RECOMMENDED MOTION:
Deliberate and act on a resolution and authorizing Change Order #1 and final of the
contract with Richard Drake Construction for the 0.8 miles eastern extension of the Trail
de Paris; authorizing the City Manager to negotiate and execute all necessary documents.

BACKGROUND:
This section of the Trail de Paris is between Loop 286 and Old Clarksville Road
intersection with the old railroad bed. This is the section that had the bridge installed
over Loop 286. The original contract amount for this extension was $110,962.44 for two
different bid items. The new contract amount is $108,106.83, a deduction of $2,856.61.
The reason for the reduction in cost is based on the actual quantity of material used on the
Trail de Paris extension. The attached Change Order No. 1 shows the differences in
estimated and actual quantities used. We will be reimbursed by Texas Parks & Wildlife
for almost $100,000 upon submitting the required documents.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
TEXAS, APPROVING CHANGE ORDER NO. ONE TO THE CONTRACT
FOR THE CONSTRUCTION OF THE TRAIL DE PARIS 0.8 MILE
EASTERN TRAIL EXTENSION PROJECT; MAKING OTHER FINDINGS
AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN
EFFECTIVE DATE.
WHEREAS, the Ciry Council of the City of Paris did heretofore, on the 25th day of
August, 2008, in Resolution No. 2008-068, award the contract for "Trail de Paris 0.8 Mile
Eastern Trail Extension Project,", to Richard Drake Construction Company of Paris,
Texas; and,
WHEREAS, the City Engineer, Shawn Napier, acting as project engineer,
recommends the amendment of the contract for said project based on the actual materials
used, and providing for a net decrease of $2,856.00 in the contract price, for a revised
contract price of $108,106.83; and,
WHEREAS, the form of Change Order No. One, attached hereto as Exhibit A,
should, in all things, be approved, and the City Manager should be authorized to execute the
same;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble of this resolution are
hereby in all things approved.
Section 2. That the form of Change Order No. One to the Contract for the "Trail
de Paris 0.8 Mile Eastern Trail Extension Project,", attached hereto as Exhibit A,
based on the actual materials used, and providing for a net decrease of $2,856.00 in the
contract price, for a revised contract price of $108,106.83, be, and the same is hereby,
approved. ,
Section 3. That the City Manager be, and he is hereby, authorized and directed
to execute, on behalf of the City of Paris, said Change Order No. One, upon the terms and
conditions and in the form shown in Exhibit A, attached hereto.
Section 4. That this resolution shall be effective from and after the date of
passage.
