervenor receives copies of documents related to
the case, has the opportunity to file briefs and appear at any hearings held in Washington, and
appeal finai FERC rulings to the courts. An intervenor is required to serve copies of anything he
or she files on a(I other parties, a process that is sometimes expensive and time-consuming. If
you have more questions about your rights at the FERC, please refer to the enclosed pamphlet or
contact the FERC.
Eminent Domain - General Information
A pipeline's rights to use eminent domain to acquire a right-of-way to construct and maintain a
praject on a landawner's property is a statutory right granted by Congress in Section 7(h) ofi the
Natural Gas Act. The power of eminent domain is conferred on a pipeline in cases where the
FERC finds the proposed project to be required by the public convenience and necessity. Then,
if the pipeline company cannot otherwise reach a negotiated agreement with the property owner,
it may exercise the right of eminent domain. This involves condemnation proceedings where a
court decides the appropriafe compensation fo be paid by the pipeline to the landowner for the
easement. It is MEP's policy to negotiate with landowners in good faith, in a fair and honest
manner, to reach a mutually agreeable resolution of issues necessary to the acquisition of a right-
of-way in which to cons#ruct and focate the project, thereby avoiding use of #he eminent domain
statutes. Should such a proceeding become necessary, however, campensation for property
obfained by eminent domain is determined by fhe laws of the state in which the condemnation
proceeding takes ptace.
Eminent Domain Law in Louisiana
Eminent Domain in Louisiana, ar "expropriation," is governed by Title 19 of the Louisiana Revised
Statutes. Before an expropriation suit may be filed, the party seeking the property or rights from
the landowner (the "condemnor") must conduct good faith, bona fide negotiations with the
landowner. This means that before an expropriation suit can be filed, the parties must attempt to
agree on the compensation to be paid for fhe property or rights the condemnar wishes to acquire.
Those parties entitled to file condemnation proceedings in Louisiana are listed in Title 19, Section
2 of the Louisiana Revised Sfatutes, and inc[ude natural gas pipelines.
If the parties cannot agree on compensation, expropriation proceedings are initiated when the
condemnor files a petition in the district court of the Parish in which the properfy or rights are
situated. Thereafter, the trial court fixes the fime of the #rial within sixty days from the filing of the

suit, and the landowner is notified at least sixty days before the time fixed for trial. The
proceedings are tried before the court without a jury; however, a party has a right tc) a jury trial to
determine compensation. If the trial judge decides in favor of the condemnar, a jury is impaneled
within thirty days to decide the rneasure of compensation. The condemnor then presents its
evidence of value, followed by the landowner. After evidence is presented from both sides, the
court renders judgment against the condemnor in the amount of compensation determined to be
due the landowner. If the righ# of the condemnor to expropriate the property or rights is
challenged, the court also decides this issue.
After a final judgment, a landowner may appeal the judgment within sixfy days from the signing of
the judgment. The condemnor is not en#itled to possession or ownership until a final judgment
has been rendered and payment has been made to the landowner or paid into the registry of the
court.
Eminent Domain Law in Missis5lppl
Chapter 11, Title 27, of the Mississippi Code governs condemnation proceedings in the State of
Mississippi. Condemnafion proceedings are brought in the Special Court of Eminent Domain,
which is the County Court in counties that have a County Court or the Circui# Court in counties
that do not. The only issue at trial in a condemnation proceeding is the amount of due
compensation a condemning authority has to pay a landowner in whose property an interest is
taken.
Prior to trial, a landowner may challenge the condemning authority's exercise of the power of
eminent domain. Both the United States and Mississippi Gonstitutions govern the property righfs
of landowners. The Mississippi Constitution states that land may not be taken or damaged for
public use wi#hout paying due compensation. The state legislature grants governmentaf and
private bodies the pawer of eminent domain. The court determines whether the proposed use is
a public use. Landowners may challenge, (1) whether the commending authority has been
granted the power of eminent domain, (2) whether the proposed use is a public use, and (3)
whether the taking is required by public necessify.
Once the triaf has occurred, and the jury has determined the amount of due compensation, the
condemning authority may take title to the property upon paying the landowner the arnount of the
judgmenf. Because the condemning authority is not able to take #itle to the property without
paying due compensation, neither the condemning authority's payment of the judgment, nor the
landowner's acceptance of the money, act as a waiver of the right to appeal. If an appeai is
pursued after the judgment is entered, it will be only for the amaunt of compensation awarded.
Eminent Domain Law in Texas
Chapter 21 of the Texas Property Code govems condemnation praceedings in the State of
Texas. A condemnation proceeding is a two-parf process, involving an initial administrative
proceeding and, if necessary, a judicial proceeding. Before initiating a condemnation proceeding,
a condemnor must make an aftempt to agree with the landowner regarding the amount of
compensation due for the property rights being acquired. This obligation is generally satisfied if
the condemnor makes a single bona fide offer that it in good faith believes is the amount of
cornpensafion due and the landowner rejects the offer.
The administrative phase begins when the condemnor files a condemnation petition in the Counfy
Court at Law or District Court of the proper county. Once a petition is filed, the trial court appoints
three special commissioners to assess the value of the property rights being acquired. After
taking their aath, the special commissioners schedule an administrative hearing to deterrnine the
amount of compensation due for the property being condemned. A landowner is enfitled to notice
of the fime and place of the hearing and may choose not to attend.

