Move to approve a request for a curb and gutter variance, acceptance of a subdivision improvement
agreement, and acceptance of an off-site utility easement and the Final Plat of the New Paris High
School CB 350.
POLICY ISSUE(S):
Plat approval, variance, easement acceptance and subdivision improvements
BACKGROUND:
This final plat will allow Paris Independent School District to construct the new high school. The
District has submitted a variance on construction of curb and gutter along South Collegiate Drive. The
Thoroughfare Plan calls for South Collegiate Drive to be an arterial level street with 60-feet of pavement
and 80-foot of Right-of-Way.
An off-utility easement is necessary because water and sewer lines must be extended from existing lines
in easements to the proposed final plat property. The existing water and sewer line are north of the
subject property near the Love Civic Center. A 25-foot permanent utility easement and 25-foot
temporary construction easement are needed from Paris Junior College (PJC) in order to accommodate
the new water and sewer lines. PJC owns the property south of the civic center. The PJC Board of
Regents will meet March 23, 2009 to act on the easement. I recommend that the easement acceptance
be approved contingent upon PJC's Board of Regents approving the easement.
The subdivision improvement agreement will be provided at the council meeting. The PISD Board will
vote on the agreement Monday morning and deliver the completed document to the City.
BOARD/COMMISSION RECOMMENDATION:
The Commission recommended approval of the final plat subject to City Engineer's recommendations
by a vote of 5-0.

SUBJECT: New Paris High School CB 350
I have reviewed the final plat of the above referenced addition. It appears that the final plat
complies with the City of Paris subdivision regulations with the following exceptions:
l. The guarantee of construction form must be completed and approved concurrently with
the final plat.
2. Add CB 350 to the plat name.
3. Add a 35-foot building setback line to the three roadway frontages.
4. Add a 20-foot by 20-foot easement for AT&T at the Northwest end of the property.
I recommend approval of the final plat upon submission of a corrected mylar copy with
signatures of the surveyor and owners prior to noon on March 9, 2009.

RE: PROPOSED VARIANCE FOR NEW HIGH SCHOOL DEVELOPMENT

The purpose of this letter is to formerly request a Variance from the
Concrete Curb and Gutter requirements of the Subdivision Ordinance
number 29.57 for the Proposed New Paris High School. As you are aware the
Paris Independent School District is developing a new High School at the
intersection of South Collegiate Dr. and Highway Loop 286. It has come to
our attention that extreme grade changes exist from each edge of the
existing road and the new grades along the property line that are being
developed. Also since at this time the Paris ISD nor the City of Paris are
developing South Collegiate Dr. into a new road it would be impractical to
install this new curb and gutter along the adjacent property side of the road.
It would not be usable for the future development of said road.
Thank you for your immediate consideration of this matter. We look forward
to the approval of our permit and developing this and future projects to
enhance our community.

That Paris Junior College of Lamar County, Texas, (hereinafter referred to as
GRANTOR) for and in consideration of the sum of TEN DOLLARS ($10.00) cash, and other
good and valuable consideration, to us in hand paid by the CITY OF PARIS, Texas, the receipt
and sufficiency of which is hereby acknowledged, do hereby give, grant and convey unto the
said CITY OF PARIS, TEXAS a home rule municipal corporation (hereinafter referred to as
GRANTEE) a perpetual utility easement described as follows:
SITUATED within the corporate limits of the City of Paris, County of
Lamar and State of Texas, a part of the George W. Cox Survey, Abstract No. 164,
also being part of a 0.3732 acre tract of land conveyed to Regents of Paris Junior
College District by deed recorded in Volume 350, Page 172, of the Lamar County
Real Property Records, and being more particularly described by metes and
bounds in Exhibit "A" attached hereto and made a part hereof by reference
("Premises").
TO HAVE AND TO HOLD the above property unto the GRANTEE for the purposes
aforesaid, with the right and privilege at any and all times to enter said Premises, or any part
thereof, and construct, reconstruct, relocate, inspect, and maintain any and all utilities
(including, but not limited to water, sewer, drainage) and placed or to be placed therein
(hereinafter "Facilities"); provided that Grantee will, after doing any work in connection with
the construction, reconstruction, relocation, inspection, or maintenance of said utility
facilities, restore the surface as close to the condition in which said surface was found when
such work was undertaken, insofar as permitted under the plans, standards, and specifications
approved for projects to be located within the herein described easement, and that in the use
of said rights and privileges herein granted, the GRANTEE will not create a nuisance or do any

act that will be detrimental to said Premises; and provided further, that the GRANTOR shall
not erect or place any building, fence, tree or other permanent structure on the
above-described perpetual easement and shall not otherwise use the above-described
Premises in a way that will interfere with the construction, maintenance, repair, inspection, or

GRANTOR does hereby bind itself, it's heirs, executors and administrators, to warrant
and forever defend, all and singular, said premises unto the GRANTEE against every person
whomsoever lawfully claiming or to claim the same or any part thereof.

22, 1956, to Regents of Paris Junior College District, recorded in Volume 350, Page 172 of the
Lamar County Deed Records (L.C.D.R.), the 0.3732 acre utility easement is more particularly
described by metes and bounds as follows (all bearings cited herein are based on The Texas

BEGINNING at a point in a curve to the right in the east right-of-way line of Farm Road
