RECOMMENDED MOTION:
Deliberate on a resolution to abandon a portion of a sewer line easement on property owned by Roger-
Wade Manufacturing Co., authorizing the City Manager to negotiate and execute all necessary
documents.

BACKGROUND:
The City was approached by Roger-Wade about relocating a sewer line in the early 1990's. They
proposed to build a building that would be on top of an existing sewer line. A drawing is attached that
shows the sewer line easement and sewer line location. The current easement is labeled on the drawing
and a portion of the easement is under a building. The sewer line was relocated as shown on the
attached sheet. No easement has been dedicated for the existing sewer line location. Staff recommends
that a 15-foot easement be dedicated to the City for the existing sewer line location.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
DECLARING A PORTION OF A CERTAIN SEWER EASEMENT LOCATED ON AND
ACROSS PROPERTY BELONGING TO ROGERS-WADE MANUFACTURING
COMPANY IS NO LONGER NEEDED AND IS OF NO USE TO THE CITY OF PARIS;
ABANDONING THAT PORTION OF SAID SEWER EASEMENT; AUTHORIZING
THE CITY MANAGER TO EXECUTE ANY AND ALL DOCUMENTS NECESSARY
TO ABANDON SAID SEWER EASEMENT; MAKING OTHER FINDINGS AND
PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE
DATE.
WHEREAS, it has been determined by the City of Paris that the a portion of a certain
sewer easement contained in Right-of-Way Deed from Sallie Lee Lightfoot to City of Paris
attached hereto as Exhibit A is located on and across property belonging to Rogers-Wade
Manufacturing Company, as shown in the Survey attached hereto as Exhibit B, and is no longer
needed by the City of Paris for sewer line purposes; and,
WHEREAS, it has been determined that this easement is no longer needed by citizens of
Paris for sewer line purposes, and the same should be abandoned;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PARIS:
Section 1. That the findings set out in the preamble of this resolution are hereby in all
things approved.
Section 2. That the portion of that certain sewer easement located on and across
property belonging to Rogers-Wade Manufacturing Company, described in the Sewer Easement
Abandonment attached hereto as Exhibit C be, and the same is hereby, declared to be no longer
needed by the citizens of the City of Paris for sewer line purposes.
Section 3. That the above described portion of a certain sewer easement, is hereby
abandoned and the City Manager be, and is hereby directed to execute the Sewer Easement
Abandonment attached hereto as Exhibit C and any other documents necessary to abandon such
portion of sewer easement.
Section 4. That this resolution shall be effective from and after the date of passage.

} KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF LAMAR }
That the City of Paris, Texas a home rule municipal corporation of the
County of Lamar, State of Texas, acting by and through its City Manager, duly
authorized by Resolution No. 2009- . for and in consideration of the sum of
Ten and no/100 Dollars ($10.00) cash and other good and valuable
consideration, in cash, to it in hand paid by Rodgers-Wade Manufacturing
Company the receipt and sufficiency of which is hereby acknowledged; has
Abandoned, Sold and Conveyed, and by these presents does Abandon, Sell and
Convey unto the said Rodgers-Wade Manufacturing Company of the County
of Lamar, State of Texas, whose mailing address is 1401 SW 3rd Street, Paris,
Texas 75460, the City of Paris' interest in a portion of a sewer easement as
depicted in the survey attached hereto and incorporated herein as Exhibit A, and
as further described as follows:
SITUATED within the corporate limits of the City of Paris, Lamar
County, Texas, a part of the Larkin Rattan Survey , and being a
portion of that certain sewer line easement contained in Right of
Way Deed from Sallie Lee Lightfoot to the City of Paris dated
March 15, 1935, recorded in Book 242, Page 348, Lamar County
Deed Records and being the entirety and entire width of said
sewer easement along the following line:
BEGINNING AT A POINT 586 FEET North from the
beginning point of the above referenced sewer easement and
being in the south line of the Texas Midland right-of-way for spur
track;
THENCE with the South line of said Texas Midland
right-of-way (as it existed) in a Southwesterly direction 873 feet,
more or less, to the point where said Texas Midland right-of-way

intersects the East line of South Travis Street (now known as 4th
Street SV1).
TO HAVE AND TO HOLD the above described property unto
Rodgers-Wade Manufacturing Company for the purposes aforesaid, together
with all and singular, the rights and appurtenances thereto in anywise belonging
unto the said City of Paris, Texas its successors and assigns forever. This
conveyance shall be without warranty of any kind, whether express or implied.
WITNESS its hand at Paris, Texas, this 27th day of April, A.D. 2009.