At the hearing, the candemnor, and Ehe landowner if it chooses to attend, presents evidence
regarding the amount of compensation due for the property being condemned. The special
commissioners then determine the compensation due and fife their award wifh the court. Once
the special commissioners fi{e their award, the condemnor may take possession of the
condemned proper#y by depositing the amount of the award in#o the registry of the court and
executing a bond to secure payment of additional costs. The condemnor and the landowner also
have twenty days after the award is filed fo file objections to the award. If objections are filed, the
case becomes a judicial proceeding and is tried in the same manner as other civil cases. If no
objections are filed, the court has no option but to enter a judgment on the special
comrrtissioners' award.

1'ake notice that on January 29, 2009, Midcontinent Express Pipeline LLC
(iVlidcontinent) 3250 Lacey Roaa, Suite 700, Downers Grovt, Illinois 60515, filed an
application in Docket No. CP09-56-000, pursuant to section 7(c) of the Natural Gas Act
(NGA) and Part 157 of the Coinmission's reb ilations, requesting a certificate of public
convenience and necessity to construct and operate facilities to expand the capacity of its
system in Zone 1 by 300,000 Dth per day. Specifically, Midcontinent proposes to increase
compression at three certificated compressor stations: (1) Lamar Compressor Station in
Lamar County, Texas - one new 6,135 horsepower (hp) unit; (2) Atlanta Compressor
Station in Cass County, Texas - two new units totaling 16,360 hp and an increase the
certificated level of operation of two compressor units requested in Docket No.
CP08-6-002 by a total of 4,090 hp; and (3) Vicksburg Compressor Station in Hinds
County, Mississippi - one new 6,135 hp unit. In addition, Midcontinent proposes to add a
new inlet filter/separator at its certificated Perryville Compressor Station in Union Parish,
Louisiana. Midcontinent requests a determination that rolled-in rate treatment is
appropriate for the proposed facilities.

a Notice of Schedule for Environmental Review will serve to notify federal and state
agencies of the timing for the completion of all necessary reviews, and the subsequent need
to complete all federal authorizations within 90 days of the date of issuance of the

MEP Noise Impact Comparisons
The tables below summarize the noise studies that were conducted for MEP's original Federal Energy Regulatory
Commission (FERC) filin-, its amendment filing (where applicable) and the expansion filing For each of the three
compressor stations. The data presented in these tables includes the existing measured ambient noise levels before the
project started, the combined future noise levels (the currently existing levels plus the contribution of the proposed
compressor stations as modeled in the original filin-, the amendment and the expansion) and the resultin- expected increase
in noise over currently existin- conditions at the noise-sensitive areas (NSA) near each site. FF,RC limits compressor
station noise (not counting currently existing leveis) to no greater than an Ld„ of 55 decibels (dBA), and the calcufated
compressor station noise levels at each NSA location have been modeled to not exceed this limit.
The 55 dBA limit is a level that the Environmental Protection Agency recommends for °`outdoor residential areas and farms
and other outdoor areas where people spend widely varying amounts of time and other places in which quiet is a basis for
use." The EPA considers this level as protective of the public health and welfare from the effects of environmental noise
and notes that this criterion was developed without regard to technical or economic feasibiliry and contains a margin of
safety. ln areas where the existing noise levefs are ciurently above 55 dBA, as is true for soine of Lhe iV1EP NSAs as shown
below, the addition of another 55 dBA sound results in only minimal increases to future noise levels due to the logarithmic
nature of decibel addition. This is one reason that FERC utilizes an absolute noise standard, so that there is a limit to how
much noise can be increased. In fact, addinlg a 55 dBA sound to any sound that is already at 55 dBA or greater, will result
in increases in noise of only 3 dE3A or less. Increases in noise of 3 dBA or less are considered to be barely perceptible.
The Ld. is a measurement used by the FERC for evaluating compressor station noise. It is the avera-e of the noise
occurring over a 24- hour period, but with a 10 dBA penalty for noise that is generated durinb the ni-ht. Noise levels from
the compressor stations will be steady in level durin- all hours. Therefore, on a continuous 24-hour basis, the compressor
stations are actually limited to a sound level of 49 dBA at any residence (this is the sound level that must be achieved
during the post construction testing).
MEP will ensure its operations do not exceed regulatory noise limits. While the increases in noise will be relatively small in
most cases, it is likely that, depending on location, time of day, weather and levels of noise from other soLirces, some
landowners within a half-mile of a compressor station will be able to hear it, at least at some times of day.

(ETCADA) in the City of Paris 2009 budget. We are working hard to ensure that people with drug
and alcohol addictions receive the help they need.
ET'CADA counselars provide the clinical screening and assessment that allows low-income
individuals access state-funded treatment. We also provide prevention services that reduce the use of
alcohol and other drugs by our youth. In addition, ETCADA provides a crisis hotline that is available

OSAR (Individual Counseling to Access Drug/Alcohol Treatment):
Licensed Chemical Dependency Counselors provide confidential services for
individuals seeking treatment for alcoholism and/or drug addiction.
After Hours Crisis Help Line: Free, confidential and immediate assistance
available 24 hours/7 days per week.
School-Based Prevention Programs: Using research-based curricula with
proven outcomes, trained ETCADA staff facilitate drug and alcohol prevention
programs in local schools. These programs are designed to reduce the onset of
the use of alcohol, tobacco and other drugs by youth.
Tobacco Compliance Checks: ETCADA staff provides education for retailers
who sell tobacco products to ensure that youth under age 18 are not allowed to
purchase tobacco and to ensure retailer compliance when receiving "tobacco
stings" by law enforcement.
Community Presentations: Our professional staff accepts invitations from
organizations, churches and schools to educate people about alcoholism and drug
addiction and to make them aware of prevention and intervention services
available throughout East Texas.

Dear Mayor Jesse James Freelan:
March 15-21, 2009 marks the 47th annual observance of Poison Prevention Week. This
time is used to encourage our citizens to learn more about the dangers of accidental
poisonings and to take more preventive measures.
On behalf of the North Texas Poison Center I, am requesting that March 15-21, 2009 be
proclaimed as "Poison Prevention Week" in Paris.' Enclosed is a suggested proclamation.

Whereas, our society has become increasingly dependent on household chemicals to perform
labor-saving, time-saving miracles; and on medicine to provide health-giving, life-sustaining
benefits;
Whereas, these products, when not used as intended or directed, may be hazardous, particularly
if children gain access to them;
Whereas, over the past 47 years, the nation has been observing Poison Prevention Week to call
attention to these hazards and how proper handling and disposal of these substances and proper use
of safety packaging can help eliminate them;
Whereas, the efforts of our community organizations, complemented by the efforts of the North
Texas Poison Center have reduced childhood poisonings in Paris,Texas.
Whereas, the North Texas Poison Center, a regional poison center, located at Parkland
Memorial Hospital, provides the ultimate in human service programming, immediate, accessible
emergency information to safe lives of victims of poison-related emergencies, and;
Whereas, these programs must continue as long as even one child swallows a household product
or medicine by mistake.
NOW, Therefore, I, Jesse James Freelan, Mayor of the City of Paris, do hereby proclaim the
week of March 15-21, 2009, as Poison Prevention Week in this City. Further, I direct the
appropriate agencies in our local government to continue their cooperation with concerned citizens
and community organizations, including our schools, to develop programs which will alert our
people to the continued danger of misusing medicines and household products and to promote
effective safeguards against accidental poisonings among young children.
